Motion lost.on.the.following roll call vote:
AYES: Councilmen.Dunin and.Petterson
NOES: Councilmen Jorgensen, Settle and Mayor.Schwartz
ABSENT: None
The City Council._asked..the City Administrative-Officer ... to..have the staff
prepare a scope of.work for the drainage channel improvements along Old
Garden Creek north of Foothill Boulevard. The City Council also asked the
C.A.O. to have the staff prepare a comparative analyses of drainage improve-
ments at Prefumo Creek, U.S. Highway 101 versus Marsh Street bridge in cooper-
ation with Caltrans.
Study of the status of the C.I.P. was continued for further council study.
The City Council also continued for a study session a preliminary review
by the council of the recently completed circulation plan.
2. Communication from Gann Investments regarding landscaping and irriga-
tion-system installation for Tract No. 736, approved by the council on
November 21, 1978.
Rob.Strong, on behalf of Gann Investments, stated that.with.the approval of
the landscaping plan for Meadow Park expansion and the Exposition Park
greenbelt, which included plans and specifications for an irrigation system
for the.411 acre proposed addition to the public park, the council did not
allocate funds for the project to be completed this year..but rather continued
the matter to this next fiscal.year.'s Capital..Improvement Budget.
Mr..Strong continued that at-the time he:did not realize the'.complication
this would cause the landscaping and installation.schedule nor.was he prepared
to respond to the council questions of how this expenditure.might..affect
other budgeted projects. He stated.that.subsequently, in several conferences
with the city staff, the following facts-were presented for the council's
consideration:
1) For best results as well as economy, the ideal schedule and sequence of
construction and coordination would be:
a) Developer to.complete grading and construction of drainage, bridge,
and pathways, (including erosion control) prior to February, 1979.
b).'City.to install . irrigation.'system - during.February, 1979.
c) .Developer to complete.trees,' shrub'planting,.- ground cover,-and construct
entries and recreational features - March &.April, 1979.
d) City to complete soil preparation and turf planting - April & May, 1979.
2) The city cannot participate with a.developer.financially'(such as reim-
bursing for irrigation improvements), exceptAn._conform_ance with bid
procedures defined in the City Charter.
3) The bid procedure..involves approximately two.months from the time the
council authorizes.a call for bids to commencement of the.construction.
The funds should be available at the time the bid is awarded, although
actual expenditure may be in subsequent payments.
4) Although the developer.attempted, they were unable.to..obtain.approval of
the lending institution to fund._an.interest.free..loan or "advance" to
the City to enable awird..of bid fbr public irrigation system installation,
subject to reimbursement agreement.
Therefore,.because of these.findings, Rob Strong on.behalf of the developer,
.....requested.the City Council's 'reconsideration as part of.the quarterly report
of this years C.I.P. They - respectfully requested that the City Council
authorize a call for bids and budgeting of the anticipated .$54,000 expenditure
from this years budget, rather than delay the matter until the next fiscal
year. If the council approves this request, the developer and city staff
would be better able to coordinate, to plant during the best season, and to
gain approximately six months plant growth without any additional cost.

L. Walton, C.A.O., stated that he has looked into.this matter, has talked to
the staff and..recommends..that the.City Council fund.the landscaping portion
to be done by-the city and this years budget in order to process concurrently
with the developer which would be in.the long run, a savings to both the city
and the developer.
On motion of.Mayor.Schwartz, seconded by.Councilman Settle, the request was
approved and-the City. Administrative Officer was authorized to add to the
1978 -1979 budget for landscaping work to be done in the fiscal year 1978/79
for Tract No. 736.
Motion carried on the following roll call vote:

3. Consideration of adoption of..an: ordinance. limiting third party appeals
which was continued from the November 21, 1978 Council Meeting was continued
to a future study session due to the time limitation.
4. Status:.report.on. flood zone map and creek setback line.and conditions
for development continued from the November 21, 1978 meeting was continued to
a future study session due to time limitations.
The City Administrative Officer was.asked by the City Council.to submit for
the council'.s consideration.a proposal to increase.staffing mid year with
his analyses to-include-effect of.state freeze on staffing. The C.A.O. was
also asked by the City Council.to consider the possibility of the city
retaining a licensed architect and landscape architect on an annual contract
to consult..with city staff on minor or small city projects.
5. City Attorney, George Thacher, discussed with the City Council the
appeal of Charles Andrews regarding the..pave out policy as it applied to
the Walters' property on Higuera Street, property being.developed for E.D.D.
The City Attorney stated he was.not. sure whether the appeal was proper in
its present form or whether the appeal involved just a general request for
review of the city's pave out policy with developers.
At the request.of the City Administrative Officer, the matter was continued
to the regular council meeting of December 5, 1978 to be added as an emergency
item.
6. . There being no further business to come before the City Council,
Mayor Schwartz adjourned the meeting at 2:25 p.m.
