1. - Ray Gallo,.attorney for.the San Luis Mill.and Lumber Company, appealing
the request.of..the city planning_staff..to grant the city without payment by the
city, of 20' in front of the mill property at 236 Higuera. This gift of private
property to the city for future widening was in addition to the condition estab-
lished by the-Planning Commission .to grant a fairly.large parcel of land at the
rear of the property including.a..portion of San Luis Creek. He stated that the
property.owners had no objection to the Planning Commission's request for prop-
erty to the rear along the Creek,-which they felt would benefit:their own prop-
erty, their neighbor's property.and the.city as a whole, but the property owners
objected to the staff condition.to grant frontage.on Higuera Street. The basis
for the objection included the.following: 1) Unfairness in taking the full
future widening from one.side of the street with one.property owner bearing
the full burden of loss of land; 2) Granting.land to the city without payment
when other adjacent property owners would be paid for any land needed if street
were ever widened; 3) Particularly, in view of the large-area being granted on
the Creek.side of property it would seem simple justice not to take additional
land at the front of the property.and treat this property owner as anyone else
when the city widened the street and bought the land.
Ray Gallo then presented what he felt were questions of interpretation of the
Code and not necessarily the same as interpreted by staff.
The City Clerk was directed to inform the City Attorney of Ray Gallo's appeal
and get a report from Allen Grimes.for the Council on his appeal.
3. 1:00 p.m.,..Council adjourned to Executive Session. 2:00 p.m.,
Council reconvened in Regular Session.
2. The City Council then discussed various bills listed in the League
of California Cities Legislative Bulletin Nos. 16 and 17, 1978:
