WASTEWATER TREATMENT PLANT UNIT II CONTRACT (File 4183 -01) ' - Council considered a resolution consenting to the substitution of painting subcontractor on the wastewater treatment plant, unit II contract (continued from 11- 13 -84). A full and complete tape and transcript is available for this meeting. The following is a synopsis of that transcript. Dave Romero, Public Works Director, briefly reviewed the Council agenda report. Mayor Billig declared the public hearing open. Scott Fort, resident engineer for the project, briefly stated that, in his opinion, Associated West's work had been less than satisfactory in quality and progress. In his opinion the proposed new subcontractor, Peterson Painting, was qualified to do the work. Councilman Dunin requested that those individuals wishing to speak at this hearing be sworn in. 12:45 p.m. Mayor Billig arrived at the meeting. Pam Voges, City Clerk, swore in John D. Meyer and Marshal Agee. Public testimony received by Marshal Agee, General Superintendent and part owner of E1 Camino Construction Co.; John Myers, Associated West Coatings; and Scott Fort, Resident Engineer for E1 Camino Construction Co., (see tape for complete testimony - draft transcript also available in City Clerk's Office). Mayor Billig declared the public hearing closed. On motion of Councilwoman Dovey, seconded by-Councilman Settle, to adopt the resolution with amendments as submitted by Councilmembers Dunin and Griffin. Councilwoman Dovey stated that she could support the resolution as she could make the findings that were listed in the body of it. Primarily being that the work was not done in a timely manner, city staff was not in a position to get back into the building, failure to complete the job, and failure to perform the work. Councilman Settle agreed with comments made by Councilwoman Dovey. He also felt that the comments made by Roger Picquet with regard to §4107 of the Government Code had been adequately addressed. Councilman Dunin stated that he would support the mot -ion because the request was only to allow the substitution. He did, however, have reser- vations as to this being done after the fact. ' Mayor Billig agreed to support the motion as she felt the requirements of e §4107 had been satisfied and the verbal explanation had also made her feel comfortable. After discussion, Resolution No. 5530 (1984 Series), a resolution of the Council of the City of San Luis Obispo be adopted consenting to the substi- tution of a painting subcontractor on the wastewater treatment plant, unit II contract with amendments as submitted by Councilmembers Dunin and Griffin. Page 3 C O M M U N I C A T I O N S C -1 Vice -Mayor Settle presented Paul Lanspery, Administrative Officer, a resolution of appreciation for his efforts as secretary to the League of California Cities for 1983 -84. Councilman Dunin requested that in the future he would prefer that Council approve any staff time that would be required for activities not directly related to the City of San Luis Obispo. C -2 Mayor Billig presented the City a check for $12,000 on behalf of the Rotary Club as their contribution for a tot .pool at the Sinsheimer Park. C -3 Mayor Billig submitted a letter written by Ruben Sienz urging:the city's opposition of toxic waste storage and its passage through the city. C -4 Mayor Billig presented a letter from residents concerned about future closure near the Slack /Hathway Street area should a recreational facility be approved by Cal Poly. C -5 A citizens' advisory commission had been established for each prison -in the State of California as required by AB 2774. The City Council nominated Ron Dunin and Kenneth Schwartz as possible candidates.
