COUNCIL HEARING ROOM, CITY HALL Roll Call Councilmen PRESENT: Councilmen Dunin, Jorgensen, Settle and Mayor Schwartz ABSENT: Councilman Petterson City Staff PRESENT: J.H. Fitzpatrick, City Clerk; Allen Grimes, City Attorney, R.D. Miller, Administrative Officer; Jim Stockton, Director of Parks and Recreation; Terry Sanville, Associate Planner; Dan Smith, Senior Planner 1. The City Council adjourned to Executive Session at 11:50 a.m. 2. The City Council reconvened in Regular Session at 12:20 p.m. All Council- men present except Councilman Petterson. Staff present: J.H. Fitzpatrick; Allen Grimes, R.D. Miller, Terry Sanville and Dan Smith. 3. Communication from the County Engineer, San Luis Obispo County, forwarding a list of proposed federal aid urban projects for the region of San Luis Obispo and the City of San Luis Obispo. 1) Santa Rosa Street from Monterey Street to Highway 1 widening easterly side of Santa Rosa from Monterey Street to Walnut Street. Work should consist of right -of -way acquisition, building removal or demolition, roadway con- ' struction, installation of traffic signals at Walnut and Santa Rosa Street. 2) A portion of South Higuera Street from Marsh Street to Madonna Road and South Street realignment from Madonna Road to Beebee Street. The County Engineer asked if the Council had any objections to these projects. On motion of Councilman Settle, seconded by Mayor Schwartz, that the City Council of the City of San Luis Obispo notify the County of San Luis Obispo that they had reviewed the projects and approved the list for forwarding to the Regional Transportation Planning Agency. Motion carried, Councilman Petterson absent. 3. The City Council considered a housing proposal from Barbara Kraus which would establish a plan to direct and manage the rate, the type and cost of residential housing in the City of San Luis Obispo. She reviewed her proposal stating the following: I. Purpose: To adopt a specific Growth Management Program, consistent with the General Plan, which would: A. Preserve the small -town characteristics of San Luis Obispo B. Encourage tourism as a fundamental source of revenue C. Insure the social stability of the community D. Address the impact of growth management of affordable housing for working families F. Consider the problem of energy conservation in residential construction G. Address the necessity to maintain clean air. II. Authority: The general police powers granted to local governments to promote and preserve the public health, safety and general welfare. III. Implementation IV. City's Role as re- purchaser of all MI housing under the allocation system. V. Funding. City Council Minutes October 17, 1977 . Page 2 She suggested the city could enact a real estates: transfer tax on all sales of residential property within the�city which she stated that would be legally possible for the city to do. She then reviewed for the City Council, a possible criteria fora "Project Rating Scale ", criteria for "Applicant's Rating Scale ", and the possible selling /profit considerations in the program. She stated that her program was based on extensive..research carried.on by her in the cities of San Juan Capistrano and Davis in the State of California. Terry Sanville stated that the city's Advanced Planning Staff had not done any in -depth studies of the Kraus proposal but the staff could proceed as part of the city's Housing Element of the General Plan and include this type of program but felt that-the City Council must first establish policy for the staff to follow.. Dan- Smith.stated. that he had checked with -the cities of Davis and San Juan Capistrano and he stated while -it's true - they had this type -of.program,•they were having some difficulty with the implementation of various facets of it. Mr. Yeoman, builder,.opposed.the program. ..He-felt-it was just.:one more.step in government control of housing, felt it was a.poor...suggestion and should be rejected by the City Council. Tom Maple, planning consultant,- stated.he would.support any program in general thatlwould.insure moderate and low- income housing for - __citizens of San Luis Obispo but he felt that a lot more work was.needed.to clearly see- the . impact that the type of program proposed would have on the city. [,chile he was supportive, he felt that a lot:.of work had-to go in to.the Kraus proposal to have it make.sense. Melanie Billig felt the program had merit and that.the city should integgate the program with their other goals and.plans for the community. She felt that not only should.middle- income people be protected but also low- income citizens in trying to develop housing for themselves. But.she felt that the program should not-be-developed in a vacuum but must be included in the overall city General Plan and its elements. She-hoped this program could be implemented without allowing.the.city bureaucracy to get involved and with its long staff time, increase costs.to housing in the city. She also felt the city should work with the normal lending institutions in helping people get housing in -the community. Foster Gruber stated he was supportive of the program.but felt he needed more information on the proposal before giving his opinion. Councilman -Dunin stated.he- was•-working on a.proposal sponsored by the Chamber to appoint a task force committee, which would include all elements of the community to try to•come up.- with -some proposals-to provide housing for the city but that this committee would not include any of the city's bureaucrats or politicians. He felt that it should only -involve people involved in the housing program.: Finally, he stated he•could not - support any.- program -that would put any city management :in charge-of-the-Kraus proposal. He continued that it would be his suggestion:that before appointing a task force to study housing; the committee- should be clearly given a charge of..the scope of work that they must accomplish. He felt-that the Kraus proposal lacked: 1) legal grounds; 2) administrative solutions; and 3) means of financial implementation. Councilman Jorgensen felt the Kraus proposal was very comprehensive but it might be too big a project for the City of San Luis Obispo to attempt.at this time but he felt the City Council could implement portions of the plan.as proposed. He felt that one area not-covered were the financial implications of the proposal, particularly with no provisions for annual inflation factors that were facing the builders and purchasers of dwellings in the-community. He:also felt that no program would ever make housing available to-the low income people without support from the government. Another way to proceed was the use of rent control-in order to control the rents on dwellings which.would affect.the - price.of the building and the replacement buildings. He would support-some type of growth control management program in the community and also put in a real estate transfer tax or a land improvement tax ordinance. 1:20 p.m: Councilman Jorgensen left the meeting. i - 1 1 1 City Council Minutes October 17, 1977 Page 3 Mrs. Kraus urged the appointment of a citizen's committee to study her proposal and to prepare documents to implement the proposal for the people of San Luis Obispo. R.D. Miller, administrative officer, stated that before the City Council appointed another task force or committee on this or any other subject, they should analyse of how the work would affect the staff and ongoing projects previously assigned by the City Council. Terry Sanville, associate planner, reported in detail on the 1975 Task Force on Housing which took over nine months of meeting with no real conclusions being arrived at. He felt that to have a task force effective, it should have very clearly defined parameters established by the policy makers of the city, the City Council. Allen Settle felt that the Kraus proposal was very interesting but felt that to implement the program would take a long, long time due to the complexity of the problem and the number of different people involved in housing programs in the city. He hoped that in the future, each subdivision would include homes for middle- income citizens but to do this in San Luis Obispo would be difficult without having public funds involved. Finally, he felt that many of the Kraus' objections should be included in the City's General Plan Housing Element and the Council should look to city regulations on development and construction in a way to help reduce costs of construction. Mayor Schwartz thanked Mrs. Kraus for her suggestions in trying to solve the housing dilemma facing the City of San Luis Obispo and he felt that there were suggestions that should be included in the City's Housing Element to be prepared very soon by the city staff. He, too, hoped that these suggestions could be implemented by the private sector and hoped that the government would not get involved in a housing development for medium and upper income citizens as they had been for the low income. There being no further business to come before the City Council, Mayor Schwartz adjourned the meeting at 1:50 p.m., Monday, October 17, 1977. APPROVED: January 3, 1978 J! COUNCIL CHAMBERS, CITY HALL Pledge Roll Call Councilmen PRESENT: Councilmen Dunin, Jorgensen, Petterson, Settle and Mayor Schwartz ABSENT: None City Staff PRESENT: J.H. Fitzpatrick, City Clerk; Allen Grimes, City Attorney, R.D. Miller, Administrative Officer; Dan Smith, Senior Planner; Terry Sanville, Associate Planner; Jim Stockton, Director of Parks and Recreation; Rudy Muravez, Director of Finance; D.F. Romero, Director of Public Services; Wayne Peterson, City Engineer 1. The City Council continued their public hearing on the recommendation of the Planning Commission to rezone property in the Foothill /College Area in order to have the zoning conform to the recently adopted General Plan of the city. This matter was continued from the October 11, 1977 meeting.
