COUNCIL HEARING ROOM, CITY HALL, 990 PALM STREET SAN LUIS OBISPO, CALIFORNIA ROLL CALL: Councilmembers .Present: Vice -Mayor GlennaDeane Dovey, Councilmembers Robert Griffin, Penny Rappa, Allen K. Settle and Mayor Ron Dunin Absent:. None City Staff Present: Roger Picquet, City Attorney; Pamela Voges, City Clerk; Bill Hetland; Utilities Manager 1. CAO RECRUITMENT PROCESS Council discussed the preparation of a job profile for the City Administrative Officer recruitment process. Jim Morrison, with Ralph Anderson and Associates, reviewed what he understood to.be the criteria or concerns identified by individual Councilmembers to be used as an assessment for looking at a new CAO. These included: warm, outgoing, personable, leader (without being pushy), work towards acceptable growth in the community (this also includes the issue of water). Must be a Team Management member /player.. Someone who will get the job done and develop the product in a timely fashion. See that the budget is used as a policy tool rather than as a nuts and bolts - supportive of a two -year budget process. Person must have good inter - governmental skills, open communicator, someone who will not create the illusion of establishing policy, an honest straightforward individual. Someone who has a lot of citizen involvement, good analytical skills, a good.sense of redevelopment skills, even though the city is not facing redevelopment at this time. A good sense of humor, someone who is confident and flexible, politically astute. Someone with visionary skills, accessible to the Council, not a "yes" person, but someone who can interpret the Council policy, someone who can say "no" in a positive way. Someone who can "grow ". No agreement reached on how long, or if, a commitment should be made as to the length of tenure. Someone who is willing to be a risk taker, has experience with JPA's, who can reach closure to issues. Someone who can work with management, being accessible to all levels. Should have at least a B. A. in public administration (Masters would be preferred but not required);.experience of over five years, prefer.Western United States (again not a necessity); experience in a growt'i community. Knowledgeable in personnel. With regard to the selection process, the Management Team might have some input, but it should be clear that they would not have anything to say in the final decision. Consensus that there would be three groups of applications. The first group being the best candidates that meet the qualifications, probably 6 -8 persons. Group two, other qualified candidates. Group three, all others. He suggested blocking out a Friday, Saturday or Monday for interviews in the first or second week of February. There was no final agreement on relocation assistance or housing assistance, but it was something that the Council might wish to review later. 5:10 p.m. Mayor Dunin declared a recess. REVIEW OF ORIGINAL PURPOSE AND EVALUATION OF THE IMPACTS OF THE RENT STABILIZATION ORDINANCE B. Council and Board concerns with current process both procedural and policy. Various issues were raised, including review of a fair rate of return, minimizing the amount of time -that the Rent Review Board members have to spend on the appeal process, better clarification of reasons to be provided the Rent Review Board if the Council overturns it's decision. Clarifications to the ordinance to make it clearer, open lines of communication between the Council and advisory body, and developing standards. C. Inhibitors to long -term leases. Council and Board discussed various inhibitors to long -term leases which included: vacancy decontrol, safe harbor concept, fundamental lack of trust, lack of incentives for long -term leases. D. Roger Picquet, City Attorney, reviewed recent court actions: ' 1) Fowler vs. Gould, et al (SLO Municipal. Court - Judge Rear); 2) Fall vs. City of Santa Barbara (Calif. Appellate Court); 3) Pennell vs. City of San Jose; 4) other related cases. 2. NUTS AND BOLTS ISSUES It was general consensus that the Board work with the staff to try to establish one methodology for a fair rate of return which could be incorporated in the Rent. Stabilization Ordinance. Staff directed to prepare recommendations including possible preparation of a moratorium ordinance (of minimum duration) to provide an opportunity for the Board and Council to deal with revisions to the ordinance in an effort to better clarify or add definitions to the ordinance. This could include defining what is a mobilehome vs. an RV unit, amendments regarding just and reasonable rate of return, metering of water, vacancy decontrol, safe A. Council's purpose and intent in enacting Chapter 5.44 in 1982.
