HomeMy WebLinkAbout10/24/1983M I N U T E S ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF SAN LUIS OBISPO MONDAY, OCTOBER 24, 1983 - 12:00 NOON COUNCIL HEARING ROOM, CITY HALL, 990 PALM STREET SAN LUIS OBISPO, CALIFORNIA ROLL CALL Councilmembers Present: GlennaDeane Dovey, Ron Dunin, Robert Griffin, Allen K. Settle and Mayor - Melanie C. Billig. Absent: None City Staff Present: Paul Lanspery, Administrative - Officer; Roger.Picquet;•City Attorney; Pamela Voges, City Clerk; Ann Crossey, Personnel Director;. Dave .Romero,..Public Works. Director..... A-1,-REPORT-ON BIDS - DRAINAGE IMPROVEMENT PROJECT Dave Romero,. Public Works Director, reported on bids received for. "DRAINAGE IMPROVEMENT PROJECT - FLORA STREET SWALE ", City Plan No. H -22 -H; bid estimate $24,000, without contingencies•(see file no.83- 26)... He.said.this was priority number 3 on the Minor Waterway Modification.list.recently. adopted by Council, and that the Administrative Officer had approved•the plans and specifications and authorized staff to go for bids. The only reason staff was requesting Council approval at this time; was because the bid estimate had been estimated'at $24,000 and the low bid came in $273 over the $25,000 limit that requires Council approval. He felt that based upon the short bid period allowed, the complexities and unknowns involved in hillside constriction work of this type, and the fact the contractors in the area are still overextended with.work, this was a low and reasonable bid and should be awarded. He would, therefore, recommend Council adoption of the resolution awarding the low bid to R. Burke Corp. in the amount of $25,273'. Mayor Billig was-concerned that it: appeared that the drainage problems in this area were expanding and questioned if this project would mitigate the problem. Dave Romero, Public Works Director, stated that although there -were no guarantees,. he did feel.that this would be sufficient. Councilman.Duni.n stated.that.he would like-to see developed a system that when a development occurs above an existing project in the city, that the people below would in some way be protected. He would like to see what the owners above;.or.the development that occurs above the landowners, might contribute towards its mitigation. To that extent, he would like.to put the County on notice that the property on the periphery of the city, if there was-any flooding; would be held responsible. Councilman Settle agreed; that if any impact was such that-the offsite had helped to contribute to it, that there should be some way to require the ' above development to contribute towards its mitigation. Upon question; Roger Picquet, City Attorney, stated that he would look into the legality of the responsibility of the other property owner. He also cautioned Councilwoman Dovey that, because this project.does'take.place behind her property, there would be a possible conflict of interest. Councilwoman Dovey stated that although she did not believe there was an interest connected directly as far as her property was concerned, she would abstain from voting and at 12:20 p.m. left the meeting. City Council Minutes p Monday, October 24, 1983 - 12:00 Page 2 Councilman Griffin suggested that staff bring back a report when this project was finished and at that time it might be more appropriate to send a communication to the County with the City's concerns., Mayor Billig again stated, that insofar as potential future.liability, she felt very uncomfortable with the project as presently proposed. 1. After brief discussion, it was moved by Councilman.Settle, seconded by Councilman Griffin, to adopt the following resolution: Resolution No. 5240 ' (1983 Series), a resolution of the Council of the City.of San Luis Obispo awarding the contact to R. Burke Corp., in the amount of $25,273 with an additional finding as suggested by the City Attorney that this was for an urgency purpose. Passed and adopted on the following roll call vote: AYES: Councilmembers Settle, Griffin, Dunin and Mayor Billig NOES: None 1 ABSENT: Councilwoman Dovey Council also requested staff be directed to report back upon completion of the project at which time Council could discuss the need to communicate with the County regarding drainage.consequences of this- project.(4 -0 -1). 12:40 p.m. Councilwoman Dovey returned to her seat.
