CALL TO ORDER
An Adjourned Regular Meeting of the San Luis Obispo City Council was called to order
on Tuesday, December 9, 2014 at 6:00 p.m. in the Council Chamber, located at 990
Palm Street, San Luis Obispo, California, by Mayor Marx.

Present: Council Members Dan Carpenter, Carlyn Christianson, Dan Rivoire, Vice
Mayor John Ashbaugh, and Mayor Jan Marx
Council Member
Absent: None
City Staff
Present: Katie Lichtig, City Manager, Christine Dietrick, City Attorney, Michael
Codron, Assistant City Manager, and Anthony Mejia, City Clerk, were
present at Roll Call. Other staff members presented reports or responded
to questions as indicated in the minutes.
PLEDGE OF ALLEGIANCE
Council Member Carpenter led the Pledge of Allegiance.
PUBLIC COMMENT
There was no one present desiring to speak during public comment.

INCONSISTENT WITH THE AIRPORT LAND USE PLAN AND ADOPTION OF
APPROPRIATE RESOLUTIONS, ORDINANCE AND FINDINGS TO APPROVE
THE LUCE UPDATE AND IMPLEMENTING ZONING
Community Development Director Johnson, Community Development Deputy
Director Murry, Nick Johnson, of Johnson Aviation, and Lori Ballance, of Gatzke,
Dillion, and Balance, LLP, narrated a presentation entitled "Land Use and
Circulation Element Update" and responded to Council inquiries.
Mayor Marx re- opened the public hearing.
Michelle Tasseff, San Luis Obispo, noted that she supports development of
affordable housing and the proposed homeless service center; spoke on her
experiences witnessing aircraft accidents in the San Diego area; recommended
that the Council work with Caltrans and the Airport Land Use Commission
(ALUC) to ensure public safety.
Carolyn Smith, San Luis Obispo, urged Council to work with the ALUC to resolve
areas of conflict relative to the Land Use and Circulation Elements.
Stew Jenkins, San Luis Obispo, voiced concerns regarding the possibility and
potential impacts of an aircraft accident if residences are developed in the airport
area; noted that Council has the discretion to postpone action on the matter;
urged Council to work with the ALUC to find resolution.
Linda White, San Luis Obispo, advised that her concerns regarding the LUCE
relate to public safety, not noise impacts; pointed out a small aircraft accident
recently occurred in Massachusetts.
Dawn Legg, San Luis Obispo, noted that subject matter experts in aviation
assisted in the development of the LUCE and have evaluated potential risks;
voiced support for an overrule of the ALUC determination of inconsistency.
Jacob Rogers, representing Cal Poly ASI, requested that Council work
collaboratively with Cal Poly to address student housing, noting that students
housed within neighborhood can add diversity and culture.
Dan Blandford, San Luis Obispo, voiced support for overruling the ALUC, opining
that elected officials should have final authority on local land use decisions.
Mila Vuiovich- LaBarre, San Luis Obispo, voiced objection to the adoption of the
LUCE, noting concerns regarding infrastructure, environmental impacts, and
noise; asserted that the LUCE will not support more affordable housing; urged
Council to continue working the ALUC.

1 Richard Kreisa, San Luis Obispo, advised that he circulated a petition in 1969
regarding pollution and calling for the creation of a natural resources protection
agency and creek plan; voiced concern that the LUCE considers natural
resources and manmade development coequal, opining that such a viewpoint
could further deteriorate the downtown creek areas.
Brian Reel, San Luis Obispo, advised that he is a pilot and flies out of San Luis
Obispo airport; expressed concern that Johnson Aviation does not disclose
assumption used to obtain the proposed noise contours; suggested that the
noise study does not support the proposed mix of operations.
There being no others desiring to speak on this item, the public hearing was
closed.
In response to public comment, Community Development Director Johnson
noted that the Legislature expressly authorizes the Council, under the State
Aeronautics Act, to overrule an adopted airport land use plan, if necessary;
pointed out that staff has worked with the LUCE Task Force and Planning
Commission to present Council with factual evidence; advised that the LUCE
minority report is available online and on file with the City.
Following discussion, MOTION BY COUNCIL MEMBER CHRISTIANSON,
SECOND BY COUNCIL MEMBER RIVOIRE, CARRIED 4 -1 (COUNCIL
MEMBER CARPENTER VOTING NO), to adopt Resolution No. 10585 (2014
Series ) to overrule the Airport Land Use Commission's determination of
inconsistency relative to noise contours and type and density of land uses within
portions of safety zones S -1 b, S -1 c, and S -2 of the Airport Land Use Plan, said
resolution is entitled:
"A Resolution of the City Council of the City of San Luis Obispo, California,
overruling the County of San Luis Obispo Airport Land Use Commission
(ALUC) determination that the proposed Land Use and Circulation
Element (LUCE) update and related airport overlay zoning amendments
are inconsistent with the Airport Land Use Plan (ALUP)."
MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER
CHRISTIANSON, CARRIED 3 -2 (COUNCIL MEMBER CARPENTER AND
MAYOR MARX VOTING NO), to amend Land Use Element Section 8.3.2.4(a) to
read as follows "Provide land and appropriate financial support for development
of a Prado Road connection. Appropriate land to support road infrastructure
identified in the Final Project EIR (overpass or interchange) at this location shall
be dedicated as part of any proposal and any area in excess of the project's fair
share of this facility shall not be included as part of the project site area used to
1 calculate the required 50% open space.

MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER
CHRISTIANSON, CARRIED 3 -2 (COUNCIL MEMBERS CARPENTER AND
RIVOIRE VOTING NO), to amend Land Use Element Section 2.5.1 to read as
follows "The City shall encourage Cal Poly to build housing on campus for all of
its students, to the extent feasible. On- campus housing should be expanded at
least as fast as enrollment increases. Consideration shall be given for housing for
faculty and staff as student enrollment increases.
MOTION BY COUNCIL MEMBER CARPENTER, SECOND BY VICE MAYOR
ASHBAUGH, CARRIED 5 -0, to amend Land Use Element Section 1.2 to be
entitled "Build Out Capacity" and to read as follows "There should not be major
expansion of the urban reserve line because the urban reserve provides
adequate capacity for new housing and employment up to the City's desired
maximum. This element seeks to establish an ultimate population capacity."
MOTION BY VICE MAYOR ASHBAUGH, SECOND BY COUNCIL MEMBER
CHRISTIANSON, CARRIED 4 -1 (COUNCIL MEMBERS CARPENTER VOTING
NO), to adopt Resolution No. 10586 (2014 Series) approving: a) updates to the
City's Land Use and Circulation Elements (LUCE) project, including the South
Broad Street Area Plan; and (b) Compendium of changes to the draft documents
including findings to support a determination that project modifications do not
warrant additional environmental review in conformance with CEQA section
15162; and related amendments to the Noise, Safety, and Conservation and 1
Open Space Elements of the General Plan for internal consistency; and (c) Land
Use Element map changes to reflect updated land use designations, said
resolution is entitled:
"A Resolution of the City Council of the City of San Luis Obispo, California,
approving updates to the Land Use and Circulation Elements of the
General Plan including associated amendments to the South Broad Street
Area Plan, Noise Element, Safety Element, and Conservation and Open
Space Elements; and, approving amendments to the General Plan Land
Use designations for special focus areas associated with the General Plan
Land Use and Circulation Element update project (GPI /ER 15 -12)."
MOTION BY MAYOR MARX, SECOND BY VICE MAYOR ASHBAUGH,
CARRIED 4 -1 (COUNCIL MEMBERS CARPENTER VOTING NO), to:
1. Modify Table 10, footnote UZ', to read as "These uses not allowed within
10,000 feet from the end of primary runway 11 -29 for a width of 1,000 feet on
an extension of runway centerline; and are not allowed within 2OW 4000 feet
from the end of the existing secondary runway 7 -25 for an area 1000 ft wide
on an extension of the runway centerline."

2. Introduce Ordinance No. 1610 12014 Series) amending the Municipal Code to
t add an Airport Overlay Zone, Special Focus Areas Overlay Zone, and
amending Zoning designations for LUCE special focus areas consistent with
General Plan amendments, said ordinance is entitled:
"An Ordinance of the City Council of the City of San Luis Obispo,
California, amending Title 17 (Zoning Regulations) of the Municipal Code
(GPI /ER 15 -12)."
