After a lengthy discussion, the Council took the following action:
On motion of Mayor Schwartz, seconded by Councilman Jorgensen, that the
Council accept the recommendation of the Jack House Committee amended as
follows:
A) $25.00 basic rental plus $7.50 per hour for clean -up and maintenance.
B) $5.00 per hour for supervision.
C) All donations to Jack Residence to be earmarked for Jack House building
fund.
Motion carried, all ayes.
The City Council also directed the Jack Residence Committee to submit a plan
and cost estimate for improvements to Jack Residence grounds for Council
consideration.
2. The City Council discussed the progress being made by the Citizens'
Advisory Committee on their study of council advisory boards and commis-
sions and ultimate recommendation to City Council for reorganization or
restructuring of the advisory groups.
After discussion with the Chairman of the Citizens' Advisory Committee,
Foster Gruber, the City Council informed Mr. Gruber to have the C.A.C.
continue their study as the City Council is interested in the reorganization
of some advisory boards and then as C.A.C. is ready, to establish a series
of study meetings with the Council in order to review step by step the
recommendations of the C.A.C. and analyze the suggested organization, duties,
etc.
On motion of Councilman Settle, seconded by Councilman Dunin, that the
Council meet with the C.A.C. at 7:30 p.m., Tuesday, October 10, 1978, in
order to review work to date and guide the C.A.C. on the study of advisory
board organization. Motion carried, all ayes.
3. Mayor Schwartz briefly reviewed a chart prepared by the County
Hydraulics Design Division of preliminary cost estimates of the 1980 State
Water Project Costs to anticipated participants.
After discussion by the Council, the staff was directed to set a meeting
for 12:10 p.m., Monday, October 2, 1978, with representatives of the
County Staff for a more comprehensive review of the State [dater Plan cost
estimates.
4. The City Council reviewed a letter from the developer of the
San Luis Obispo Mall Project asking to withdraw their appeal to the Planning
Commission decision to deny their rezoning for the project, but asked the
Council to hold the hearing on the E.I.R. and Economic Report for the
San Luis Obispo Mall Project.
The Council continued the request to the public hearing of September 12,
1978.
5. The Council adjourned to Executive Session at 1:50 p.m.
The City Council reconvened in Regular Session with all Councilmen present. ,
6. There being no further business to come before the Council, Mayor
Schwartz adjourned the meeting to 8:00 a.m., Tuesday, September 12, 1978
at the Maya Restaurant, 1761 Monterey Street, San Luis Obispo.

1. The City Council discussed with Assemblywoman Hallett the impact of
the 1977 -1978 legislative session on the cities of California and
San Luis Obispo in particular, and, also,- the Council attempted to inform
the Assemblywoman on areas of legislation that would be of benefit to the
citizens of the City of San Luis Obispo.
2. There being no further business to come before the Council, Mayor
Schwartz adjourned the meeting at 9:15 a.m. to 7:30 p.m., Tuesday,
September 12, 1978.

1. The City Council will hold a public hearing on the appeal of Rybar
Associates (San Luis Mall Shopping Center) from the denial by the Planning
Commission of a requested rezoning to C -R -PD retail - commercial, planned
development from A /C -20 agriculture /conservation, 20 acre minimum.
Mackey W. Deasy, respresenting Merriam, Deasy and Whisenant, Inc., consulting
firm for the developers Rybar Associates,submitted the following letter to
the City Council regarding the San Luis Mall:

Gentlemen: "Please be advised that after careful consideration we are
hereby requesting that our application of appeal from the decision of the
Planning Commission in connection with the above referenced project be
withdrawn, without prejudice against resubmittal at some future date.
Insofar as a great deal of effort on the part of staff and the consultants
and substantial funds have been expended, we respectfully request that
the meeting scheduled for September 12, 1978 at 7:30 p.m. be held solely
for the purpose of certifying the E.I.R. and the parallel economic report."
Mayor Schwartz announced that based on the consultant's request on behalf
of the property owners that the meeting would proceed but be limited only
to the consistency of the E.I.R. and the economic report for the San Luis
Mall project and not for.the rezoning or use permit.
Councilman Petterson left the meeting due to possible conflict of interest.
Henry Engen, Community Development Director, gave to the City Council the
progress to date on the E.I.R. and the economic report for the San Luis Mall
Shopping Center including the recommendations of the Planning Commission
on 1) the E.I.R., 2) the economic report, and 3) the requested zoning change.
He continued that the City Planning Commission recommended approval of the
E.I.R. and the economic report as being consistent and adequate for the
proposed project.
Mayor Schwartz declared the public hearing open.
Mackey Deasy, representing the firm of Merriam, Deasy and Whisenant, Inc.,
consultants for the property owners, reviewed for the council the entire
project for their information which included the land, the proposed mall,
the tenant mix space allocation, parking, landscaping, etc.
Michael Wright, representing WESTEC Services Inc., reviewed the environ-
mental impact report for the proposed San Luis Mall which included a
review of such items as:
1. soils and geologic conditions
2. air quality
3. hydrology
4. climate
5. noise
6. land uses
7. aesthetics
8. circulation
9. public services and utilities
10. energy
He also reviewed things that could be.done to mitigate the adverse
effects this project would have on the immediate environment and also
alternative projects for the area.
Andy Trevedi, representing Larry Smith & Company, Ltd., the city's economic
consultants,reviewed for the City Council the economic studies prepared by
his firm on 1) effects of the center on existing city businesses, 2) effects
of the center on downtown shopping center, and 3) effects.of the - center on the
balance of the county. He then reviewed in detail the economic consultant's
summary and conclusions of the effect the San Luis Mall Shopping Center
would have if developed in the City of San Luis Obispo.
Henry Engen, Community Development Director, again reviewed the Planning
Commission's action dealing with the San Luis Mall that the Planning
Commission on a unanimous vote recommended that the City Council certify
the shopping center's E.I.R. as being adequate and prepared consistent with
city and state E. & R. guidelines.

Mayor Schwartz again restated that the action before the City Council this
evening was consideration of the E.I.R. and economic report only and not
of the land use or proposed uses.
Mackey Deasy, representing the developer, again asked the City Council
to accept the E.I.R. as adequate and meets the city and state requirements
as approved by the Planning Commission.
Russ Johnson, San Luis Obispo, felt the E.I.R. was adequate, covered all
the potential problems, mitigated them and felt the city needed additional
shopping facilities and urged that the Council approve the E.I.R. and
economic report.
Jack Foot felt the E.I.R. was adequate, felt it was well done and should
be accepted by the City Council.
Mayor Schwartz declared the publice hearing closed.
Henry Engen again stated that the E.I.R. and economic report do list altern-
atives and referred the public to pages 73 -76 of the E.I.R. and pages 48 -50
of the economic report. In answer to the comments of the B.I.A., he stated
that the economic report was adequate in the mind of the Planning Commission
and also that the answers were adequate.
Councilman Settle felt that the E.I.R. was adequate as was the economic
report on San Luis Mall. He felt the information was well rounded and
adequate and a good job in bringing out the evironmental and economic
potentials of this proposal.
Councilman Dunin felt the E.I.R. was adequate and very informative for
future development and he would support the Planning Commission's recommen-
dation.
Councilman Jorgensen agreed that the E.I.R. and economic report were adequate.
While he disagreed with some of the conclusions, he felt the job was well
done and that the Planning Commission had done a good job in analysing the
responses and their questions.
James Lopes, Chairman of the Ecoslo, submitted a report stating that the
Environmental Center has reviewed the responses to comments, San Luis Mall
draft E.I.R., and stated that throughout the responses they found that the
consultant has addressed the various public comments only from the viewpoint
of mitigating measures for the proposed project. In none of the responses
has the consultant.proposed- alternative projects or no project as a response.
The Ecoslo felt that this neglect was fatal to the standing of the report.
They also felt the final E.I.R. should follow the state guidelines and
contain adequate alternatives to the proposed project. In order to do this
properly, the consultant should be expected to modify their alternatives
and to propose new alternatives which suggest themselves in the course of
public discussion. Of particular concern to the Environmental Center was
the alternative of timing. While this project is obviously ill- timed, it
may be well accepted as a project in 10 or 15 years; yet the alternative to
delay construction has not been proposed. For these reasons Ecoslo feels
the E.I.R. for the San Luis Mall was inadequate and should not be accepted
by the council until the alternatives, which would be addressed by the public,
have been examined.
Beth Law, Chairperson of Business Improvement Area, still felt that the
economic report was inadequate and that there were erroneous conclusions
arrived at in stating that the downtown was declining. She felt as a
representative of downtown business that the opposite was true and that
the downtown area was improving.
Wayne Hesselbarth, Waynes Tires, stated he is opposed to the mall project
as he felt that it would hurt existing businesses in the city and felt
that the E.I.R. was inadequate particularly as to the economic portion.

Mayor Schwartz stated he felt the economic report was adequate, and that the
consultants and developers had submitted good information to the city and
its citizens. He felt he could support the recommendation of the Planning
Commission.
On motion of Councilman Settle, seconded by Councilman Jorgensen, that
the City Council accept the Planning Commission's recommendation and
certify that the E.I.R. was adequate and was prepared in consistency with
city and state E.I.R. guidelines.
Motion carried on the following roll call vote:
AYES: Councilmen Settle, Jorgensen, Dunin and Mayor Schwartz
NOES: None
ABSENT: Councilman Petterson
On motion of Councilman Jorgensen, seconded by Councilman Settle, that
the City Council accept in principle the recommendations of the Planning
Commission,.:that they should refine the general plan policies to include
long term strategy for freezing commercial development in the city, the
general plan should be expanded to contain a clear definition of what the
city considers a regional shopping facility, and finally that.the city
should complete and adopt a downtown specific plan which would clearly
define the city's roll in assisting retail development in the downtown area.
Motion carried, all ayes, Councilman Petterson absent.
2. There being no further business to come before the City Council,
Mayor Schwartz adjourned the meeting at 9:15 p.m. to 12:10 p.m., Monday,
September 18, 1978.
