HAND DELIVERED
Please be advised that we hereby withdraw our application for
rezoning of the property at Madonna Road and Calle Joaquin for
San Luis Mall, which application was scheduled for hearing by
the City Council on February 14, 1980. We recognize that this
withdrawal terminates this application and necessitates a new
application at a later date.
Please disregard our request for a continuance of this matter
as previously submitted. The request was necessitated by the
limited time period available for our preparation prior to the
scheduled hearing.
The reason for the withdrawal is that we have independently
decided to proceed with the public opinion study that originally
was to have been a joint effort between Rybar and the B.I.A.
The B.I.A. unilaterally withdrew their prior approval of par-
ticipation in this study. We are anxious to receive the final
results of the survey to determine what effect the information
may have on our program.

George Thacher, City Attorney, felt that the City Council did not need
to take any action on the application as it has been withdrawn making
any Council consideration moot.
There being no further business to come before the meeting, Mayor Cooper
adjourned the meeting at 7:50 p.m., to 4:00 p.m., Tuesday, February 19, 1980.
