for a 30" diameter storm drain, however, the storm drain crossing the
railroad tracks is 24" and the very tight vertical spacing of many utilities
in the intersection would preclude installation of bigger than a 24" line
without significant increased costs. Staff is recommending that a change
order be issued to install a 24" storm drain through the work arei,�to the
creek west of Leff Street.
After brief discussion it was moved by Councilman Dunin, seconded by Mayor
Billig, to authorize construction of the 24" storm drain in Osos Street as
recommended by staff. ... 1
Passed and adopted on the following-roll call vote.
AYES: Councilman Dunin, Mayor Billig, Councilmembers Dovey and Griffin
NOES: None

A -2 CONSTRUCTION PROJECT DOWNTOWN - SEWERLINE IMPROVEMENT PORJECT -
HIGUERA STREET, CHORRO STREET, PACIFIC STREET, MORRO STREET
Councilman Dunin questioned the sewerline project that was currently being
constructed in the downtown area. He stated it had come to his attention
that this project could have been done at night for the same contract price
which he felt would have been more advantageous to the downtown business
owners. He also was concerned that the project continued on the Friday of
the three day holiday, which increased the congestion downtown. He had
been told that two cuts had been made, when maybe only one was required.
He asked staff to further investigate those charges.
After brief discussion, Council directed staff to review the downtown
sewerline project concerning the feasibility of the project being done at
night for the same contract price, avoidance of work being done on holiday
weekends and the charges that two cuts were made when only one may have
been needed (4 -0 -1).
1. TREE PROGRAM
Lane Wilson, Superintendent Building /Parks Maintenance, provided an informa-
tional program and slide presentation of the City's Tree Program developed
by the Parks Department. The presentation lasted for approximately 30
minutes in which Lane reviewed the Master Tree List, Downtown Tree List,
major streets with trees, Heritage Tree applications, tree permit /tree
problem form, annual schedule, annual objective calendar, proposed new
program for trees needing "TLC" and the Tree Policy and Budget Program (see
Tree Maintenance Program file no. 505).
Councilman Dunin was concerned with possible liability involved with the
"TLC" program, wherein citizens borrow city's equipment for pruning of
their trees.
Councilwoman Dovey felt that the program was an excellent one and the
presentation should be-used more extensively at the schools, possibly
Rotary, Lions Club and other such organizations, in an effort to inform the
public about the programs available.
Councilman Dunin was ' a ' Iso concerned that the- city not put itsel_f-.into the
position of competing ith private businesses insofar as equipment rentals
were concerned. He would also like to see the tree list currently _used in
the downtown area reviewed again with the possibility of removing any of
those trees that drop berries. He felt those trees were a real nuisance
and can cause real hazards for the public.
Upon general consensus staff was directed to review the liability involved
in lending equipment to citizens for tree pruning (4 -0 -1).
After additional discussion it was moved by Mayor Billig, seconded'by!
Councilwoman Dovey, that a review of downtown street trees be referred,to

staff as to appropriateness and feasibility of continuing with trees
bearing fruit or berries, input to be received by the Tree Committee, the
B.I.A., and Beautification Committee, with report back to Council within
six months. Motion carried, all ayes, Councilman Settle absent.
2. WATER CONSERVATION PLAN
Paul Lanspery, Administrative Officer, reviewed the recommended Water
Conservation Plan as prepared by the Citizens' Advisory Committee outlining
the comprehensive plan with its variety of options and recommendations. He
stated that the document was planned to be used more as a resource document
during the process of preparing the overall water management plan, that the
Council had requested the first two recommended elements of the plan would
be public information program and an infrastructure improvement program.
It was the feeling of the committee that the Public Works Department would
be.•the appropriate lead agency as to the implementation. Also recommended
.was that the program be evaluated every three years (report and backup
material available in file no. 517).
Bill.Hetland, Utilities Manager, also reviewed some of the points of the
plan:with the comment that he felt the document was a good one and would
urge)Council's support.
With regard to public information for encouraging new and existing busi-
nesses to install water saving devices, Mayor Billig also would encourage
the B.I.A. to put together a committee or at least review retrofitting in
new and existing businesses for the installation of the water saving
devices. ' z .
Councilman Griffin cautioned that acceptance of the report should reflect
that the city was:not necessarily accepting it as policy, but rather was
receiving the report with additional comments by Councilmembers to be
submitted to staff for later incorporation in the Water Management Plan.
;He would suggest that a letter of appreciation be sent to the committee
thanking them for their efforts.
Councilman Dunin stated he had several concerns,
to bring his notes with him so he too would like
'suggestions by Councilmembers be submitted to St.

1:20 p.m. Councilman Griffin left the meeting.
Mayor Billig suggested the use of a prerecorded message in the event of
emergencies for a water emergency standby.
After discussion it was moved by Councilwoman Dovey, seconded by Mayor
Billig, to receive -the report with Mayor'to send•a letter of appreciation
to the committee thanking them for their efforts, report to be used as a
resource document in preparing the water management plan. Motion carried,
all ayes, Councilmembers Griffin and Settle absent.
3. SIDEWALK SALES ORDINANCE
Toby Ross, Community Development Director, gave a brief status report on
Ordinance No. 929 which regulated sidewalk sales in the downtown area (see
file no. 478). He stated there had only been limited experience with the
operation of the Sidewalk Sales Ordinance in the past year with only four
permits having been issued, which included two permits for special B.I.A.
sales events. No input had been received from the B.I.A. or individual
merchants regarding the ordinance and the ordinance did not appear to have
any significant fiscal impact. It was staff's recommendation that Council
direct staff to continue monitoring the ordinance and report back in April

of 1984. The Council could decide at that time whether additional review
was required. _..
After brief discussion it was moved by Mayor Billig, seconded -by Councilman
Dunin, for staff to further monitor the ordinance with input to be received
by the B.I.A. and Chamber of Commerce, with report back -by_ April- .1984.
Motion carried, all ayes, Councilmembers Griffin and Settle absent.
1:30 p.m. Mayor Billig declared a recess. -
1:35 p.m..City Council reconvened, Councilmembers Griffin and Settle
absent..
4. HIGUERA COMMERCE PARK
Toby Ross, Community Development Director, briefly reviewed the Higuera
Commerce Park Specific Plan which was adopted on July.of.1979 and'amended
in February 1982 (see file no. 410 -703). He stated the-Specific Plan•,ii
guided land use and included site planning and design standards dealing
with setbacks, parking requirements, landscaping, outdoor storage andi'
screening. On September 20 the.Council would be considering additional
amendments to the plan, therefore, he wanted to review the plan.and develop-
ment in the area.
Councilman Dunin questioned the review process as it would relate to-.
including additional landscaping or general guidelines to be used by
property owners for general landscape plans. He felt a standard landscape
program as a part of the development process would be extremely important.
Mayor Billig reminded the Council that when the 30 -acre property .had.."-)
originally been rezoned, it was the city's.intent to get high -tech industry
in this area. She also had a real problem with the current land use as it
related to encouraging bowling, skating rinks, miniature.golf and theatres.
She did not feel those were appropriate uses and would like that reviewed
again. She also felt a home improvement center as far as the selling'of
radios and televisions was inappropriate.
Paul Lanspery, Administrative Officer, suggested that additional incentives
be given in this aiea similar to the discussion with regard to Auto Park
Way. ;
Council made additional general comments and, upon consensus, Council
agreed that additional suggestions come back to staff at the September'20,
1983, Council meeting.
There being no further business to come before t e Council, Mayor Billig
adjourned the meeting at 2:25 p.m. to Tuesda §, S ptember 2 , 1983, at 7:00 p.m.
