C -3 1982 -1983 BUDGET NARRATIVE REVISIONS On motion of Councilman Griffin, seconded by Councilwoman Dovey, the program narratives as amended.be.approved . and_staff to publish.the final 1982 -1983 budget as amended. Motion carried, Councilman Settle and Mayor Billig absent. Councilman Griffin commented that the City had made significant strides with.respect to the budget review process; and the.narratives that contain the program objectives for the coming fiscal year he felt represented a rare opportunity for an expression of policy and compli- mented the staff-and management team for a job well done. C -4 QUARTERLY REPORT - GROWTH MANAGEMENT REGULATIONS On motion of Councilman Griffin, seconded by Councilwoman Dovey, the second 1982 quarterly report on growth management regulations be received and filed. Motion carried, Councilman Settle and Mayor Billig absent. C -5 EMS AGENCY FUNDING On motion of Councilman Griffin, seconded by Councilwoman Dovey, funding of $7,370 to EMS Agency be authorized paid. Motion carried, Councilman Settle and Mayor Billig absent. C -6 SLOCOG JPA ANNUAL RATIFICATION AND WORK PROGRAM On motion of Councilman Griffin, seconded by Councilwoman Dovey, the following resolution was introduced: Resolution No. 4898 (1982 Series), a resolution of the Council of the City of San Luis Obispo ratifying the Joint Powers Agreement.which establishes the.San Luis Obispo County Area Council of Governments and the Annual Work Program for Regional Transporta- tion Planning Agency be approved. C -10 GOLF SCORECARDS FOR MUNICIPAL GOLF COURSE On motion of Councilman Griffin, seconded by Councilwoman Dovey, the following resolution was introduced: Resolution No. 4903 (1982 Series), a resolution of the Council of the City of San:Luis Obispo approving an agreement between the City and Sports Score Company for furnishing scorecards for City Golf Course be adopted. CONFIRMING COSTS OF SIDEWALK CONSTRUCTION Council held a public hearing to consider confirmation of costs for sidewalk construction under the 1911 Act. (File No. 532) Dave Romero, Public Services Director, stated that the list represented those property owners who had elected not to make repairs after city notification. The work was then conducted under a city contract. He indicated all of the property owners were notified of the cost and the meeting. He stated the name "Meredith" should be removed from the list Council received because it had been paid. Vice -Mayor Dunin declared the public hearing open. No.one spoke for or against confirmation of costs for sidewalk construction. Vice -Mayor Dunin declared the public hearing closed. On motion of Councilwoman Dovey, seconded by Councilman Griffin, the following resolution was-introduced: Resolution No. 4904 (1982 Series), a resolution confirming costs for sidewalk construction conducted under the 1911 Act be adopted. Passed and adopted on the following roll call vote: AYES: Councilmembers Dovey, Griffin and Vice -Mayor Dunin NOES: None ABSENT: Councilman Settle and Mayor Billig 2. FINAL MAP APPROVAL FOR MINOR SUBDIVISION NO. 80 -121 Dave Romero, Public Services Director, stated that the final map was correct but there was a problem with variance. He-requested continuance 1 so it could be worked out with the developer. (File No. 430, 80 -121) On motion of Councilman Griffin, seconded by Councilwoman Dovey, to continue public Bearing to consider final map approval for minor sub- division No. 80 -121 until August 31, 1982. Motion carried, Councilman Settle and Mayor Billig absent. 3. FINAL MAP APPROVAL FOR MINOR SUBDIVISION NO. 81 -291 Council held a public hearing to consider a resolution granting final map approval for minor subdivision No. 81 -291 located at 274 Foothill Blvd.; Mark Eisemann, subdivider. (File No. 430, 81 -291) Dave Romero, Public Services Director, indicated these were four existing lots being subdivided into four different lots. He stated the developer has followed Council's conditions regarding drainage problems had posted $2,000 for tree planting, completion of some minor improvements on the site and driveway grading. The subdivision is now to city.standards, and staff recommended approval. Upon question by Councilwoman Dovey, Mr. Romero stated there had been dirt graded into the creek but that everything had been taken care of to remove that dirt. Councilman Griffin questioned if the initial concerns of adjacent property owners regarding drainage had been resolved to their satis- faction under the grading and drainage plan. Dave Romero indicated that the condition was that the developer make certain improvements to the property being developed, and the Council report at that time to the staff was that part of the problem could only be resolved by the property owner to the west. He stated.that the neighbor still needed to take care of low drainage, but the developer has done all required to meet city conditions. On motion of Councilman Griffin, seconded by Councilwoman Dovey, the following resolution was introduced: Resolution No. 4905 (1982 Series), a resolution of the Council of the City of San Luis Obispo granting final map approval for minor subdivision No. 81 -291 located at 274 Foothill Blvd. Passed and adopted on the following roll call vote: AYES: Councilmembers Griffin, Dovey and Vice -Mayor Dunin NOES: None ABSENT: Councilman Settle and Mayor Billig 4. TIME EXTENSION FOR MINOR SUBDIVISION NO. 80 -45 Council held a public hearing to consider a Planning Commission recommen- dation to grant a 6 -month time extension to submit the final map for minor subdivision No. 80 -45 creating 2 lots from 1 lot, located at 1425 Woodside Drive; R -2 zone, Flagg Industries, Inc., subdivider. (File No. 430, 80 -45) Toby Ross, Community Development Director, stated the 6 -month time extension was being recommended by the Planning Commission and staff. Vice -Mayor Dunin declared the public hearing open. No one spoke for or against the time extension. Vice -Mayor Dunin declared the public hearing closed. ... On motion of Councilman Griffin, seconded by Councilwoman Dovey, the following resolution was introduced: Resolution No. 4906 (1982 Series), a resolution of the Council of the City of San Luis Obispo approving a 6 -month time extension to submit the.final map for minor subdivision No. 80 -45 creating 2 lots from 1 lot, located at 1425 Woodside Drive. APPROVAL FOR MINOR SUBDIVISION NO. 82 -106 Council held a public hearing to consider a Planning Commission recommen- dation to grant tentative map approval for minor subdivision No. 82 -106 to modify one unit of existing air -space office condominium, located at 100 Casa Street, 0 zone; Ross, Levin & MacIntyre, subdivider. (File No. 430, 82 -106) Toby Ross, Community Development Director, stated the applicant was requesting an addition to the building and staff recommended approval as submitted. 1 Vice -Mayor Dunin declared the public hearing open. Ken Maclntyre, representing the applicant of this project, indicated they had no problems with the conditions as stated and concurred with staff's recommendation. Vice -Mayor Dunin declared the public hearing closed. On motion of Councilwoman Dovey, seconded by Councilman Griffin, the following resolution was introduced: Resolution No. 4907 (1982 Series), a resolution of the Council of the City of San Luis Obispo granting City Council Minutes Tuesday, July 27, 1982 - 7:00 p.m. Page 6 tentative map approval for minor subdivision No. 82 -106 to modify one unit of existing air -space office condominium, located at 100 Casa Street. APPEAL OF PLANNING COMMISSION - DEL MONTE CAFE Toby Ross, Community Development Director, stated the appellant is requesting a 90 -day continuance on his appeal of the Planning Commis- sion's action denying variance to allow reduced parking from 13 spaces to 9 spaces to allow expansion of restaurant seating (File No. 407). Staff had no objection to continuing the appeal. On motion of Councilwoman Dovey, seconded by Councilman Griffin, to continue the Del Monte Cafe appeal to October 19, 1982, meeting. Motion carried, Councilman Settle and Mayor Billig absent. 7. ACTIONS RELATING TO "STONERIDGE" PR�3ECT Council held public hearings to consider amendment and time extension of a planned development project consisting of 43 lots and 46 dwelling units at 2877 Broad Street; R -1 -PD zone; John King, applicant. (File Nos. 410, 935). A. Planned Development PD0890 -A - Public hearing to consider an ordin- ance approving amended planned development project -- preliminary plan. B. Tract 935 (Stoneridge) - Public hearing to consider adoption of a resolution to approve a.12 -month extension to submit final map creating a 43 -lot optional design residential subdivision containing 4 condominium units and 42 lots. Toby Ross, Community Development Director, stated the developer was asking for a time extension and staff supported the request. Vice -Mayor Dunin declared the public hearing open. Roy Hanff, 569 Lawrence Drive, questioned the filing date of Mr. Lenger's letter of May 17, 1982. He stated there was no proof of when the city actually received the letter. He stated he had gone to the Planning Commission and asked to see the city ledger to see when the amount was deposited; all he got was Mr. Lenger's letter and never received the city ledger. He felt like somebody might be trying to cover up something and Council may be continuing something that may never be annexed to the city. He thought Council should postpone voting until the ledger was found to prove the date the letter and deposit were received. Toby Ross, Community Development Director, was satisfied that the application and handwritten letter were received in time. He did not believe anyone would change a date to accommodate the developer. Geoff Grote, Assistant City Administrative Officer, stated he discussed this matter with Mr. Bruce who indicated the letter had come in on May 17, 1982, and was received by the office. Toby Ross indicated if a check is received prior to 3:00 p.m., it is stamped that day, but this is not a good indication of when the appli- cation was received. Introduced and passed to print on the following roll call vote: AYES: Councilmembers Dovey, Griffin and Vice -Mayor Dunin NOES: None ABSENT: Councilman Settle and Mayor Billig On motion of Councilwoman Dovey, seconded by Councilman Griffin, the following resolution was introduced: Resolution No. 4908 (1982 Series), a resolution of the Council of the City of San Luis Obispo approving a 12 -month time extension to submit the final map for Tract 935, creating a 43 -lot optional design residential subdivision containing 4 condominium units and 42 lots. Passed and adopted on the.following roll call vote: AYES: Councilmembers Dovey, Griffin and Vice -Mayor Dunin NOES: None ABSENT: Councilman Settle and Mayor Billig Councilman Griffin stated he would like toy emphasize, to.the.City Administrative Officer, the need to.simplify.the.procedures:for a citizen to obtain information between two departments. Councilwoman Dovey concurred with Councilman Griffin's comment. 8. FINAL PASSAGE OF ORDINANCE NO. 929 - SIDEWALK SALES Council held a public hearing to consider final passage of Ordinance No. 929, an ordinance regulating sidewalk sales in San Luis Obispo. (File No. 478) Geoff Grote,.Assistant Administrative Officer, stated the ordinance was amended slightly on July 6, 1982, and was now back before Council for final passage and public hearing. He explained that-if the.ordinance was adopted, staff would be returning to Council within a 30 -day period to present a resolution that no-fees be charged to secure a permit. Vice -Mayor Dunin declared the public hearing open. Joe Green, a resident of Arroyo Grande working in San Luis Obispo, stated he was a merchant who partakes in sidewalk days. He stated it was a very important day because it brought a lot of exposure. He pointed out that revenue taken in is taxable and goes to the city. He urged Council to pass the ordinance as amended which will allow holding sidewalk sales on Saturday. Vice -Mayor Dunin declared the public hearing closed. On motion of Councilwoman Dovey, seconded by Councilman Griffin, to give final passage to Ordinance No. 929. FINAL PASSAGE OF ORDINANCE 931 - TERRACE HILL City Council Minutes Tuesday, July 27, 1982 - 7:00 p.m. Page 8 Council held a public hearing to consider final passage of Ordinance No. 931, an ordinance rezoning property known as.Terrace Hill from R -1, R -1 Specific Plan, R =1 Special Considerations and R -2 to R -1 Planned Develop- ment. (File No. 463) Toby Ross, Community Development Director, stated that this item was considered by Council on July 13, 1982, and,was now coming back for final adoption. Vice -Mayor Dunin declared the public hearing open. No one spoke for or 1 against adoption of the ordinance. Vice -Mayor Dunin declared the public hearing closed. On motion 'of Councilwoman Dovey, seconded by Councilman Griffin, to give final passage'to Ordinance No. 931'. Finally passed on the following roll call vote: AYES: Councilmembers Dovey, Griffin and Vice -Mayor Dunin NOES: None ABSENT: Councilman Settle and Mayor Billig 10. PREVAILING WAGE RATES On motion of Councilwoman Dovey, seconded by Councilman Griffin, to continue prevailing wage..rates to the August 10; 1982, meeting. Motion carried, Councilman Settle and Mayor Billig absent. C O M M U N I C A T I O N S Dave Romero, Public Services Director, reported on the water crisis that day. He said a broken trunk main that serves the Terrace Hill and the v 1 entire Johnson Avenue area was discovered at 1:30 a.m. The line that split was cast iron, 16 inches in diameter, ! inch wall thickness and installed in 1957. The main reservoir was almost drained out and pavement was severely damaged. They had a piece of pipe to fit and were able to put it in at approximately 10:00 a.m. The rest of the day was spent trying to fill up tanks at the Johnson Avenue area. He indicated people at high elevations were out'of water and there were traffic jams; however, by 3:00 p.m. all water was on and traffic was restored to near normal. He was concerned because they did not have any way to bypass this main trunk line; and he would come back with a proposal so they could bypass a main trunk line in the future. Councilwoman Dovey questioned what the potential was for this happening again. Dave Romero stated that heavy walled cast iron pipe should not really fail at all'. He indicated it happened a few years ago near the Madonna Road Plaza. The staff has since changed specs but there is still no real way to check it. He stated they try to keep one or two additional pieces of every size pipe available. Vice -Mayor Dunin requested in a case of near catastrophe to let the Councilmembers know as soon as possible so they can be in a position to answer calls without having to refer people to other departments. Councilwoman Dovey was concerned about getting the word out so people would realize they needed to conserve water. The measures taken to accomplish this (i.e., driving through the neighborhood with a bullhorn; radio announcements, etc.) would have to be determined on a case -to -case basis. Dave Romero felt it depended upon whether it was a life threatening situation. City Council Minutes Tuesday, July 27, 1982 - 7:00 p.m. Page 9 Roger Neuman, Police Chief, felt driving through a neighborhood with a bullhorn should be kept to emergency situations only. Councilwoman Dovey was concerned about notifying hospitals and wondered if they kept supplementary water supplies. Vice -Mayor Dunin was concerned about fire protection. Dave Romero indicated they would have to take a hard look at the fire protection situation in the future and felt there should be a bypass or reserve. Vice -Mayor Dunin felt a report should come to Council to consider changing the priorities. 7:40 p.m. Council adjourned to Closed Session to discuss personnel and litigation matters. 7:50 p.m. Council reconvened in open session, Councilman Settle and Mayor Billig absent. A -1 PURCHASE AND SALE OF PROPERTY - PIANTANIDA On motion of Councilman Griffin, seconded by Councilwoman Dovey, the following resolution was introduced: Resolution No. 4909 (1982 Series), a resolution approving an agreement between the City of San Luis Obispo and Paul and Edna Piantanida for purchase and sale of property at 1010 Nipomo Street, San Luis Obispo. Passed and adopted on the following roll call vote: AYES: Councilmembers Griffin, Dovey and Vice -Mayor Dunin NOES: None 1 ABSENT: Councilman Settle and Mayor Billig Councilwoman Dovey suggested that Council ask staff to approach the present tenant with an offer of at least a one -year lease for the premises at the current rate being paid. George Thacher, City Attorney, stated they would do that. Councilman Griffin felt this should be handled as a separate item. Upon general consensus Council directed staff to approach the present tenant. 8:03 p.m. Council adjourned to closed session to discuss personnel and litigation matters. 9:00 p.m. Council reconvened in regular session, Councilman Settle and Mayor Billig absent.
