COUNCIL CHAMBER, CITY HALL, 990 PALM STREET SAN LUIS OBISPO, CALIFORNIA ROLL CALL Councilmembers Present: Peg Pinard, Vice -Mayor Penny Rappa, Jerry Reiss and Mayor Ron Dunin Absent: Allen K. Fire Chief --------------------------------------------------------------------- - - - - -- Moved by Rappa /Pinard (4 -0 -1, Settle absent), agreed to an add on item concerning rocket fuel to be discussed at the end of the meeting. Council also accepted a plaque by Leola Rubottom on behalf of the Golden State Mobilehome Owners League, Inc. (G.S.M.O.L.) thanking the Council for their effors concerning rent stabilization regulations'. Mayor Dunin presented a proclamation to them on their behalf. C O N S E N T A G E N D A Moved by Rappa /Pinard (4 -0 -1, Settle absent), to unanimously approve the consent calendar as recommended by the CAD with an additional comment on C -2 as noted. C -1 COUNCIL MINUTES Council approved the minutes of Monday, November 9, 1987 - 5:30 p.m. and Monday, November 16, 1987 - 5:30 p.m. as amended. C -2 FINAL HAP /SUBDIVISION ACCEPTANCE - TRACT 1476 (File :410 -1478) Resolution No. 6369 (1987 Series) adopted approving final map and accepting subdivision improvements for Tract 1478, creating a five -lot subdivision located at 1010 Bishop Street; R -1 -PD zone: P.E.T.R.A., subdivider, as recommended. As requested by Councilwoman Rappa, staff was directed to report back on suggestions for noticing potential property owners of improvements that they might be liable for. C -3 PARKING METERS (File #551) A) Staff authorized to issue purchase order to Duncan Industries for refurbishing 200 meters to cost $17,080; B) staff directed to prepare specifications and advertise for bids for refurbishment of 1100 meters estimated at $95.000; and C) CAO authorized to award bid as recommended. C -4 ELECTION' CANVASS (File 324) Resolution No. 6370 (1987 Series) adopted declaring the results of the General Municipal Election held Tuesday, November.3. 1987, and ordered filed as recommended. (see attached) City Council Minutes Page 2 Tuesday, December 15, 1987 - 7:00 p.m. C -5 CITY /COUNTY LIBRARY (File x573) Quitclaim deeds accepted representing interest in an alley adjacent to the City /County Library as recommended. C -6 EMERGENCY SHELTER GRANT (File #121) Resolution No. 6371 (1987 Series) adopted authorizing grant application to the Department of Housing and Urban Development (HUD) for federai emergency shelter program grant funds ($50.000) on behalf of the Women's Shelter Program as recommended. P U B L I C H E A R I N G S' 1. BUILDING CODE AMENDMENTS (File #402) Council held a public hearing to consider giving final passage to Ordinance No. 1105 adopting the 1985 Uniform Construction Codes and making editorial and minor amendments (continued from 11 -17 -87 and 12- 1 -87). Mayor Dunin declared the public hearing open. Mike Multari, Community Development Director, briefly reviewed the agenda report with the recommendation that Council give final passage to Ordinance No. 1105, adopting the 1985 Uniform Construction Codes as recommended. Mayor Dunin declared the public-hearing closed. Moved by Rappa /Pinard (4 -0 -1, Settle absent), Ordinance No. 1105 (1937 Series) was given final passage adopting the 1985 Uniform Construction Codes and Resolution No. 6372 (1987 Series) adopted justifying and requiring specific amendments to the Uniform Construction Codes as recommended. 2. REZONING - SOUTH STREET (PD 1328) (File #463) Council held a public hearing to consider giving final passage to Ordinance No. 1104, approving a preliminary development plan and rezoning property from service - commercial (C -S) to service - commercial - planned development (C -S -PD) to allow large office uses at 265 -285 South Street; Volny Construction, Inc., applicant (cont. from 12- 1 -87). Mayor Dunin declared the public hearing open. Mike Multari, Community Development Director, reviewed the agenda report with the recommendation that Council give final passage to Ordinance No. 1104, rezoning the properties as recommended. Mayor Dunin declared the public hearing closed. Moved by Rappa /Reiss (4 -0 -1, Councilman Settle absent), Ordinance No...1104 (1987 Series) given final passage as recommended. 3. ZONING REGULATIONS AMENDMENTS (CR 1307) File #463) Council continued its public hearing to consider an ordinance amending the zoning regulations sections #6 (density calculations in multifamily residential zones); #12 (satellite dish antenna): and #17 (general plan amendment regulations); City of San Luis Obispo. applicant (continued from 10 -20 -87 and 11- 17 -87). Mike Multari, Community Development Director, briefly reviewed the agenda report with the recommendation that Council introduce the ordinance to print amending the zoning regulations as amended. Mayor Dunin declared the public hearing open. John French, 3949 Hollyhock, was concerned about the school fee issue and living area definitions with regard to the amendment proposed for density caluculations. City Council Minutes Page 3 Tuesday. December 15. 1987 - 7:00 p.m. He suggested that Council may wish to wait on this item in order to obtain additional information. Mayor Dunin declared the public portion closed on the density issue. Councilwoman Pinard stated she had contacted several real - estate firms, and with the information she received, expressed concerns with the ' proposed density standards. She noted that the density calculations also relate to the size of the building on the lot; the number of parking spaces, and the affordability of the units. She urged that the size of the one and two- bedroom units in the density formula be decreased. After discussion it was moved by Rappa /Pinard (3 -1 -1, Reiss voting not Settle absent), to amend Ordinance No. 1106 (1987 Series). Section 17.16.010 concerning density calculations with the following amendments: One- bedroom dwellings square footage reduced from 850 to 600 square feet. Two- bedroom dwellings square footage reduced from 1300 to 1000 square feet. Council then discussed the general plan regulations section. After discussion it was moved by Rappa /Dunin (4 -0 -1. Settle absent). Ordinance No. 1108 (1987 Series) was introduced to print approving the general plan amendments with minor wording changes as indicated (see file No. 463). ' Council then reviewed the amendment being proposed concerning satellite antenna installations. Mayor Dunin asked for public comment. - Councilwoman Rappa stepped down due to a possible conflict of interest. Richard Carsel, 3375 Sequoia St., spoke in favor of the ordinance. He submitted a petition signed by 61 neighbors and residents of the neighborhood opposing a current request to install a roof- mnunted satellite dish on a home at 3346 Barranca Court. They were opposed to this application as well as the Architectural Control Committee for the subdivision. They urged support of the zoning ordinance changes. They did not feel that the application for a satellite dish in their neighborhood was as significant as for the rest of the city because they had their own CC &R's which gave the Homeowners Association the right to regulate additional restrictions. He was concerned that visibility impacts be minimized. He stated also that the petition was signed by over 90% of the neighborhood. Penny Rappa, speaking as a private citizen, also spoke in support of adopting standards to control satellite dish antennas. She felt there needed to be a review of lot =size and visibility restrictions. She did not feel that satellite dishes should be precluded in rear yard set backs. In proper surroundings, they should be allowed. Mayor Dunin declared the public hearing closed. After considerable discussion, moved by Pinard /Dunin (3 -1 -1, Rappa /Settle absent). Ordinance No. 1107 (1987 Series), was introduced to print ' approving the satellite dish antenna section with wording amendments as discussed. A -1 RAILROAD CARS (File #432) After discussion staff directed to send revised letter to Southern Pacific Railroad asking to have the box cars removed at the San Luis Depot. (4 -0 -1. Settle absent). C O M M U N I C A T I O N S C -1 Upon general consensus. Council requested that staff report back on the types of micro -wave emitters working in the City. City Council Minutes Tuesday, December 15, 1987 - 7:00 p.m. Page 4 C -2 Upon general consensus, staff directed to work with Congressman P --netta's office and others to urge that the City be made a part of the assessment process concerning highways used to transport rocket fuel. C Upon general consensus, Council encouraged that an update status be provided them by the Mobilehome Rent Stabilization Adhoc Committee as to how they are progressing with making revisions to the mobilehome rent regulations. I P U B L I C C O M M E N T P E R I O D Bob Kocotan, representing F.O.R.R. (Friends of Railroads). expressed disappointment at not having been invited to the Intermodal Facilities C—lebration recently held by the City. The CAO was asked to follow -up on their having been left out. There being no further business to come before the City Council, Mayor Dunin adjourned the meeting at 9:10 p.m., to Tuesday.
