He felt.the agreement:sets a.very.poor precedent for the city. Depositions should have proceeded.as the city ' had no wrong doing to cover up. ..He felt the terms of the agreement were excessive. The City of San Luis Obispo.was.proper.in selecting the lowest offer that benefitted the public which:would have provided a reasonable.transit system.:. Dave.Larson, Rutan & Tucker, stated the agreement was based on the .-advise of the City Attorney and special legal counsel as being a reasonable resolution. COUNCIL CHAMBERS, CITY HALL, 990 PALM STREET SAN LUIS OBISPO, CALIFORNIA STUDY SESSION ROLL CALL Councilmembers ' Present: GlennaDeane Dovey, Ron Runin, Robert Griffin, Allen Settle and Mayor Melanie C. Billig. Absent: None City Staff Present: Paul Lanspery, Administrative Officer; Geoff Grote, Assistant Administrative Officer; Pamela Voges, City Clerk; Toby Ross, Community Development Director; Terry Sanville, Senior Planner City Council Minutes Tuesday, November 23, 1982 - 7:00 p.m. Page 2 1. HILLSIDE PLANNING PROGRAM Toby Ross, Community Development Director, reviewed the Council agenda report concerning Hillside Planning Program (For detailed information concerning background, Planning Commission recommendations, and staff recommendations outlining general hillside.criteria, please.see: file no. 467). He gave a'background summary report explaining that-:the initial report had presented staff recommendations for -19 hillside areas but in March of 1982 the Council identified six areas for the Planning Commission to review, and these were the six that the Council would be reviewing tonight and discussing at future public hearings. The next hearing was scheduled for December 7, 1982, and again on January 11, 1983:. He then reviewed the five program objectives: 1) Urban reserve line; 2) open - space preservation goals; 3) establishing planning policy before specific projects were.proposed; 4) identifying the need and establishing:guidelines for additional planning; and 5) establishing pertinent development policies and standards for each of the hillside planning areas. The basic concepts that were being applied were: 1) The urban reserve line; 2) open -space preservation programs; 3) development transfer programs; 4) density transfer programs; 5) minor expansion programs; 6) provision of services. He reviewed the general hillside standards as recommended by the Planning Commission and stated that the Council would be requested to accept the Planning Commission's recommendations with few exceptions. He then reviewed each of the six sites including the Planning Commission and staff recommendations. The six sites included: 1) Yancy's Hill /Howard Johnson's Restaurant area; 2) Luneta Drive area; 3) highschool /hospital area; 4) Gold Tree area; 5) Southwood Drive area /Alrita Street. In most cases staff agreed with Planning•Commission recommendations but:.there were areas where they differed (for recommended'General Plan and zoning changes, see pages 9 -30 of the report; for individual Planning'Commis- sion actions for each of the six areas, please review beginning with page 45)•_ . After brief discussion and upon general consensus, Council agreed the , Hillside Planning Program be continued.for.public hearing at-the December 7, 1982, Council meeting. (5 -0) Due to lack of business items, Council agreed to cancel the Regular Meeting for December 21, 1982. C O M M U N I C A T I O N S Mayor Billig reviewed a letter received from Ethel Cooley thanking the Council for their recent matching -fund contribution of $1,500 for the Jack House Carriage reconstruction..., .
