1. MOBILEHOME RENT REGULATIONS (File *324)
Council considered placement of rent regulations on the June ballot
(continued from 1- 19 -88).
Pam Voges, City Clerk, upon question, reviewed the calendar for the June
ballot.
John Dunn, City Administrative Officer, briefly reviewed the agenda
report.
Steve Henderson, Assistant to CAO, and Roger PicQuet, City Attorney,
identified various areas of differences between the ad -hoc committee's
report and the proposed initiative as well as other issues and background
regarding the mobilehome rent regulations.
Mayor Dunin asked for public comment.
Bill Welch, 1628 Garnett Dr., a resident of the Laguna Lake Mobilehome
Park, stated that he had attended the ad -hoc committee meetings. He felt
the ad hoc committee -Is ordinance was representative of most of the
mobilehome parks' concern and urged Council's adoption of the ordinance.

Dr Huntington Beach, spoke on behalf of the
mobilehome park owners and of the ordinance suggested by the ad hoc
committee.
Paul Beauvais, a resident of Creekside Mobilehome Park, urged against the
recommendations of the ad -hoc committee and their proposed ordinance.
Morris Levin, a resident of Hacienda Del Pismo, Pismo Beach, suggested a
change in the way the hearings would be held.
Leola Rubottom, 3916 So. Higuera St., requested that Council place the
proposed initiative ordinance on the June ballot. She then read a letter
into the record by Ward Spencer outlining their concerns. She also urged
that Mayor Dunin step down due to a possible conflict of interest as a
resident in the Laguna Lake Mobilehome Park and that several members of
the ad -hoc committee's report were also residents of the same park.
Mayor Dunin stated for the record that two owners of the Creekside
Mobilehome Park had signed the ad hoc committee's letter supporting their
ordinance and that it was his understanding that all of the meetings held
by the ad -hoc committee were open to the public.

Ladd Day, owner in Laguna Lake Mobilehome Estates, stated that it was his
understanding that the group had six months to come up with
recommendations to the ordinance, and that they were not to review the
model lease. He also felt that the initiative might result in a
long -term court process and did not feel that leases were necessarily
good for all the people all the time.
Charlene Hall, spoke-in support of the initiative. She took exception
with park owners and the ad -hoc committee's recommendations.
Patricia Barlow, 544 Princeton, a previous member of the Mobilehome
Review Board, spoke in support of the ad -hoc committee's recommendations
and urged Council's support of the ordinance.
Lisa Luttweiler, a resident.of Creekside Mobilehome Park, stated that it
was her understanding that no one had been noticed about the meetings of
the ad -hoc committee. Had she known of them, she certainly would have
attended.

James Maxwell, member of the Creekside Mobilehome Park, spoke against the
ad -hoc committee's recommendations.
Art Jack, 1836 Carolyn Dr., resident of Laguna Lake Mobilehome Park,
spoke to some of the more technical aspects of the ordinance, re: safe
harbor, vacancy decontrol, and others. He did feel that the ad -hoc
committee had come up with some good compromises.
Dennis Law, Andre, Morris, and Buttery, 1304 Pacific St., reviewed how
the ad -hoc committee reached many of their recommendations and how they
had tried to work together for a workable compromise for both sides.
6:15 p.m., Mayor Dunin declared a recess. At 6:30
p.m., City Council
reconvened, all Councilmembers present.
After brief discussion, it was moved by Settle /Raopa (5 -0), to support
the staff's recommended option #6 to place two pending measures on the
June 7th ballot, specifically: 1) the Mobilehome Ad -Hoc Committee's
recommended amendments to the existing mobilehome rent regulations; and
2) the proposed initiative ordinance establishing new mobilehome rent
regulations urged by Leola Rubottom.
7:05 p.m., Mayor Dunin declared a recess. At 7:40
p.m., City Council
reconvened, all Councilmembers present.
2. WASTEWATER MANAGEMENT PLAN (File #526)
Council considered authorization for staff to negotiate a contract for
the implementation of the Wastewater Management Plan with the firm of
Brown and Caldwell Consulting Engineers (estimated at $1.2 million).
Bill Hetland, Utilities Manager, reviewed the staff report with the
recommended action.
Council held considerable discussion. Finally moved by Settle /Raopa
(4 -1, Councilwoman Pinard voting no), to accept the staffs'
recommendation to negotiate the contract for the implementation of the
Wastewater Management Plan with the firm of Brown and Caldwell Consulting
Engineers as recommended.
C O M M U N I C A T I O N S
C -1 GRAFITTI - OVERPASS (File #532)
Staff directed to write a letter to Southern Pacific requesting removal
of grafitti over the Johnson Avenue railroad overpass.

C -2 ADVISORY BODIES (File #125)
Staff to review terms of office for the Housing Authority. Councilman
Settle requested that staff look at terms of office of the Housing
Authority in that they may not be under the same requirements of the
other advisory bodies because of their different status and structure as
provided under State regulations.
C -3 WATER QUALITY CONTROL BOARD
Moved by Rappa /Settle (5 -0), to direct staff to place the Wastewater
Management Plan on the Water Quality Control Board agenda for their
February 19, 1988, meeting asking them if they would be receptive to
changes regarding wastewater discharge requirements as discussed.
C -4 Council agreed to hold a meeting on Tuesday, February 9, 1988, at
3:30 p.m., rather that 12:15 p.m., to discuss capital projects.
Their being no further business to come before the City Council, Mayor
Dunin adjourned the meeting at 8:45 p.m., to Monday, February 1, 1988, at
12:15 p.m.
