1. STORM DRAINAGE REPORT (File #597)
Dave Romero, Public Works Director, gave a lengthy review of the storm
drainage report and stated that staff was recommending that Council take
several actions as follows:

a) Direct staff regarding Council preference in modifying existing
ordinances or preparing a new ordinance to deal with abatement of
obstructions and litter.
b) Direct staff regarding approaches to be pursued to finance storm
drainage improvements.
c) Direct staff to proceed with final draft of ordinance regarding permit
and inspection process for storm drainage improvements.
d) Direct staff regarding modifications desired in creek setback program.
e) Direct staff to delay detailed studies to determine the feasibility of
individual flood protection measures until the Corps has completed its
study.
P R O J E C T S
a) Approve staff request to conduct intermediate level improvements to
San Luis Obispo Creek between Madonna Road and Marsh Street in 1985.
b) Determine whether staff should proceed with negotiations with the Elks
Club to obtain right -of -way in exchange for creek work.
Wayne Peterson, City Engineer, addressed the issue of establishing an
ordinance for clarifying creek maintenance and responsibility for the
property owner, littering and polluting.
Dave Elliott, Administrative Assistant, reported on analyses to create a
storm drainage utility or easement districts in addition to funding
sources and property dedication requirements.

After discussion Council reached consensus on each item as follows:
Policy a - Staff directed to modify existing ordinances to deal with the
abatement of obstructions and litter with cross - referencing to the various
ordinances (4 -1).
Policy b - Staff directed to defer pursuing finance storm drainage
improvements until the tight spots are completed; intermediate projects
are finished and the Corps study finished and evaluated.
Council indicated that they would be supportive of going with the
combination financing approach listed as #6 when these were completed
(3 -2).
Policy c - Staff directed to proceed with the final draft of an ordinance
regarding permit and inspection process for storm drainage improvements
(5 -O).
Policy d - Staff directed to prepare a draft ordinance concerning the
creek setback program to come back at a future study session with field
trip to be taken by Councilmembers and newsmedia first (5 -0).
Policy e - Staff directed to delay detailed studies to determine the
feasibility of individual flood protection measures until the Corps has
completed its study. A letter to be sent to the Corps asking for their
proposed time frame for completion and letting them know that the city is
interested in this report (5 -0).
Project a - Staff to bring back a report for Council review for the
intermediate level improvements to San Luis Obispo Creek between Madonna
Road and Marsh Street in 1985. This to come back to Council as soon as
possible (5 -0).
Project b - Staff directed to prepare staff report and backup agenda
material with regard to whether negotiations with the Elks Club to obtain
a right -of -way in exchange for creek work should be approved (5 -0).
2. HOUSING ELEMENT (File #462)
Toby Ross, Community Development Director, briefly reviewed the agenda
report concerning the Housing Element Scope. He asked that staff be given
direction with regard to the various components the Council wished to have
included in the new housing element.
After brief discussion Council concurred with staff's recommendation
(5 -0).
There being no further business to come before the City Council, Mayor
Billig adjourned the ting at 2:10 p.m. to Monday, May 20, 1985, at
12:10 p.m.
