COUNCIL HEARING ROOM, CITY HALL, 990 PALM STREET SAN LUIS OBISPO, CALIFORNIA ROLL CALL: Councilmembers Present: GlennaDeane Dovey, Ron Dunin, Robert Griffin, Vice -Mayor Allen K. Settle and Mayor Melanie C. Billig Absent: none City Staff Present: Paul Lanspery, Administrative Officer; Roger Picquet, City Attorney; Pamela Voges, City Clerk; Geoff Grote, Assistant Administrative Officer 1. DECLARING A LOCAL EMERGENCY (File #715) Council considered a resolution ratifying the Mayor's Proclamation of the existence of a local emergency in the City of San Luis Obispo. On motion of Councilman Settle, seconded by Councilman Dunin, Resolution No. 5723 (1985 Series), a resolution of the Council of the City of San Luis Obispo was adopted ratifying the Mayor's Proclamation of the existence of a local emergency as recommended (5 -0). 2. BALLOT MEASURES (File #324) Council reviewed and considered ballot measures for the November 5, 1985, General Municipal Election. Vice -Mayor Settle briefly reviewed the Council Subcommittee report with the recommendation that Council adopt three resolutions to submit proposed Charter amendments, Sections 405, 602 and 606, and 908 for the ballot. He also proposed that the Subcommittee and staff review future proposed amendments and develop a prioritization and time schedule by December 1985. A) Council then reviewed the first resolution of a proposed amendment to the City of San Luis Obispo Charter Section 405 which would limit the term of any elected official to eight years in succession excluding partial terms. After discussion it was moved by Councilman Settle, seconded by Councilman Dunin, to adopt Resolution No. 5724 (1985 Series), a resolution of the Council of the City of San Luis Obispo approving a proposed amendment to the City of San Luis Obispo Charter Section 405 which would limit the terms of office with suggested wording by Councilman Griffin and other minor amendments as indicated: "WHEREAS, a general municipal election is scheduled to be held on Tuesday, 1 November 5, 1985;" with amendment to SECTION 1 to read, "The, ¢ general municipal election is hereby ordered to be held on Tuesday, November 5, 1985, fbf Znk bbtbbAk bf shall include voting on a proposed amendment to Charter Section 405 which would qualify -terms of office to exclude partial terms of less than one -half duration." SECION 405. Limitation of Terms. (A) Neither the Mayor nor any member of the Council shall serve in the same office for more than eight (8) years in succession; provided, however, that any time in office resulting from 46 10 a partial term of office, which is less than one-half (1/2) the length of the full term for that office, shall not be considered. PAGE 2 MEASURE A Shall City Charter Section 405 be amended so that time served as a result of an appointment or election which is less than one -half (1/2) of the full term not be included in determining the eight (8) year limitation? Motion carried unanimously (5 -0). B) Council considered a resolution to vote on a proposed amendment to City of San Luis Obispo Charter Sections 602 and 606 to revise ordinance requirements and amendments. Councilman Griffin recommended that the fourth Whereas in the clari- fication of Section 1 be included as in the first resolution. Council then reviewed the resolution and on motion of Councilwoman Dovey, seconded by Councilman Dunin, to adopt Resolution No. 5725 (1985 Series), a resolution of the Council of the City of San Luis Obispo to include a vote on a proposed amendment to City of San Luis Obispo Charter Sections 602 and 606 to revise ordinance requirements, with amendments as follows: include some revisions to the fourth Whereas and Section 1 as previously recommended by Councilman Griffin and amend Measure B question wording to read, "Shall City Charter Sections 602 and 606 be amended to allow for 00OV00¢gy$ changes to the Municipal Code $0$ t$¢ 0¢401100 iihWW VVYjj0gYjOV Of 001¢ 000$000$j$ to be done by subsections W90i Vjy��V OVVY�00� ?" Motion carried (5 -0). Council considered a resolution to vote on a proposed amendment to City of San Luis Obispo Charter to add Section 908 requiring voter approval to release, repeal or rescind any dedicated open space. Councilman Griffin again suggested adding the revised fourth Whereas and revision to Section 1 as stated earlier. On motion of Councilman Settle, seconded by Mayor Billig to adopt the resolution as recommended. After discussion a substitution motion was made by Councilman Griffin, seconded by Councilman Dunin to amend section 908 to read, "No open space easement or dedicated passive park or other dedicated open space required or provided by a real property owner as a condition for development of the real property shall be released, repealed, rescinded, or otherwise amended or terminated, in whole or in part, at any time, without dddjdddY d� five affirmative votes of the Council." Council discussed whether it should be a four - fifths or a full Council approval requirement. The motion passed on a 3 -2 vote, Councilman Settle and Mayor Billig voting no. Council then took action on the original motion, moved by Councilman Settle, seconded by Mayor Billig to approve the resolution which included the amendment. The motion failed on a 2 -3 vote, Councilmembers Dovey, Settle and Mayor Billig voting no. On motion of Councilwoman Dovey, seconded by Councilman Dunin, to continue this item to a future date. Motion carried on a 3 -2 vote, Councilman Griffin and Mayor Billig voting no. Councilman Settle then asked for reconsideration of the motion. On motion of Councilman Settle, seconded by Mayor Billig, to reconsider this item. Motion passed on a 3 -2 vote, Councilmembers Dunin and Dovey voting no. On motion of Mayor Billig, seconded by Councilman Settle, to place this measure on the ballot as originally recommended. Motion failed on a 2 -3 vote, Councilmembers Dovey, Dunin and Griffin voting no. The motion to continue to a future date was then reinstated (3 -2, Councilman Griffin and Mayor Billig voting no). PAGE 3 C) Council considered a resolution which would amend the City Charter to add Section 908 to require development of lands annexed to the City to be consistent with the General Plan. After discussion and on motion of Councilman Griffin, seconded by Councilman Settle, to adopt Resolution No. 5726 (1985 Series), a resolution of the Council of the City of San Luis Obispo to include a vote on a proposed amendment to City of San Luis Obispo Charter to add Section 908 requiring development of lands annexed to the City to be consistent with the General Plan with the amendment to add the fourth Whereas and revision to Section 1 as previously recommended by Councilman Griffin. Councilman Dunin felt that there were already sufficient provisions in City regulations that would not make this additional section to the Charter necessary. Councilwoman Dovey felt it was important that ballot measures be unanimous if submitted to the voters and, therefore, could not support the resolution. Motion passed on a.3-2 vote. Councilmembers Dovey and Dunin voting no. C O M M U N I C A T I O N S C -1 Roger Picquet, City Attorney, stated that he had received a request from Howard Sagaser from the City of Fresno, representing various farmers in the area who were concerned about the environmental review process regarding a proposed prison site in their area. Mr. Sagaser requested that the Council show support by sending a letter asking the State to provide a complete hearing process as governed by the EIR requirements. After discussion and upon general consensus the Mayor was directed to write a letter regarding Council's support of stricter enforcement of the State's EIR process concerning State prisons (5 -0). 2:05 p.m. Mayor Billig declared a recess. 2:32 p.m. City Council reconvened, all Councilmembers present. Mayor Billig submitted a draft urgency ordinance asking for future discussion by the Council and a possible moratorium on conversion of residential uses in the office zone. Council continued the CAO evaluation (closed session) to Tuesday, July 16, 1985.
