PAGE 2 C -1 COUNCIL MINUTES Council minutes of Thursday, August 15, 1985 - 12:00 noon approved as amended (5 -0). C -2 CONTRACT PAY ESTIMATES Contract pay estimates approved and ordered paid for "Waterline Improvement Project, Hillcrest Place - Grove to Park Avenue; Park Avenue - Wilson to Mill," City Plan No. H03P as recommended (5 -0). C -3 CLAIM AGAINST THE CITY - KARAM (File #189) Claim against the City by Raymond Karam in the amount of $162 for reimbursement of expenses in connection with a parking ticket violation was denied as recommended (5 -0). C -4 REPORT ON BIDS - SEWAGE TREATMENT PLANT (File #85 -18) Resolution No. 5790 (1985 Series), a resolution of the Council of the City of San Luis Obispo was adopted as recommended awarding contract to Madonna Construction Co. in the amount of $59,925 for "Sewage Treatment Plant Paving Project," City Plan No. F -20; bid estimate $65,000, without contingencies (5 -0). C -5 HUMAN SERVICES (File #1011) Resolution No. 5791 (1985 Series), a resolution of the Council of the City of San Luis Obispo was adopted approving contract with the Salvation Army in the amount of $18,000 for fiscal year 1985 -86 as recommended (5 -0). C -6 PERSONNEL SERVICES (File #601) Resolution No. 5792 (1985 Series), a resolution of the Council of the City of San Luis Obispo was adopted approving agreement with Cal Poly for work study program ($7,500) as recommended (5 -0). C -7 CONSTRUCTION INSPECTION SERVICES (File #401) Staff authorized to negotiate final contract with William Wittmeyer for construction inspection services for a one -year period July 1, 1985, through June 30, 1986, (budgeted amount $45,000) as recommended (5 -0). C -8 PERFORMING ARTS FACILITY (File #854) CAO authorized to negotiate with Hall, Goodhue, Haisley and Barker to provide consultant services for assessing the siting, financing, major features, operations and long -term maintenance for a community performing arts facility (continued from 8 -6 -85) as recommended (5 -0). C -9 PUBLIC IMPROVEMENTS - SAN LUIS MALL (File #416) Staff authorized to enter into agreement with bond cousel for public improvements in conjunction with the San Luis Mall as recommended (5 -0). P U B L I C H E A R I N G S 1. APPEAL PROVISIONS (File #407) Council held a public hearing to consider granting final passage to Ordinance No. 1044, amending the Municipal Code concerning appeal provisions regarding third party appeals (continued from 9- 3 -85). Roger Picquet, City Attorney, briefly reviewed the agenda report with the recommendation that Council give final passage to the ordinance. Mayor Billig declared the public hearing open. No one spoke for or against the proposed final passage. Mayor Billig declared the public hearing closed. CITY COUNCIL MINUTES - TUESDAY, SEPTEMBER 17, 1985 - 7:00 P.M. PAGE 3 On motion of Councilman Settle, seconded by Councilman Griffin, Ordinance No. 1044 was given final passage as recommended (5 -0). 2. PROPOSED SUBDIVISION - TRACT 1310 (File #410 -1310) Council continued its public hearing to consider granting tentative map approval for Tract 1310, creating a 9 -unit residential air -space condominium at 3100 Johnson Avenue; Jim Dummit, subdivider; R -1 zone (continued from 8- 6 -85). Toby Ross, Community Development Director, briefly reviewed the agenda report with the recommendation that Council adopt a revised resolution which would approve the tentative tract map based on findings and subject to conditions as recommended by the Planning Commission. Mayor Billie declared the public hearing open. Terry Simons, representing Mr. Dummit, reviewed the revised proposal pursuant to their letter dated August 28, 1985, in which they re- evaluated their proposal in light of the concerns raised by the Council. They selected various mitigation measures that they felt would satisfy those concerns. Gordon Paul, 3160 Johnson Avenue and an adjacent property owner, stated that Mr. Dummit had verbally agreed to put in additional landscaping between the two properties for an additional barrier effect. He also questioned whether a playground would go in that area, to which Mr. Ross stated there was no proposal for a playground. With that exception, Mr. Paul would be supportive of the project. Mrs. Alice Paul, 3160 Johnson Avenue, also spoke in support of the project. Mayor Billie declared the public hearing closed. Councilman Settle stated he still had problems with the project, particularly with regard to the density, height and scope of the project. He was also concerned as to how it would affect the character the neighborhood. Mayor Billie agreed and felt that it was architecturally well designed, however, the site plan could have been improved. On motion of Councilman Dunin, seconded by Councilwoman Dove y, Resolution No. 5793 (1985 Series), a resolution of the Council of the City of San Luis Obispo was adopted approving tentative map for Tract 1310 with amendment to add condition #23 as it related to the planting of trees on the southeast boundary line for the adjacent property owner (5 -0). Councilman Griffin stated that in light of the concerns with regard to the standards applied to this development, he would suggest review of these standards in the near future. Mayor Billie agreed. 3. APPEAL - SANDS MOTEL (File #407) Council held a public hearing to consider an appeal by Jess Norris of a decision by the Hearing Officer to grant tentative map approval for Minor Subdivision No. 85 -226 to combine 8 lots and portions of two lots into one lot at 1930 Monterey Street (Sands Motel); C -T zone. Toby Ross, Community Development Director, briefly reviewed the agenda report with the recommendation that Council adopt a resolution to deny the appeal and uphold the Hearing Officer's action with amendments, to the resolution contained in the agenda packet, which would allow for 1) a certificate of compliance to be submitted in lieu of the final map and; 2) allow the subdivider to dedicate right -of -way for future street widening or meet the requirement by paying the city an amount equal to the appraised value of the dedication. CITY COUNCIL MINUTES - TUESDAY, SEPTEMBER 17, 1985 - 7:00 P.M. PAGE 4 7:40 p.m. Mayor Billig declared a recess. 7:50 p.m. City Council reconvened, all Councilmembers present. Mayor Billig declared the public hearing open. Jess Norris, appellant, spoke in support of his appeal and reviewed the project since its inception and explained that his primary concern was that he could not meet the requirements being asked by staff as he was not owner of the subject property. He stated he was not supportive of paying 1 for the dedication of the property as no plan lines had been adopted for Monterey Street but if this was the only way to meet the conditions, he would be willing to abide by them. Mayor Billig declared the public hearing closed. On motion of Councilwoman Dove y, seconded by Mayor Billig, Resolution No. 5794 (1985 Series), a resolution of the Council of the City of San Luis Obispo was adopted denying the appeal and upholding the Hearing Officer's decision to.grant tentative map for MS 85 -226 as amended this evening and including minor wording changes made by Councilman Griffin (5 -0). On motion of Councilman Settle, seconded by Mayor Billig, to direct staff to bring back within 60 days the Broad Street plan line for determination. After discussion the motion was amended to direct staff to bring back a progress report within 90 days reviewing how plan lines for the Monterey and Broad Street areas interface with other circulation element policies (5 -0). 4. ENERGY CONSERVATION (File #494) Council considered an ordinance amending the Municipal Code entitled "Solar Water Heating Regulations" regarding roof jacks for installing solar water heating systems; City of San Luis Obispo, applicant. Toby Ross, Community Development Director, briefly reviewed the agenda report with the recommendation that Council introduce the ordinance to print repealing the requirement for roof penetrations for solar water heating systems, as recommended. Mayor Billig declared the public hearing open. John French spoke in support of the ordinance. Mayor Billig declared the public hearing closed. On motion of Councilwoman Dove y, seconded by Councilman Settle, Ordinance No. 1045 (1985 Series), an ordinance of the Council of the City of San Luis Obispo was introduced to print amending the solar water heating regulations as recommended (5 -0). C 0 M M U N I C A T 1 0 N S C -1 Mayor Billig stated the annual League resolutions should be available within the next week for Council review. Councilman Settle updated the Council regarding recent League decisions - SB75, Joint & Several Liability Bill was not successful and it appeared that the Garcia decision would not be successful either. He also stated that Mayor Billig was elected first Vice - President of the Channel Counties Division, League of California Cities. 8:30 p.m. Mayor Billig adjourned the meeting to closed session to give instructions to the city's negotiator regarding negotiations with Mr. Clifford Evans, representing the Evans Family for the property located at 148 -182 Higuera; and Mr. and Mrs. Paul Prather regarding the property at 110 Higuera; and Mr. Dean McClish regarding the tenant, Budget Rent -A -Car, at 110 Higuera. 9:05 p.m. City Council reconvened in open session, all Councilmembers present. COUNCIL HEARING ROOM, CITY HALL, 990 PALM STREET SAN LUIS OBISPO, CALIFORNIA STUDY SESSION ROLL CALL: Councilmembers Present: GlennaDeane Dovey, Ron Dunin, Robert Griffin, Vice -Mayor Allen K. Settle and Mayor Melanie C. Billig Absent: None City Staff Present: Paul Lanspery, Administrative Officer; Roger Picquet, City Attorney; Pamela Voges, City Clerk; Geoff Grote, Assistant Administrative Officer; Don Englert, Police Chief 1. VIDEO OF SAN LUIS OBISPO (10 min.) A short video was shown produced by the Chamber of Commerce designed to enhance the visitor's industry to encourage tourists to stay longer in the San Luis Obispo area. Pat Duval, President of the Chamber of Commerce, briefly reviewed names of the individuals who helped in making this film. Dave Garth, Executive Director of the Chamber, stated that the video was available for showing to other individuals or organizations if city officials were interested. 2. SISTER CITY PROGRAM (File #859) Council considered participating in a Sister City Program with the City of Mondsee, Austria. Mayor Billig reviewed the agenda report with the recommendation that Council support the Sister City Program and authorize the Mayor and staff to pursue a sister city relationship in accordance with guidelines established by Sister Cities International. She stated that the resolution that would establish the guidelines along with budget documentation would return for Council approval. She stated also that Mondsee was doing a similar video as that of the Chamber video shown today. Councilman Settle stated he was supportive of the program and could support the recommended action.
