COUNCIL HEARING ROOM, CITY HALL, 990 PALM STREET Roll Call Councilmembers , Present: Melanie Billig, Alan Bond, Ron Dunin, Gerald Munger and Mayor Lynn R. Cooper Absent: None City Staff Present: Lee Walton, Administrative Officer; George Thacher, City Attorney; J.H. Fitzpatrick, City Clerk; Henry Engen, Community Development Director; D.F. Romero, Public Services Director F410 A. Henry Engen, Community Development Director, brought to the Council's attention a communication from the agent for Irish Hills Haciendas stating that following the public hearing on October 28, 1980, modifying the focused EIR for the tract, the developer felt that as they must prepare an EIR even though a limited one, it was in their best interest to.include all the items recommended by city staff and they were so informing the Council that they were proceeding with a normal EIR. 1. D.F. Romero, Public Services Director, stated he had had a meeting with the Boriacks dealing with the inadequate storm drainage and the sewer lateral at their property at 172 Broad Street. He continued that the proposal made to ' the Boriack's which seemed acceptable was: 1) City at its sole cost will connect to the existing 30" pipe which enters the Boriack property from Broad Street and construct a new pipe of 30" and 42" size in a route and alignment to clear the Boriack sewer lateral, follow along the southerly portion of the carport and discharge to the drainage channel behind the carport. 2) City will restore all improvemetns damaged by the pipe installation as nearly as possible to original condition. 3) City will construct an energy dissipater at the outlet of the pipe and will modify the trash rack :-arrangement at the inlet to the 30" pipe. 4) City agrees that should improvements installed pursuant to this agree- ment result in damage to the channel downstream of the pipe outlet, City will make appropriate repairs. 5) Boriacks' grant permission for the City or its contractor to enter the premises to conduct the work and grant an easement 10 ft. wide centered on the 42" storm drain. 6) City agrees to withdraw abatement proceedings. After discussion, the Public Services Director stated the work proposed under the agreement was in the magnitude of $25,000 to $28,000 all to be paid for by the city. He felt that this was an improvement that would fit into a master plan for drainage of the area. After discussion and questions and some minor amendments to the agreement, the City Council authorized the Public Services Director to return to the Boriacks with their suggestions and if they will sign the agreement to proceed with the improvement.
