1. At this time the City Council held a public hearing on Resolution No.
3073 (1976 Series), a resolution of the Council of the City of San Luis Obispo
giving notice of intention to adopt the wage and fringe benefit package for
Fire Department personnel without a formal Memorandum of Understanding.
Richard D. Miller, Administrative Officer, reviewed for the City Council the
steps taken by management to this point in an attempt to arrive at a Memorandum
of Understanding concerning wage and fringe benefit packages for the Fire Depart -
ment personnel for the fiscal year 1976 -77, but to this point was to no avail.
He recommended that in the interest of the Police Department and Fire Department
personnel that the City Council establish a wage and benefit package for city
employees. Basic package would include for salaries, approximately 5.3% increase
rounded off to the nearest $2.00 per month and that in future meet - and - confer
sessions, the March to March cost -of- living indices would be used to guide
deliberations.
Conditions of employment would be 1) Total of $59.51 per employee per month
to be provided for all full -time employees in the Fire Department with the
Firemens' Association advising the Fire Department how this money is to be
applied in paying premiums for such city approved programs as health insurance,
disability insurance, etc.; 2) The city would participate in a joint management -
employee committee to study various insurance programs. The committee to meet
on a regular basis at least twice monthly, starting the first week in August with
recommendations to be formulated in writing prior to January 1, 1977; 3) The
city would have an independent position classification and pay plan conducted in
the near future and management would make recommendations to the Council on
implementing measures for an effective date not later than July 1, 1977; 4) The
city would.pay the additional cost (one quarter of 1% of payroll) for adding the
PERS benefit for conversion of unused sick leave to additional retirement credit;
5) The annual uniform allowance be paid to all full -time clerical and fire
personnel below the rank of Chief. The annual allowance shall be equal to 10%
of the new monthly fifth step for firemen rounded off to the nearest $2.00 and
paid semi - annually. This would amount to $118.00 for the 1976 -77 fiscal year.
Mayor Schwartz declared the public hearing open.
7:10 p.m., Councilman Gurnee arrived at.the meeting.
William Callaway, Vice President - Firemens' Association, felt that the city
staff had not acted in good faith in not allowing comparisons,for averaging of
prevailing wage for city fire personnel. He stated that in making a 6% ceiling
the top for all city negotiators, he felt that this made the negotiations a
farce. He stated how under - manned the City Fire Department is, how antiquated
the fire equipment was and how dangerous the equipment was to operate. He stated

that the firemen have a very dangerous position and he asked the City Council
not to force the Fire Department to go on strike or other work slowdown or
stoppages. He also stated that they were bringing in state organizing nego-
tiators and they would still like to negotiate with the city staff. He felt
at no time did the city staff recognize that firemen were firemen and they
were being compared constantly with other classes of city employment.
Mayor Schwartz declared the public hearing closed.
Councilman Norris agreed with the Fire Department employees, stating he felt
the city staff should make an attempt to meet - and - confer with the firemen to
negotiate.a fair package along-with lines the other associations settled on.
Councilman Gurnee stated he felt it was unfortunate that it had come to the
Council to make the salary and fringe benefit decision for-the firemen. He
stated that this was not the year to make great demands against the public
purse. He felt it was wrong to pick out a list of cities to compare to our
city's salaries. He felt it was wrong to use a list of cities to average off
comparative salaries and he would support the resolution between Council and
the employees. He hoped that the city would look into a new meet - and - confer
negotiations system with the employee groups in the future. -
Mayor Schwartz felt the problem was in starting negotiations go late in the.
year. He felt that over the years the City of San Luis Obispo has always
treated its employees fairly as possible and further did not feel that the
city employees salaries should be set by an arbitrary list of cities of which
this City Council has no control which would saddle local taxpayers with other
cities costs. He stated that during the negotiations, the city negotiators had
kept the Council fully aware in all candor about the progress of discussions
with the.fire- employee group.
R.D. Miller, Administrative Officer, again reviewed the attempt by.the city
staff to arrive at some agreement with the Firemens' Association.
Allen Grimes, City Attorney, explained the legal action the Council could -take
in this matter.
William Callaway again spoke stating he objected to the close of the meet -and-
confer sessions and felt that negotiations should go on all year if.necessary
in order to arrive at a conclusion.
On motion of Mayor Schwartz, seconded by Councilman Graham, the following
resolution was introduced: Resolution No. 3073 (1976 Series), a resolution of
the Council of the City of San Luis Obispo giving notice of intention to adopt
the wage and fringe benefit package for fire department personnel without a
formal Memorandum of Understanding.
Passed and adopted on the following roll call vote:

The City Clerk was directed to send copies of the resolution to the Firemens'
Association.
2. The City Council held a public hearing on the appeal of the
Environmental Center of San Luis Obispo County from the approval by
the Planning Commission of the Environmental Impact Report for Tract
465, Val Vista Estates, which would allow 81 single family home lots
adjoining Laguna Junior High School and the the Laguna Lake.

J.H. Fitzpatrick; City Clerk, presented the appeal from the Environmental
Center of San`Luis Obispo- County.which appealed the decision of the
Planning Commission in approving.the E.I.R..for Tract 465.
Rob Strong, Community:Development.Director, reported to the City Council
that the Planning.Commission,..at a..public hearing.held June-15, 1976,
passed their Resolution NO.-925- 76,.finding that the project E.I.R. was
adequate to-describe any adverse environmental.impacts for the subject
project in compliance with the Guidelines of the California-Environmental
Quality Act. The Planning Commission's action was taken following a public
hearing on the.E.I.R., which addressed all written and.verbal testimony
received resulting from the public hearing and.all written comments received
in response to distribution and the required 30 day review-period of the
project E.I.R. All such comments received were included in the' attached
addendum to the E.I.R. Also included in.the E.I.R. was a summary of all
comments received and the required responses thereto prepared by the E.I.R.
Project Consultant.
The Planning Commissions- action on the E.I.R. included a determination
that the prepared - responses were adequate to address all comments in
compliance with'the California Environmental Quality Act Guidelines. The
addendum was considered by the Planning Commission as an integral part
of the final E.I.R.
Mr. Strong continued.that.with respect..to the letter of appeal by the
Environmental Center, that the City.staff felt that all the issues raised
in such appeal were addressed in depth by the staff, the E.I.R. Consultant
and the Planning Commission. The Planning Commission determined that the
subject issues were sufficiently addressed in the Project E.I.R. and
thereby 3etermined.that the Project E.I.R. was adequate to.be certified
as a final-E.I.R. A letter of appeal from the Environmental Center
required that -the City..Council.,.having.the same-information as.the Planning
Commission, review the final E.I.R. and determine it to be either acceptable
or not acceptable. The City Planning Staff supports the Planning Commission's
determination. that the E.I.R. was sufficient and thereby acceptable to the
City-as the final E.I:R.
Mayor Schwartz declared the public hearing open.
Donald Smith, Chairman of -the Conservation Committee of the Environmental
Center of San -Luis Obispo, appeared before.the City Council-stating that the
Environmental Center felt that there were a number of- inadequate presentations
in the E.I.R. for this tract. They felt that the E.I.R. did not adequately
define the increase in.water run -off due to the.project and the accumulative
run -off due to the project and the accumulative run- off.of other developments
planned in this flood basin. Further, the E:I.R. did not provide an.adequate
analysis..of this increase•in flood.hazard,.especially as it related to backup
of water because of deficiencies in the.creek channel maintained by the County
and the downstream freeway bridge obstructions. Further, at.least 16 of.the
proposed lots were-in the flood.plain.of:Laguna.Lake with fill dirt at as much
of 6' depth was necessary.to get the.proposed homesites out of the lake when
flooded. The City Staff had indicated this fill.dirt would extend as much as
200'.into the lake -when flooded and they.strongly believed that this cuts
down.the long term capacity of.the lake to absorb flood waters despite the
contrary implied by.-the.-representatives of the developer. 'This item was not
adequately covered by:the E.I.R.
Another item was-.the-growth inducing..impact.of..the project which was not
adequately-considered in the. E.I.R.,.especially- .by.setting a precedent for
developing.agricultural land along..Los Osos Valley Road and northwest of
the Laguna Junior-High School: In addition, the act of, providing sewer to
this area will tend.to cause the adjacent agricultural land to develop there-
by spoiling this very scenic entry into the City of San Luis Obispo. The

proposed project--was not consistent.with.the.current General.Plan, which
specifies that approximately 200' of the.lake frontage was to be left-in
open-space. The E.I.R..does not adequately address.the.accumulative
impact.of_this. project _aloug.with.other.developments in the:area as to
the. sewer.. system- .capabilities.__For.,example, the--need ' for a new.sewer.
lift station. The E.I.R. does.not adequately consider the need for water
conservation, the.design.and size of.the.project...The available water
may have to_ be...spread_ over-all. the- land..within...the..City limits. This
proposed - project would.put. houses.. is.flood.plains:thus.increasing water
needs. The..E.I.R does not adequately address the air pollution problem
as it is not consistent with the need to clean up the air as the City now
exceeds State and Federal health_standards.for.air pollution onjan average
of 40..days per year. A primary deficiency of the E.I.R. is that it does
not seriously consider.alternative.designs for-study and evaluation.
..Several-alternate designs should have been made.and:considered seriously -
including the ideas as follows:
First, the new General. Plan. recommended that.the.City.obtain approximately
50..acres of additional park land in the-Laguna Lake area, so a first..priority
should have been given to determine whether..the City should not consider that
24 acres as a prime choice for park.or..at least part.of it for a.park. Several
alternate-designs should have been made.which would..protect the lake frontage
and/or-allow public access to.a nature-trail-along the lake:front_as now -
exists. .Alternate designs should also consider parking for public.in non -
sensitive parking areas. In addition, alternate designs should be made
which would better protect the scenic.agricultural land along Los Osos Valley
Road. Alternate designs should be made to.utilize.clustering,.mixed densities,
common_land.ownership, density transfer for open space, and to keep.housing
out.of flood plains, a complete planned development of various combinations'.
Mr. Flanagan, 1379 - Avalon Street, objected to additional development in -and
around Laguna Lake due to potential .flooding.of..the.:lake. He felt.that when
additional .grading. is. done_.in_and around the. lake_. and additional streets
developed, they would_just..carry more- vater_into_the lake..and onto adjacent '
properties causing serious flooding:problems.

James.Lopes;lreviewed_fnr theICouncil.:s information, the. State required
E:I.R. Guidelines as they applied to.this development. He felt that the
City staff approved the E.I.R. which does not answer.required questions
of the Guidelines as the proposed-development has a very bad impact on the
area.without any mitigating alternatives. He felt that the consultant
hired.-by and paid by.the City.rarely..addresses the.environmental.problems
in this development. He urged the Council to meet with the developer and
come up with a more adequate plan.
Dr. Eric V. Johnson,.Morro Coast Au dubon..Society,.and Cal Poly Biology
Professor,-reviewed his.objections- :presented..to the.Planning Commission on
the-E.I.R.-stating that he felt that the E.I.R. was misleading,.deceitful,
inaccurate, and in some areas, does not even apply to the property under dis-
cussion.
L1oyd..Detrick, opposed.to - the:.development, felt.that the E.I.R..was inade-
quate and should-:not-.be-approved. He.felt.that.the entire proposal was
wrong.
Melanie Billig, League of Women Voters, urged the Council to-consider some
way_to.protect.this portion of Laguna_.Lake.....She.hoped the.Council would
adopt policies for guidelines for- developers.:and..architects in.this very
.sensitive area.. She.felt that this.development -.was poorly designed and
did ... not_protect_the.precious open space adjacent to the Lake. She also
hoped.the_Council would reject those_ portions.of -the E.I.R. that would
force the City into more expansion- and:expensive.flood control devices.
She..-hoped the Council-would consider:_the-implication this development would
have on.this most.sensitive: area of the community._

Rob Strong, Community.Development_Director, stated that A.G. Merriam,
Architect for the- .developer;-prepared a draft E.I.R. report for City infor-
mation.and.subsequently.a:3- member staff voted to accept the draft E.I.R.
and in.turn,....the. City_then.hired_A.G. Merriam to.complete the E.I.R. for
the City. . The_ Planning .- Commission..subsequently accepted this report and
felt the.E.I.R., as_submitted,.with.supplemental reports was adequate for
the City.and..they..so_.approved it. He concluded his statement by saying that
the E.I.R. prepared for..the.developer.and.the City by the same consultant
1 was adequate and that..the_rezoning _ should..be allowed to proceed.
The.City Council.discussed.with.staff various questions brought before
them involving the Environmental.Impact.Report for Tract 465.
9:10 p.m. Mayor Schwartz declared.a. recess.
9:22 p.m. .The..meeting.reconvened with.all.Councilmen present.
A.G..Merriam.and.Staff, Consul tants. for. the developer of Tract 465 and
the City-of San Luis.Obispo,.reviewed his report.for the City Council
and felt.that all.the.questions submitted by the public and the City staff
had been-.adequately answered, and he.felt -that the E.I.R. was..adequate
and that the appeal of.the.Environmental..Center should be denied and the
project be allowed to proceed. He.concluded-.that the only real way to
protect the wildlife from disturbance would be to leave the area alone-
and allow no.development,.not.even.used as a public park. He felt that
the Tentative Map of Tract.465 is.a compromise.of both the.City Staff,
the Planning Commission-and the private developer and his consultants.
Paul Landell, City Engineer's Office,.stated that it was his engineering
opinion that.the drainage from.this development., Tract 465, would not.
affect the ditch or.water_.course_ from Prefumo.Canyon and-that the land
east of Madonna.outlet.- although the.culvert under 101 could be a problem
in that.any water-would simply go over Highway 101 at this point.
Mayor-.Schwartz declared the public.heariing closed.
Councilman.Gurnee felt that the.. staff and ..Planning,Commission.approved
an E.I.R. which was inadequate.. He felt.that the E:I.R.'- shoiild have given
more attention to. alternative developments•of the property. He also felt
that the E.I.R. was - incomplete as it did not.answer the problem in dredging
Pr efumo.Creek .and of_the.grading.which would be-required of:the_ development
and'its.affect on .floods.and..flood waters. He also felt the E.I.R. did not
answer the growth inducing-'affect-that this-development would have on the
entire area. He also..questioned..the.City's action in retaining Meyer,
Merriam and Company to analyze.their.own.E.I.R. for..the City._ He felt
it did not look good and the City. should. not .contract.with_the.developer's
engineers..or consuitants.in the future._ He.stated.he would support the
appeal as presented.
Councilman-Norris.-stated he would support the staff and the.Planning
Commission .to.approve.the.E.I.R._and he felt secure that the E.I.R.
answered all the necessary questions .and.protected- the.community.
Councilman.Petterson stated that he:had read the E.I.R. and.all support-
ing documents.and.while he.did not.-feel-that the E.I.R. was of the best
quality, he did feel.the E.I.R. was.adequate for this particular develop-
ment.
Councilman.Graham_ stated he felt that_after.the public hearing this
evening, he could support the E.I.R. action. He felt that the E.I.R.
was not.of the best quality, not too well done, but he.would vote to
deny the appeal.
Mayor Schwartz.stated_ that_he- .did.not feel that-the E.I.R..was well done,
in that it did not adequately.. answer .the.normal_questions..that.the con-
sultants should.have looked-into in.this.most sensitive area of the
community. He did not -feel that the E.I.R. addressed the question of
what would.happen_to_ the area if nothing was done with a development.

On motion of.Councilman.Gurnee,.seconded by Mayor Schwartz, that the City
Council uphold the appeal of the Environmental Center of San Luis Obispo
County.
Motion carried on the following roll call vote:
AYES: Councilmen Gurnee, Graham and Mayor Schwartz
NOES: Councilmen Norris and Petterson '
ABSENT: None
The majority of the City Council in the prior motion stated that they would
like the following items considered in the E.I.R. for guidance of staff
and consultant:
1. The answer to the siltation problem of the lake caused by this development;
2. Protection of the wildlife habitat and its disposition;
3. Alternative to the 120' contour;
4. An alternative for development of balance of property, particularly
the public access control;
5. Consideration of the present motor bike use;
6. Consideration of alternative uses in the E.I.R.;
7. Consideration-to prevent contamination of the Lake;
8. Long term impact of the development;
9. Implication on City expenditures in future siltation problems of the I
Lake and possible dredging; and
10. If project was not approved, what would be the effect on the City and
the public to acquire the underlying lake property.
The Mayor asked the staff to move ahead with.supplemental E.I.R. for the
July 19, 1976 meeting based on the comments of those members of the Council
who upheld the appeal. The meeting to be advertised for public information.
3. At this time the City Council considered the final passage of Ordinance
No. 674A (1976 Series), an ordinance of the City of San Luis Obispo amending
the Municipal Code to add the "Demolition and Moving Code ".
Mayor Schwartz declared the public hearing open.
No one appeared before the City Council for or against the proposed ordinance.
Mayor Schwartz declared the public hearing closed.
On motion of Councilman Gurnee, seconded by Councilman Petterson, Ordinance
No. 674A was introduced for final passage.

The staff requested a resolution establishing.fees for inspection of and
travel to buildings to be moved within or into the city. This was continued
to the July 19, 1976 meeting with the staff to redo the fee structure.
4. At this time the.City Council considered the final passage.of Ordinance
No. 675 (1976 Series), an ordinance of the City of San Luis Obispo amending
the official zone map of the city (rezoning property on South Higuera Street
parallel to Margarita Avenue).
Mayor Schwartz declared the public hearing open.
No one appeared before the City Council for or against the proposed ordinance.
Mayor Schwartz declared the public hearing closed.
On motion of Councilman Gurnee, seconded by Councilman Petterson, Ordinance
No. 675 was finally passed.

5. Continued consideration by the City Council of increasing present fees, taxes,
rates, etc., was continued to a public hearing on July 19, 1976, on motion
of Councilman Graham, seconded by Councilman Gurnee. Motion - carried, all ayes.
6. Communication from the Waterways Planning Board asking Council considera-
tion and approval of Tract 592 - proposal concerning.flood control was continued
to receive the E.I.R. Report and filing of the Tentative Map, on motion of
Mayor Schwartz, seconded by Councilman Graham. Motion carried.
7. Robert G. Mote, Utilities Engineer, memorandum asking Council consideration
on a 604 -A Water Deficiency existing at the City, of San Luis Obispo's Water
Treatment Plant.
Mr. Mote stated that on this date, the Water Treatment Plant Superintendent
confirmed that a "critical" water treatment deficiency as defined by Ordinance
No. 604 -A has been encountered at the Water Treatment Plant. The ordinance
defined the "critical point" as being that point when "treated water volumes
exceed 8 MGD... for two consecutive three -day periods..." For the period
June 21 through June 28, the total consumed by the city averaged in excess of
8.9 MGD. Only the fact that Whale Rock water is of better quality and there-
fore can be processed through the plant at a slightly higher ratehas allowed
production tole maintained at this high rate (over 10% above the rated capacity).
He suggested that public hearings in accordance with Level I reporting procedures
should therefore be scheduled.
Richard D. Miller, Administrative Officer, answered in regard to Mr. Mote's
memo that the City has reached a critical deficiency level as far as water
treatment criteria under Ordinance 604 -A is concerned.
He stated he learned from Mr. Strong that the Planning Commission can hear this
matter July 7 and depending on the determination, return it to the Council for
its meeting of July 12. The Council could then, if they so wished, set the
matter for hearing July 19.
He further stated that he would make arrangements to refer Mr. Mote's
information to the water consultant.
Mr. Miller stated he has asked Mr. Grimes, City Attorney, to be prepared to
advise the City Council whether or not it can allow development to proceed in
the interim. Otherwise, the Council is advised that as of June 30, 1976,
Mr. Mote has stopped approving projects.

For the Council's information and to support his contention, Richard D.
Miller, Administrative Officer, submitted a copy of Ordinance 604 -A for
the Council's information.
After a very brief discussion, the City Council approved the Administrative
Officer's proposed schedule for consideration of 604 -A deficiencies and the
_City._C1erk,.Mr_ Fitzpatrick, was to set the Council hearing for July 19 under
the provisions of Ordinance No. 604 -A.'
8. Communication from the Promotional Coordinating Committee recommending
that the City Council approve a grant of funds to the Babe Ruth League which
would be a repayable grant to cover start -up costs for putting on two
California League semi - professional baseball games at the San Luis Obispo
Baseball Stadium. One game to be held July 31 and one game to be held on
August 14, 1976.
The Promotional Coordinating Committee endorsed the project and recommended
that the Council approve the proposal and grant a repayable sum to the San
Luis Obispo Babe Ruth League so that they may sponsor these teams which will
bring enjoyment to the citizens of San Luis Obispo and would financially support
the completion of the baseball stadium.
On motion of Councilman Petterson, seconded by Councilman Graham, the request
of the Promotional Coordinating Committee was approved and $1,500.00 was
granted to the Babe Ruth League as start -up funds for these two semi - professional
baseball teams. Motion carried.
9. Communication from the Housing Authority requesting Council consideration
regarding permit parking in Parking Lot 6. The Housing Authority felt that
there were a few tenants-in the Anderson Hotel building who have not had an
opportunity to move their cars to other parking and the city's request that they
be terminated was making a hardship on these elderly folks. Therefore, they
asked that the termination date be continued sothat the Housing Authority may
help these.peop.le find adequate parking. 1
The City Council directed the City Clerk to continue rental of spaces in
Parking Lot 6 to the two senior citizen residents of the Anderson Hotel for
a period of 30 -days and to so inform the Housing Authority.
CONSENT ITEMS:
C -1 On motion of Councilman Petterson, seconded by Councilman Graham, claims
against the city for the month of July, 1976, were approved and ordered paid
subject to the approval of the Administrative Officer.
C -2 On motion of Councilman Petterson, seconded by Councilman Graham,
minutes of Council Meetings of January 5, 7, March 22, April 7, 9, 12, 14 & 16,
1976 were approved as presented.
C -3 On motion of Councilman Petterson, seconded by Councilman Graham, the
following resolution was introduced: Resolution No. 3084 (1976 Series), a
resolution of appreciation to Police Chief Ervin L. Rodgers on his retirement
from City service.

communication from the Downtown Association- recommending that the City Council

C -5 On motion of Councilman Petterson, seconded by Councilman Graham,
the request of Archie Higdon for time extension to file a final parcel
map for. Minot Subdivision No. 428 was granted a six - months extension.
Motion carried.
C -6 Recommendation from Rob Strong, Director of Community Development
requesting that the Council consider the abandonment of a portion of Murray
Avenue between the railroad and Hathway Avenue (Fred Julien, applicant).
1 On motion of Councilman Petterson, seconded by Councilman Graham, the city
staff was authorized to prepare the necessary documentation to abandon a
portion of Murray Avenue. Motion carried.
C -7 On motion of Councilman Petterson, seconded by Councilman Graham, the
request of Roger M. Brown, General Contractor, for Council's consideration of

ing salary ranges for employee classifications, specifying methods of advance-
ment, and superseding previous salary resolutions in conflict.
On motion of Councilman Petterson, seconded by Councilman Graham, Resolution
No. 3074 (1976 Series) was introduced for passage.
