City Hall Pledge Roll Call Present: Absent: City Staff John C. Brown, Myron Graham, T. Keith Gurnee, and Kenneth E. Schwartz Jesse.- E. Norris Present: J. H. Fitzpatrick, City Clerk; A. J. Shaw, Jr. City Attorney; R. D. Miller, City Administra- tive Officer;.David Williamson, Assistant Administrative Officer; D. F. Romero, City Engineer. Others Present: Mrs. John Boriack I. City Council met with Mrs. Boriack regarding acquisition of an easement for flood drainage pipe through and under her property at 172 Broad Street. Mrs. Boriack stated that she was aware of the project, that she was basically opposed to this construction and that her attorney and appraiser had not had an opportunity to get together since the Monday night meeting to come up with an alternate proposal for her to present to the Council or to even discuss values and possible damages to her property. She stated that she was not trying to be difficult, but that she was trying to protect herself and her property. D. F. Romero, upon questioning, stated that it would take six weeks before a contractor could actually start construction if the Council approved the plans today, which at this time included plan preparation, advertising, award of bid, and start of construction. Mayor Schwartz asked if an environmental impact report was required on this project. D. F. Romero, City Engineer, answered that the Planning Commission had alread determined that an EIR was not needed, that this was not a new project but an improvement to an existing project. Mrs. Boriack, City Council and Staff discussed what they felt would be the best route for installing the new drain pipe through her property, particularly to determine which installation would cause the least future damage to her property and not necessarily which was the cheapest. Mrs. Boriack, offered several alternatives, in a spirit of cooperation to help reduce cost in replacing property and improvements. On motion of Councilman John C. Brown, seconded by Councilman Myron Graham, that the City Council (1) Continue their action on the order of immediate possession on the Boriack property as ordered October 15, 1973. City Council Minutes October 18, 1973 Page 2 (2) That the City Engineer advertise for bids on Alternates "A" and ''B" as modified. Bids to be received for the November 5, 1973 meeting. (3) That the City Council again meet with Mrs. Boriack on Friday, October 26, 1973, at 12:15 P.M. to see if a final agreement could be arrived at. Motion carried. AYES: John C. Brown, Myron Graham, T. Keith Gurnee, and Kenneth E. Schwartz NOES: None ABSENT: Jesse E..Norris.'. 2. The City Council adjourned to an Executive Session. 3.
