PAGE 2 consider the Mobilehome Rent Review Board record, conduct a further hearing, adjourn to closed session for deliberations, and further to modify the Board decision with the adoption of supplemental findings. Councilman Griffin questioned whether the Bar article written by Kenneth Bar was considered by the Rent Review Board as part of their methodology for a just rate of return. Legal Counsel stated that particular document was not considered as evidence. ' After discussion, staff was directed to submit a copy to Council for their information. Steve Henderson, staff representative, stated that staff was also recommending the Council support an inflation factor which the Board did not consider. Upon question by Councilman Griffin, Roger Picquet, City Attorney, stated that if substantial information were to be received from today's meeting, Council would still be able to make its determination rather than sending it back to the Rent Review Board. They could also send it back. Mayor Dunin declared the public hearing open. Jim Buttery, representing the owner of Chumash Mobilehome Park, reviewed the history of the park and the rent increase application emphasizing that the findings should include what a fair and just rate of return would be. This, however, was not made a part of the staff report or the discussion by the Review Board. He did not feel that any evidence had been brought forward that the property owner paid too much for the property. He would, therefore, like answered what is a reasonable and just return and what has been the actual dollars received from the park. 1:40 p.m. Mayor Dunin declared a recess. 1:55 p.m. City Council reconvened, all Councilmembers present. Ed Olpin, representing the tenants, responded to the points in the appeal in the order submitted. Following the arguments given by attorneys representing the owner'and tenants, Mayor Dunin adjourned the meeting to closed session to discuss the findings pursuant to Government Code Section 54956.9. 2:10 p.m. City Council reconvened in open session, all Councilmembers present.
