C -3 LOS OSOS VALLEY ROAD EXTENSION (File #1142)
Resolution No. 5902 (1986 Series), was adopted approving supplemental
agreement to. the Local Agency /State Master Agreement for Federal Aid
Projects for the Los Osos Valley Road Extension Project, C.P. *E08 as
recommended (4 -1. Griffin absent).
C -4 .MEMORANDUMS OF AGREEMENT (File #623/627)
1 A. Resolution No. 5903 (1986 Series), was adopted approving a two -year
Memorandum of Agreement with the San Luis Obispo City Employees'
Association for period January 1, 1986, through December 31, 1987, as
recommended (4 -1, Griffin absent).
B. Resolution No. 5904 (1986 Series), was adopted approving a two -year
Memorandum of Agreement with the City Mid - Management /Confidential
Employees for period of January 1, 1986, through December 31, 1987, as
recommended (4 -1, Griffin absent).
C -5 FINAL SUBDIVISION APPROVAL - MS 84 -267 (File #411)
Resolution No. 5905 (1986 Series), was adopted granting final map approval
for Minor Subdivision No. 84 -267, located at 603 and 617 Luneta Drive;
Ramesh T. Shah. subdivider, as recommended (4 -1, Griffin absent).
C -6 OVERSIZED UTILITY LINES (File #562)
Resolution No. 5906 (1986 Series), was adopted revising rates and fixed
formula for City contributions on oversized water and sewer lines, and
previous resolution rescinded as recommended (4 -1, Griffin absent).

1. STREET ABANDONMENT - GARFIELD (File #535)
Council held a public hearing to consider final abandonment of a portion
of street right -of -way (6 ft. on both sides) on Garfield Street between
Grand Avenue and Buena Vista Avenue; R -4 and C -T zones; Jesse Norris,
applicant (continued from 1- 21 -86).
Dave Romero, Public Works Director, reviewed the agenda report with the
recommendation that Council adopt the resolution abandoning a portion of
street right -of -way as recommended.
Mayor Dunin declared the public hearing open. No one spoke for or against
the proposed abandonment. Mayor Dunin declared the public hearing closed.
Moved by Dovey /Settle (5 -0), to adopt Resolution No. 5907 (1986 Series),
abandoning a portion of street right -of -way on Garfield between Grand
Avenue and Buena Vista as recommended.
2. REZONING - HIGUERA STREET (File #463)
Council held a public hearing to consider a Planning Commission
recommendation to amend the zone map to change the designation of
approximately 2.34 acres from service - commercial /light industrial (C -S) to
service - commercial /light industrial - special considerations (C -S -S) at 55
and 65 Higuera Street; City of San Luis Obispo, applicant (Henry Baron,
1 property owner) (continued from 2- 4 -86).
Jeff Hook, Associate Planner, reviewed the agenda report with the
recommendation that Council introduce the ordinance to print rezoning the
property as recommended.
Mayor Dunin stated for the record that a letter had been received from
Henry Baron, the property owner, regarding this issue.
Mayor Dunin declared the public hearing open. No one spoke for or against
the proposed rezoning. Mayor Dunin declared the public hearing closed.

After brief discussion, moved by Settle /Dover (3 -2, Griffin and Dunin
voting no), to introduce Ordinance No. 1054 (1986 Series), rezoning 55 and
65 Higuera Street from C -S to C -S -S with amendment as recommended by
Councilman Griffin to add language from Chapter 17.56 specifying that
concerns were site specific. Resolution amended as follows: "Whereas,
the "S" (Special Considerations) designation is to address traffic,
circulation, and land use compatibility concerns applicable to the site
and immediate area,'and not to a specific development project;"
Councilwoman Rappa could support adding an "S" designation on this
property due to concern for traffic impacts in the area. She was also
amenable to look at other properties in this area for inclusion of the "S"
designation.
Councilman Settle supported the "S" overlay to help traffic and
circulation problems in the area.
After additional discussion and upon general consensus, staff was directed
to report back on C -S properties in and around the areas bounded by South
Street to South Higuera as to appropriate zoning.
Council also reaffirmed appropriateness of the C -N zone at Broad and South
Street and requested that staff bring back a report regarding future
development plans at this location.
3. SUBDIVISION REGULATIONS AMENDMENT (File #411)
A. Council held a public hearing to consider giving final passage to
Ordinance No. 1053 amending the Subdivision Regulations to establish
requirements for processing "vesting tentative maps" for residential
subdivisions; City of San Luis Obispo, applicant (continued from 2- 4 -86).
B. consideration of a resolution establishing a $100 fee for the filing
of an application for vesting a tentative map.
Terry Sanville, Principal Planner, reviewed the agenda report with the ,
recommendation that Council give final passage to the ordinance and adopt
the resolution establishing a $100 fee as recommended.
Councilwoman Rappa expressed concern that additional language be added to
the ordinance that would let a developer know prior to filing the
application for vesting of a tentative map that other additional
application materials could be required, including ARC review.
Terry Sanville submitted three options for amending section 16.34.040,
filing and processing.
Mayor Dunin declared the public hearing open. No one spoke for or against
the proposed regulations. Mayor Dunin declared the public hearing closed.
Moved by Settle /Dover to introduce ordinance to print amending the
Subdivision Regulations to establish requirements for processing vesting
tentative maps as recommended by staff.
After additional review and discussion, Councilman Settle withdrew his
motion.
Moved by Griffin /Dunin (5 -0) to introduce Ordinance No. 1055 (1986
Series), to print establishing requirements for processing of vesting
tentative maps with an amendment to Section 16.34.040b to include option
#2, which reads "Prior to accepting an application for a vesting tentative
map, the Director may require the filing of complete application materials
for discretionary approvals associated with reasonably forseeable
development within the vesting map boundary."
Moved by Dovey /Griffin (5 -0), Resolution No. 5908 (1986 Series), was
adopted establishing $100 fee for filing application for vesting a
tentative map as recommended.
4. UNDERGROUND UTILITIES (File #562)
Council held a public hearing to consider an ordinance amending the
Municipal Code to add underground utility districts 10 and 11, located on

Madonna Road from Higuera to west of Zozobra, and on Higuera from Madonna
to Marsh (continued from 12- 3 -85).
Dave Romero, Public Works Director, reviewed the agenda report with the
recommendation that Council introduce the ordinance establishing the
districts as recommended.
Mayor Dunin declared the public hearing open.
Marshall Ellis, stated he was concerned with the flooding aspect of the
creek in the project area. He would like to see measures taken to
mitigate future flooding prior to any widening. He also questioned the
costs involved to the property owners.
Dave Romero guestimated that it would probably not average more than
$1,000 per lot.
Frank Martend, 207 South Higuera, was also concerned about hook -up costs.
Ed Ruda, 1796 Corralitos, was concerned about district 11 at Walker and
Higuera Streets and questioned which utilities were included.
Dave Romero responded that it was electricity, telephone and cable TV.
Roy Parsons, 236 Higuera Street with San Luis Mill and Lumber, stated that
he was supportive of the proposed cleanup of that area providing that the
costs were manageable, and that he not be required to underground all the
utilities on his entire property.
Mayor Dunin declared the public hearing closed.
Councilwoman Rapp a expressed concern that all the utilities within a
property be placed underground. She was otherwise very supportive of the
widening project.
After discussion, moved by Dovey /Settle (4 -1, Rappa voting no), to
introduce Ordinance No. 1056 (1986 Series) to print establishing
Underground Utility Districts 10 & 11 as recommended.
The budget subcommittee was asked to review the budget policy pertaining
to undergrounding of utilities and review financing alternatives; funding
options for District 12; and options for overhead lines that traverse the
property away from the street (budget review tentatively scheduled for
5/27/86) (5 -0).
5. MADONNA ROAD WIDENING (File #537)
Council considered approving a negative declaration of environmental
impact for Madonna Road widening.
Dave Romero, Public Works Director, briefly reviewed the agenda report
with the recommendation that Council adopt the resolution approving a
negative declaration of environmental impact as recommended.
After brief discussion, it was moved by Dovey /Settle (5 -0), to adopt
Resolution 5909 (1986 Series), approving a negative declaration of
environmental impact for Madonna Road widening with amendment as discussed
by Councilman Griffin regarding the mitigating negative declaration..
' 6. HERITAGE TREES (File #505)
Council considered designating 8 trees proposed as Heritage Trees
(continued from 4- 16 -85).
Dave Romero, Public Works Director, reviewed the agenda report with the
recommendation that Council adopt the resolution approving 8 Heritage
Trees as recommended.
Moved by Davey/Settle (5 -0), Resolution No. 5910 (1986 Series) was adopted
approving Heritage Trees as recommended (5 -0).

C O M M U N I C A T I O N S
C -1 CONSIDERATION OF CONFIRMING 1986 -86 BUDGET REVIEW CALENDAR
Paul Lanspery, Administrative Officer, reviewed the budget schedule;
Council accepted as submitted.
C -2 OCS OIL & GAS LEASING PROGRAM
After discussion, Council requested staff to review the OCS leasing 1
program for 1987 -1991 and submit a draft of comments to be sent to the
Governor's office by March 28 (5 -0).
C -3 Cancellation of February 19th County meeting where presentation was
to be made by the Department of the Interior.
C -4 Staff directed to respond to letter received from the Board of
Realtors concerning Council action taken on Morris & Dee proposal and the
status of blacksmith's permit.
8:40 p.m., there being no further business to come before the City
Council, Mayor Dunin adjourned the meeting to closed session to discuss
personnel and land acquisition.
10:00 p.m. City Council adjourned to Monday, February 24, 1986, at
12:00 noon. /
