Rob Strong', representing Gann Investments,.appeared- before the City Council amending their original request stating that they_recognized.that.they could start part of the subdivision's development involving 8.to.10 single family lots along Corrita and Senaro Drives that would not effect the drainage channel.concerns which these 8 -10 lots could be.constructed. this winter and the remainder of the subdivision, including the greenbelt.-extension and drainage channels-could be deferred until April, 1981. He. continued that this partial completion of improvements would serve the same function as an addition to the bond amounts to offset inflation. He continued-that while there were no legal prohibition upon passing an ordinance it would seem prudent to refrain from doing so until the courts ruling had..set.some.guidelines in this.area. Therefore.he suggested that the City Council continue.this matter for.90 days for a final decision by the courts. In order for the Council to make such a determination it must -find "It is not within.the intent of tlie- Municipal.Code of this city to: require park -in -lieu fees of'a. subdivision-. that. does not'. increase the burden on the city park system ". He continued that two similar requests had been heard.by the Council and that in both cases a residence existed and was.occupied on.the proposed lots. In this case an old house existed on a portion of the lot. As a requirement of the subdivision the house was demolished and the new building was under con- struction. In.one previous case the park -in -lieu fees were deferred until further development of a subdivision on the parcel. The City Council held a public hearing to consider approving the final map for Minor Subdivision No. SLO 79 -186 combining two lots into one lot at 2049 Swazey Street; Richard Burke Corporation, subdivider. Wayne Peterson, City Engineer, stated that the Public Services Department had reviewed the final map, a bond in the amount of $6,600 was on file to guarantee installation of street trees and paving of Swazey Street and all other conditions of the tentative map had been met. He recommended that the City Council accept the final map and authorize the Mayor to sign the agreement. The City Council held a public hearing to consider extending an existing ordinance that prevents the conversion of downtown housing to offices and stores. If the ordinance extension were approved the moratorium on conversion of downtown housing would remain in effect for an additional year. Henry Engen, Community Development Director, stated that the City Council had adopted an ordinance placing a moratorium on conversion on housing in downtown to offices or other commercial uses. He stated that in the one year interim the staff was to work with the Administrator and City Attorney to simplify and bring it back for further review. He continued that the city had sent the Federal Department of Housing and Urban Development a grant request for $350,000. The money would be used to help rehabilitate older housing in the Central Business District. As part of the grant application, the City told HUD that it would adopt regulations that would "limit the conversion of downtown housing to non - residential uses ". He stated that the moratorium on conversion of downtown housing runs out on October 15, 1980 and he felt the moratorium should be continued. He concluded by stating that the most recent word from HUD that there appeared to be no problem with the City's block application and the city should receive final confirmation sometime in the beginning of October. He recommended that the City Council review regulations and suggest amendments where appropriate, send the regu- lations back to the Planning Commission for consideration of a public hearing, request the Commission respond to the Council referral as soon as possible within'aW days "and - extedd" the •8tiri3eraion morat6rium'dralriarice for afy additional one year. Mayor Cooper declared the public hearing open. Mr. Haroutenian, Granada Hotel, appeared before the City Council urging that they not adopt the moratorium ordinance as he stated that it had caused them nothing but grief that they cannot rent apartments, they cannot rent hotel rooms, there are no seniors and they never have lived in the hotel and they were in financial dire straits caused by this moratorium. He begged the Council not to readopt the ordinance. Mayor Cooper declared the public hearing closed. Councilman Bond stated he would not support extending the ordinance moratorium on downtown conversion. He felt now the city had a block grant from the Federal government some improving work should be done and the city should proceed without the moratorium. Councilman Munger felt the existing moratorium should be lifted and not extended for 12 months. He did not feel that this program had worked to the benefit of the people of San Luis Obispo. She.felt the City's program was to support housing in.the downtown area until city got.some.word on the grant.. After lengthy.discussion by member of the City Council, it was the consensus of the Council that the rules were.too restrictive and that they should be adopted in .order of guidelines.rather....than strict.and..fast rules which just add great obstacles to conversion or retention of housing in .the downtown area. It was the Mass Transportation Committee's recommendation that the Council adopt an increased level of service to the Laguna and South Higuera areas ' represented by Alternate 1A. They also recognized the cost implication of the additional service. They felt the increased service might be limited and and the city should hold off a fare increase at this time. D.F. Romero, Public Services Director, stated that the shuttle service for three hours in the morning and three hours in the afternoon would carry with it approximately a $59,000 per year price tag and it was his opinion that the city could not absorb the additional expense within the bus operations without exceeding the fare - box limitations. Therefore, he recommended that the City Council take action to raise bus fares or reduce bus operation cost by reducing service to some other area of the community. On motion of Councilwoman Billig, seconded by Councilman Bond, the matter of the additional service to the South Higuera - Laguna Lake areas were con- tinued to a future study session and also the discussion of rate increases until transportation workshop. The City Council considered accepting a grant offer from the United States Environmental Protection Agency to construct Phase I of the Wastewater Treatment Plant Improvement Project. D.F. Romero, Public Services Director, reported to the City Council that the city had been offered an EPA Grant in the amount of $1,067,250 and a State Grant in the amount of $177,875. These represented 75% and 121-2x respectively of the $1,423,000 estimated cost for Phase I of.the Wastewater Treatment I Plant improvement project. At the final approval stage, the review engineer for the State disallowed the sludge thickeners, pumps and piping as a Phase I improvement, even those these had been included in all reports and approvals prior to this date (the latest approval being in June, 1980). The disallowance of this major componenet (about $400,000) at this late hour will require fairly substantial modification of the plans and specifications, a probably amendment to the Jenks design contract, and several months delay in advertising the contract. He reminded the Council that the total project cost was estimated at $6,750,000. Jim Nicholas, project evaluator for the State, had advised the city that they proceed with this grant offer and not await the results of the city's appeal. ' He indicated that funds were available for the project at present but future funding was quite uncertain because of the possibility that huge grants to San Francisco and Los Angeles might dry up the funds. Mr. Romero recommended that the city accept the grant offer and proceed. He also stated that he was meeting with officials of the Water Quality Control Board on the City's appeal and had asked for a 60 -clay extension of time to accept the grant offer by the city. He also reported that as of this date, the City was granted a 60 -day time extension to accept the clean water grant which would allow time for the City Council to further evaluate the project and grant eligibility conditions prior to taking formal action.
