C -4 CLAIM AGAINST THE CITY - F. MIRANDA (File #189)
Claim against the City by Florence Miranda in the amount of $1,000,000 for
fatal injuries to Ramona Elisa Miranda (mother) allegedly caused by
dangerous road conditions (outside city limits) was denied as recommended
(5 -0).
C -5 PLANS AND SPECIFICATIONS - MISSION PLAZA IMPROVEMENT PROJECT
Plans and specifications for "Mission Plaza Improvement - Project- -Broad
Street Stairway," City Plan No. J -24Y; bid estimate $15,550, without
contingencies, approved as recommended (5 -0).
C -6 TRAFFIC SIGNAL MODIFICATION (File #1144)
Resolution No. 5711 (1985 Series), a resolution of the Council of the City
of San Luis Obispo was adopted approving agreement with Caltrans for
installation of pre - emptive equipment at traffic signals on Broad Street
at Orcutt and Tank Farm Roads as recommended (5 -0).
C -7 GENERAL MUNICIPAL ELECTION NOVEMBER 5, 1985 (File #324)
Resolution No. 5712 (1985 Series), a resolution of the Council of the City
of San Luis Obispo was adopted calling the election to be held Tuesday,
November 5, 1985, as recommended (5 -0).
Resolution No. 5713 (1985 Series), a resolution of the Council of the City
of San Luis Obispo was adopted as recommended requesting consolidation
with the San Luis Obispo County Board of Supervisors to consolidate the
General Municipal Election with the School Governing Boards and Special
Districts Election to be-held Tuesday, November 5, 1985 (5 -0).
C -8 ZONE 9 - STREAMBED CLEARANCE PROGRAM (File #591)
' Resolution No. 5714 (1985 Series), a resolution of the Council of the City
of San Luis Obispo was adopted as recommended approving agreement between
the City and County Flood Control District Zone 9 for streambed clearing
and erosion control projects ($210,000) (5 -0).
Staff directed to include introductory training orientation.program with
CCC for the protection of the habitat (5 -0).
C -9 CHAMBER OF COMMERCE CONTRACTS (File #1055)
A. Resolution No. 5715 (1985 Series), a resolution of the Council of the
City of San Luis Obispo was adopted as recommended approving one -year
agreement between the City and the Chamber of Commerce to continue to
operate the visitors and tourist information center for period July 1,
1985, through June 30, 1986 ($27,968) (5 -0).
B. Resolution No. 57.16 (1985 Series), a resolution of the Council of the
City of San Luis Obispo was adopted as recommended approving one -year
agreement between the City and the Chamber of Commerce to perform
promotional services on behalf of the city for period July 1, 1985,
through June 30, 1986 ($23,282) (5 -0).
C -10 NUCLEAR ARMS RACE (File #1102)
Resolution No. 5717 (1985 Series), a resolution of the Council of the City
of San Luis Obispo was adopted declaring 1985 as the year to reverse the
Nuclear Arms Race as recommended (3 -2, Councilmembers Dovey and Dunin
voting no).

1. GOLF COURSE FEES (File #880)
Council considered increasing fees for the Laguna Lake Municipal Golf
Course (continued from 6- 18 -85).

Lane Wilson, Parks /Building Manager, briefly reviewed the agenda report
with the recommendation that Council adopt the resolution which would
approve the new fees for the golf course as recommended. He then reviewed
some of the changes that had been submitted since the Council's public
hearing on this issue.
Mayor Billig asked for public comment.
Lynn Stober, San Luis Obispo resident, spoke in opposition to the fee
increase as he felt that.a subsidy from the taxpayers was warranted
towards these revenues. He felt it was unfair that the costs be born
entirely by the players with regard to additional amenities and other
maintenance.
Mayor Billig closed the public portion.
Councilman Settle asked that the record reflect that the concerns
previously raised by concerned citizens had been addressed by staff as
outlined in the staff report.
Councilman Griffin stated that he could support the rate increase as he
felt that the operation was in a more stable position. He would have
preferred to have seen the rates phased over a two -year period.
Councilman Settle agreed.
Councilwoman Dove y would support the increase and explained that this
would not be a profit- making enterprise but only an effort to have it pay
its way.
Councilman Dunin stated he would have also preferred seeing a staged
approach and could not support the increase.
Mayor Billig felt that real improvements had been made and that the
increases were necessary to keep it a quality operation.
On motion of Councilman Griffin, seconded by Councilwoman Dove y,
Resolution No. 5718 (1985 Series); a resolution of the Council of the City
of San Luis Obispo was adopted approving fee increases at the Laguna Lake
Municipal Golf Course as recommended (4 -1, Councilman Dunin voting no).
On motion of Councilman Griffin, seconded by Councilman Settle, to direct
staff to report back on the golf course long -term reserves regarding
capital outlay of major and minor expenditures (5 -0).

2. SUBDIVISION TIME EXTENSION - TRACT 1119 (File #410 -1119)
Council held a public hearing to consider a 12 -month time extension for
submission of the final map for Tract 1119 (Hillrise Gardens), creating a
12 -unit residential air -space condominium project at 480 North Chorro
Street; R -4 zone; Richard McCapes, subdivider.
Jeff Hook, Associate Planner, briefly reviewed the agenda report with the
recommendation that Council deny the time extension subject to the
recommended findings.
Mayor Billig declared the public hearing open.
T. Keith Gurnee, of Richmond Rossi & Montgomery, spoke on behalf of Bob
Richmond, the subdividers' representative, and stated that the subdivider
had finally been able to put together the financial construction package.
He reminded the Council that the tract map had been unanimously approved
by Council in June 1983. Without the time extension, he believed an
apartment building with more units could probably be constructed. He felt
it was of benefit to the city to provide the time extension as the
condominiums would pay substantially higher fees toward park development
than would apartments and would offer better open space design. Rather
than deny the tentative map extension, he suggested a compromise by adding
conditions to the tentative map extension that would implement the
condominium development regulations on open space, storage, and energy
conservation.

Upon question, Roger Picguet,• City Attorney, stated that conditions are
not binding if added as part of a time extension, or at the final map
stage.
Mayor Billig declared the public hearing closed
On motion of Councilwoman Dove y, seconded by Councilman Dunin, Resolution
No. 5719 (1985 Series), a resolution of the Council of the City of San
Luis Obispo was adopted approving the 12 -month time extension for Tract
1119 as requested by the applicant (3 -2, Councilman Griffin and Mayor
Billig voting no).
Councilwoman Dove y stated she could support it as she did not feel that
the condominium regulations were relevant for student housing, which this
project was. She would favor restudy of the condo regulations again in
this regard. She did not feel the open space requirement was applicable.
Councilman Griffin and Mayor Billig could-not support the time extension
as they felt that the applicant did not pursue the final map in a timely
fashion.
3. DATUM PLANE /STREET CROSS SECTIONS (File #532)
Council held a public hearing to consider an ordinance repealing Chapter
1.24, Title 1 of the Municipal Code regarding city datum (elevations) and
street cross sections, and adopting a new section in Chapter 12 entitled
"Datum Plane," (Streets, Sidewalks and Public Places).
Wayne Peterson, City Engineer, briefly reviewed the agenda report with the
recommendation that Council pass -to -print the ordinance as recommended.
Mayor Billig declared the public hearing open. No one spoke:for or
against the proposed ordinance. Mayor Billie declared the public hearing
closed.
On motion of Councilman Settle, seconded by Mayor Billie, Ordinance No.
1039 (1985 Series), an ordinance of the Council of the City of San Luis .
Obispo was introduced to print amending datum plane and street cross
sections as recommended (5 -0).
4. STREAMBED ABATEMENT (File #597)
Council held a public hearing to consider an ordinance amending the
Municipal Code regarding abatement of dangerous obstructions in
streambeds.
Wayne Peterson, City Engineer, briefly reviewed the agenda report with the
recommendation that Council pass -to -print the ordinance as recommended by
staff.
Mayor Billig declared the public hearing open. No one spoke for or
against the proposed-ordinance: Mayor Billie declared the public.hearing
closed.
Councilwoman Dove y had concerns with regard to charging a property owner
only during the rainy season for inspection of dangerous obstructions and
not during the dry months:-- .
' Councilman Griffin asked that staff review the enforcement authority
section to provide that the Tree Committee would be given better assurance
that it would review all obstructions.
After discussion it was moved by Councilman Settle, seconded by Councilman
Griffin, to continue the ordinance with staff directed to reword the
enforcement section and clarify other language as needed (5 -0).
5. SOLID WASTE DISPOSAL.(File. #524)
Council held a public hearing to consider.an ordinance amending the
Municipal Code regarding solid waste disposal, including prohibiting
disposal in-creeks and drainage ways.

On motion of Councilman Settle, seconded by Councilman Dunin, Ordinance
No. 1040 (1985 Series), an ordinance of the Council of the City of San
Luis Obispo was introduced to print amending the Municipal Code regarding
solid waste disposal as recommended (5 -0).
Mayor Billig also suggested that the CAO request that the CCC and CMC make
periodic enforcement checks (Council concurred 5 -0).
8:20 p.m. Mayor Billig declared a recess. 8:30 p.m. City Council
reconvened, all Councilmembers present.
6. STREET ABANDONMENT - BRIZZOLARA (File #535)
Council held a public hearing to consider final abandonment of a portion
of Brizzolara Street right -of -way at the southerly end adjacent to U.S.
Highway 101 (continued from 8- 3 -82).
Wayne Peterson, City Engineer, reviewed the agenda report with the
recommendation that staff abandon Brizzolara Street subject to recordation
of a parcel map and reservation of utility drainage and access easements
as recommended:
Mayor Billig declared the public hearing open. No one spoke for or
against the proposed abandonment. Mayor Billig declared the public
hearing closed.
On motion of Councilwoman Dove y, seconded by Councilman Settle, Resolution '
No. 5720 (1985 Series), a resolution of the Council of the City of San
Luis Obispo was adopted abandoning portion of Brizzolara Street as
recommended (5 -0).
7. APPEAL OF TREE COMMITTEE DECISION /PLANS AND SPECIFICATIONS FOR
DRAINAGE IMPROVEMENT PROJECT (File #505)
Council held a public hearing to consider an appeal by the Public Works
Director of a decision by the Tree Committee to deny request for removal
of three trees at the Santa Rosa Street Bridge site; and consideration of
plans and specifications for drainage improvement project in San Luis
Creek at Santa Rosa Street; City Plan No. J -0811; bid estimate $15,000,
without contingencies.
Wayne Peterson, City Engineer, reviewed the agenda report stating that the
recommended action was for Council to uphold the appeal of the Public
Works Director and authorize staff to remove the trees and proceed with
construction. He then reviewed various slides and also suggested other
alternatives that might be available short of removal of the trees.
Mayor Billig declared the public hearing open.
Lane Wilson, Parks /Building Manager, reviewed the staff's position with
regard to removal of the trees.
Jerry Emery spoke on behalf of the Tree Committee and their view as far as
preservation of the trees if at all possible. They did support the
removal of the palm tree.
Mayor Billig declared the public hearing closed.
After lengthy discussion, Mayor Billig suggested some compromise that
would provide for the removal of one large sycamore tree directly upstream
of Santa Rosa; the removal of the palm tree on the north bank directly
downstream of Santa Rosa; the existing sycamore tree downstream have
proposed improvements, i.e. gabions and pruning to minimize damage to the
tree; remove the middle tree and replant a new sycamore at Kardel's
property to minimize the large sycamore removal.

On motion of Mayor Billig, seconded by Councilman Settle, Resolution No.
5721 (1985 Series), a resolution of the Council of the City of San Luis
Obispo was adopted upholding appeal of the Public Works Director with
amendments as discussed by Mayor Billig (5 -0).
Plans and specifications approved and staff authorized to call for bids
(5 -0).

8. GENERAL MUNICIPAL ELECTION BALLOT MEASURES (File #324)
Council considered the Council Subcommittee (Settle /Dovey) report
regarding review of proposed ballot measures for the November 5, 1985,
General Municipal Election.
Vice -Mayor Settle stated that Council had previously looked at several
possible Charter sections that might be amended in the next few
elections. This time only one section was being proposed for change which
was in regard to limitation of terms, Section 405.
After discussion and on motion of Councilman Dunin, seconded by Mayor
Billig, staff was directed to work with Council Subcommittee
(Settle /Dovey) and report back to Council with possible ballot measures
and recommendation for the Council meeting Monday, July 15, 1985 (5 -0).
9. Mayor Billig adjourned the meeting to the Council Hearing Room to
review a 25- minute video concerning joint and several liability.
There being no further business to come before the City Council, Mayor
Billig adjourned the meeting at 10:00 p.m. t Friday, July 12, 1985, at
5:30 p.m. /
