Emmons Blake, John C. Brown, Myron Graham, T. Keith Gurnee, Kenneth E. Schwartz Present: J. H. Fitzpatrick, City Clerk; A. J. Shaw, Jr., City Attorney; R. D. Miller, City Administrator; R. Young, Planning Director; D. F. Romero, City Engineer; R. A. Paul, Water.Department Director 1. The City Council considered the adoption of an emergency ordinance adding a dangerous tree abatement procedure to the Municipal Code, to'provide for abatement of dangerous obstructions in streambeds during the rainy season. A. J. Shaw, Jr., City Attorney, reviewed the proposed urgency ordinance adding to the Municipal Code provisions for abatement of such structures to include trees, etc. D. F. Romero, City Engineer, objected to the provisions in the ordinance which would allow the City's Tree Committee to make the final decision on tree removal. He felt that they were more interested in the aesthetics of the trees than in abatement of dangerous obstructions in the creek. Dr. Howard Brown, member of the Tree Committee, stated that the Tree Committee had a horticulturist on its subcommittee in order to properly do the job of advising the Tree Committee and the City Engineer on the conditions of trees in.the waterways and creeks. Further discussion of the proposed emergency.ordinance.was continued to Friday, February 9, 1973. Mr. Lee Burkett, 1304 Oceanaire Drive, suggested to the City Council that they should look into the acceptance of the subdivisions in the Laguna Lake area as to the elevations of the house slabs and the eleva- tion of the road at the crown of the Madonna Road culvert. He asked what'the relationship between these slabs and the top of the pipes that empty the lake outlet were. Communication from Valerie Endres objecting to the City Council not seriously considering the removal of the barrels for drainage of Laguna Lake at Madonna Road and replacing them with a steel bridge which would allow more.water to pass under and.not cause flooding. She noted that. the matter was not referred to anyone for study and she hoped that the Council would not ignore the suggestion. The City Council then discussed with the City Engineer what steps should be taken to remedy the Laguna Lake outlet at Madonna Road in order to 1 avoid a repetition of the January flooding when the barrels under the road could not handle the water. After discussion, it was moved by Councilman Gurnee,.seconded.by Councilman Brown, that the City Engineer.be instructed to prepare a sketch to construct a swale or dip in Madonna Road east of the lake outlet in an attempt to remove some of the surplus or flooding'waters from the lake area. Motion carried with Councilman Blake and Mayor Schwartz voting no. City Council Minutes February 7, 1973 Page 2 2. Request by Mustang Village for additional time to complete work involving fill on their property. After discussion, it was moved by Councilman Blake, seconded by Council- man Graham, that .150 days be allowed to complete the work.with no extension of time. 3. Councilman Gurnee presented to the City Council a suggestion for the formation of an interagency task force.between the County Supervisors and their staff.and.the City Council and.their staff in an attempt to create a program for watershed debris clean -up, for guidance in reconstruction of damaged public facilities, to define and identify obvious hazards within the City and outside the City in the waterways and to try to arrive at an abatement procedure for immediate hazards. The interagency task force would also be responsible for an early warning system study of the flood plains and a definition of flood- inducing activities within the watershed. The interagency of both County and City officials would be charged with the study of the causes of flooding in.the San Luis Creek watershed, to monitor all flood - related studies and remedial measures within the watershed, to monitor planning decisions and activities within the watershed as they relate to all aspects of flooding, and to make recommendations to the legislative bodies of the City and County as to: (1) planning program, (2) priority schedule for reconstruction of damaged facilities, (3) establishment of design criteria, (4) varied ordinances and regu- lations, and (5) potential funding of future and presently proposed programs. Councilman Brown.felt that the City would be better served if it were involved in a County flood control zone of the County flood control district. Mayor Schwartz felt the proposal was a good one in attempting to arrive at a correct solution to floods and flooding and having the force composed of both City and County officials, decisions could be made that could be carried through. He moved that a task force be appointed . as outlined consisting of legislative, administrative and'planning . commission staff members of both the City and County to start long -range studies and hope that the Board of Supervisors would take similar action. The motion was withdrawn from further consideration. On motion of Mayor Schwartz, seconded by Councilman Gurnee, the Mayor was authorized to contact the County Board of Supervisors regarding the formation of an interagency task force to study the flood problems. Motion carried. 3A. R. A. Paul, Water Department Director, brought to the Council's attention the plans and specifications for a twenty -four inch transmission line relocation at Brizzolara Creek crossing on the Cal Poly Campus. This project was the relocation of a City water main when the new entrance to Cal Poly was constructed. The cost of relocation including engineering and inspection would be paid for by the State, but would be supervised and inspected by the City of San Luis Obispo. On motion of Councilman Blake, seconded by Councilman Graham, that the City was authorized to call for bids on the twenty - four.inch transmission line relocation at Brizzolara.Creek crossing, approve the plans and. specifications subject to State financing-and an alternate water supply during construction. On motion of Councilman Blake, seconded by Councilman Brown, that Item 4, a general discussion relative to placing certain measures on the April General Municipal Election Ballot be tabled. Motion lost with Councilmen Graham, Gurnee and Mayor Schwartz voting no. The matter of placing certain measures on the April ballot as guidance to the City Council was continued to a future meeting. 1 1 The meeting was adjourned. Ll 1
