A. With the concurrence of the Councilmembers present, Mayor Cooper
appointed Councilman Jeff Jorgensen to be the alternate to the San Luis
Obispo County of Governments.
1. The City Council continued their review and consideration of the
Housing Element of the General Plan following the close of the public hearings.
They began with Policies and Programs No. 12.
12) Purchase by Investors
On motion of Mayor Cooper, seconded by Councilman Bond, Item 12 was amended as
follows:
Problem: "Competition for available housing. Investors and occupants, both
residents and nonresidents, compete for available housing. Frequent
resale escalates prices faster than would otherwise occur."

Policy: "Housing for purchase should be available to those who will occupy
it as a principal residence, rather than investors."
Programs: "A. Developments requiring some conditional entitlement (use permit,
planned development, tract map) will be asked to limit their
promotional efforts to the local housing market, and direct
their publicity toward owner occupants.
B. The city will.monitor where residential property owners live
and where they work, and report the results in anonymous, summary,
form, to the council as part of the annual housing report.
C. The city should develop some mechanism to restrict initial
sales of homes to those who would occupy and not to investors.
Motion carried on the following roll call vote:

13) Condominium Conversions
On motion of Councilman Jorgensen, seconded by Councilman Bond, that the City
Council accept the problem, policy and program as recommended by the Planning
Commission with the following amendments:

Program: .. "(6).compliance with basic fire, safety and noise standards require-
ments."
Add .the .following_ condition:
"(10).-and any other items necessary to protect the public's health,
safety,'and.welfare."

14).-.Need for_ Variety

Commission and'.add to Program B "particularly low -rent apartments and rooms
in the central core area."

.15 No Children Allowed
On motion of- Councilman Jorgensen, seconded '.by ... Councilman .Dunin, number 15 was
amended as follows:
Program A: The city-will adopt .an.ordinince.providing:for:.. (1).:.all; rental
..:apartments, except those legitimately.. reserved" as elderly or
students, based .on. their location, .. design, . and. . history.:of.operat.ion,.will.be
.available to- households with minor .... children;.(2):mobile home parks will allow
at least one-half of their spaces to.be available to households.with children,
such spaces possibly located -in a designated.:area; (3) the Human Relations
Commission.will be designated a grievance-and-mediation board responsible
- ...for administering -and interpreting the ordinance.-provisions. Time frame:
...draft ordinance to be available August, 1979, and effective by December, 1979.

16)' Housing Maintenance

17) Households with Unrelated Occupants
On motion of Councilman Jorgensen, seconded by Councilman Dunin that Program B
be changed by dropping the first word "amend" and subsituting the word "maintain"
Motion carried on the following roll call vote:

18) Lack of Investment in Neighborhoods
On motion of Councilman Jorgensen, seconded by Councilman Bond, that the
City Council accept the recommendation of the Planning Commission.
Motion carried on the following roll call vote:
AYES: Councilmembers Jorgensen, Bond, Duunin and Mayor Cooper
NOES: None
ABSENT.: Councilwoman Billig
On motion of-Councilman Bond. seconded by Councilman Jorgensen, the paragraph
entitled "Additional Concern ", Page 16 of the original draft Housing Element,
was to be dropped.
Motion carried on the following roll call vote:
AYES: Councilmembers Bond, Jorgensen, Dunin and Mayor Cooper I
NOES: None
ABSENT: Councilwoman Billig
On motion of Councilman Bond, seconded by Councilman Dunin, the Housing Element
as tentatively approved by the City Council be referred to the planning staff
for editing and to the Planning Commission for report back to the City Council.

2. A communication from Robert Strong on behalf of the developer of
the Hi.guera Street Commerce Park Specific Plan asked in light of the action
taken by the City Council on April 17, 1979, in approving the project E.I.R.
but denying the approval of the specific plan and directing staff to prepare
an amendment to the General Plan to place property in agricultural conservation
area, Robert Strong asked the City Council for an opportunity to discuss
revisions to their plan which the council may consider for future approval.
1. A definite time schedule to. assure.that.the southern.30 acres are not ,
subdivided for at least 5 -10 years, thus providing for interm agri-
cultural use as part of the specific plan.
2. Provision to phase "build -out" of the northern 50 acres of the
subdivision to assure that the employment increases will occur
over an extended period of time.

3. Minor.revisions.to -the subdivision_.street.:plan.to reduce or.eliminate
_..conflict with Meisner_'.s private..road.and.to retain.flexibility for
interim. agricultural.and /or..deferred commercial- industrial use of
the adjoining acreage.
4. Other special-provisions-such as ... off- site..noise_reduction_wall, traffic
signal. participation, ,i private'_ f ire. .pro tection.:.improvements,`. employment
control.by.:conditional_.use permit,. intended..to.mitigate..possible
impacts.of.- commercial- industrial..development within the project.
Robert Strong hoped the City Council.could.give some direction to himself,
...the city planning staff and the property.owner.
George Thacher, City Attorney, in -men randum:_opinion..79 =28, stated that the
.City Council.with.their action of-April-17, 1979 in denying or failing to
_approve the specific plan for the Higuera.Commerce Park could.not make.any .
final decision.on specific plan until.such.time.as.the matter has been - returned
... to.the Planning Commission for _recommendation.on.any.proposed changes- discussed
by the City.Council. He reviewed.Section 65504 of the.California Government
......Code dealing with references to proposed - changes,.etc. He stated that the
City,Council.could talk to the property owner and developer but could not
actually adopt any changes at this time.
_Terry Sanville, planner, submitted ..a.repor.t.on:.behalf.of..the city -staff based
.on Mr..Strong.'s request.of.the council.to. reconsider their:action in not
approving the plan. He stated that.there. are a..number:of important issues
identified in R._Strong's letter that should -.be discussed by the City Council.
....However, the key issue appears.to.be one of.-land use. By.not adopting the
Higuera Commerce Park plan and initiating -the general plain-.amendment.for.
._agriculture, the majority of the council.indicated that the agricultural
land... use option should be considered. While_specific.plans.can deal with
...the'timing.and phasing of development,..the long -term use of the.property
.- needs,:to..be.clearl.y. understood :and.::agreed..upon... He.proposed.:the following
......alternatives.for the council's consideration:
Alternative #1: Agriculture /Conservation.Designation -(80 Acres)
Alternative #2: Service Commercial /Light Industrial.(80 Acres)
Alternative #3: Service Commercial /Light.Industrial (80 Acres) - Staged
Alternative #4: Service Commercial /Light Industrial (50 Acres).- Staged
Interim Agri.culture.(30.Acres - .Ultimate Use Determined Later)
He stated that the .recommendation.of_.the..staff, while there were a number of
other strategies the council may wish to.discuss was:
1. Direct.the.staff.to.work with_Rob..Strong..to prepare an amendment to
the draft.specific plan-report which.._ incorporates -environmental
mitigation measures, the Planning Commission's recommendations, and
-.a more..explicit.phasing program (which would . spell out time limits
and - "build out" requirements)..
2. Refer these amendments.to.the Planning-Commission for their reconsider -
ation and.report. This is.required..by California Law.
3. Initiate.an amendment .to.._the...general..plan to - change the land -use
designation of the southern_30- acre:_ area _from.. "service;_commercial /
' light..industrial.'.' to- " interim :agriciulture,'.'.and..expand this .designa-
tion..to appropr.iate.areas in the.county presently designated rural
industrial."- _.. .
4.. Initiate the_ rezoning- of.._the::.southern.30 -acre parcel from C -H -SP to
A /C- 20 -SP. This would be.done subsequent to-the general plan
amendment.recommended in number 3.
It was moved by Councilman Dunin,- seconded:by.Mayor Cooper,--that-the city
staff be directed.to: 1) cease any.general plan amendment at this time,
from C -H -SP to A/C in the subject .area, 2) refer the written request from

R. Strong to the Planning Commission. for their review of possible amendment,
and 3) for guidance of the Planning Commission, the City Council would look
with favor on alternate X14 for guidance.
Motion carried on the following roll call vote:

NOES: Councilmember Jorgensen
ABSENT: Councilwoman Billig
1:45 p.m. the.City Council adjourned to an executive session.
2:05 p.m. the City Council reconvened in regular session, Councilwoman
Billig, absent.
There being no further business to come before the City Council, Mayor Cooper
adjourned to 4:00 p.m., Tuesday, May 15, 1979.

1. Street Deficiency Priority List was again considered by the City
Council for the fiscal year.1979 -1980.
D.F. Romero, Director of Public Services, stated that the street deficiency
priority list reflected the Council determinations made at the meeting of
May 8, 1979. He recommended that the Council adopt the priority list by
motion thus permitting the City Staff to proceed with improvements during
the next budget year. He also asked that the City Council review Priority
No. 1, improvement of Los Osos Valley Road from Prefumo Canyon Road to the
Fire Station, a 2" asphalt and concrete paving. He stated that the 1978
priority for this street included the installation of landscaped median islands
on Los Osos Valley Road between Madonna. and Oceanaire Drive at an estimated
cost of $20,000.00. He also pointed out that the landscaped median island
