recommended (5 -0).
C -3 STATE BALLOT INITIATIVES (File #324)
Resolution No.'s 6433 and 6434 (1988 Series), adopted supporting two June
State ballot initiatives: Propositions 70 (Wildlife. Coastal and Park
Land Conservation Bond Act); and Proposition 71 (Appropriations Limit
.adjustment) as recommended (5 -0).

C -4 SALVATION ARMY (File #1041)
Moved by Settle /Reiss (5 -0), request from Salvation Army for funds to
continue emergency shelter services through 6/30/88, not to exceed $5,572,
was authorized, and staff was authorized to negotiate with the City
Administrative Officer to execute agreement with Salvation Army as
recommended.

1. APPEAL - MURRAY STREET_ APARTMENT (File *407)
Council held a public hearing to consider an appeal by Douglas Michie of a
decision by the Architectural Review Commission to deny addition of a
3 -unit apartment at 1275 Murray Street; R -3 zone.
Pam Voges, City Clerk, stated that a letter had been received today by Mr.
Michie requesting this item be continued to date uncertain.
Moved by Settle /Rappa (5 -0), this item be continued to date uncertain as
requested.
' 2. AIRCRAFT OPERATION (File *702)
Council held a public hearing to consider an ordinance regulating
helicopter operations within the City limits.
Roger Picguet, City Attorney, reviewed the agenda report.with the
recommendation that Council consider the ordinance and introduce it to
print. The proposed regulations would basically prohibit helicopter and
balloons from landing within the City limits unless previously approved by
the City Administrative Officer. He stated letters had been received from
Jim Wright, Dick Blake and Sierra Vista Hospital urging against the
ordinance.
Mayor Dunin declared the public hearing open.
Charles Long, 145 South St., stated he was not opposed or in favor of the
regulations. His only concern was that pilots not be allowed to fly over
residential areas.
Richard Blake, 2222 Beebee
St., spoke in opposition to the
proposed
regulations. He stated he
was very careful when he flew in
and out of his
pad; that it was obstructed
from public access and view by
a tall fence.
All landings and take -offs
were under the direct radio control
by the
airport tower. He felt the
FAA had sufficient regulations.
He did have a
proposed condition should the
Council decide to support the
ordinance.

Jim Wright, pilot, spoke against the ordinance. He felt the real problem
was noise, not take -offs and landings of helicopter pilots.
Brian Lawler, a licensed balloon pilot, also spoke in opposition.
Burt Forbes, helicopter pilot, spoke in opposition.
John French, 3932 Hollyhock, was concerned with training flights that
hovered within the City limits near his property. He felt they were
violating the FAA regulations and no other restraints'were protecting the
residents from this noise problem.
Clay Knight, stated he was in support of safe operations, but could not
support the proposed regulations.
Mayor Dunin declared the public hearing closed.
After discussion, moved by Settle /Reiss (5 -0), not to support the proposed
ordinance.
Councilman Rappa suggested staff review this as a land use issue.
Mayor Dunin suggested that some review of what constitutes an appropriate
helicopter pad.
9:00 p.m., Mayor Dunin declared a recess. At 9:15 p.m., City Council
reconvened, all Councilmembers present.
3. OPERATIONAL PLAN /DRAFT WATER REGULATIONS EIR (File #517)
A. Council held a public hearing to review the Annual Water Operational
Plan (continued from 8/24/87).
B. Public hearing to receive comments on the draft Environmental Impact
Report for the Draft Water Allocation Regulations continued from 7/21/87
and 8/24/87).
Mike Multari, Community Development Director, briefly introduced the
agenda items. Bill Hetland then gave a report on the first subject with
the recommendation that staff be directed to implement the 1988 -89 Annual
Water Operational Plan recommendations. Those included:
1. Continue to operate the reservoirs to minimize evaporation and
maximize reservoir storage. This would be done by actively using the
Salinas Reservoir, taking into account water quality and system
reliability while relying on Whale Rock Reservoir primarily for
storage. 1

2. Continue development of the groundwater wells within the City for
domestic consumption. This would result in new supplies being on -line
within 9 months to a year. It may be possible to expedite this
effort. Long -term projects like the Salinas Reservoir expausior..and
the coastal stream diversion and storage project were still being
pursued but would not help in the current dry period.
S. Continue the ongoing public education program with an increased
emphasis on the current water situation. Also, to continue the water
waste program and the City's water conservation efforts outlined in
the five year water conservation program.
4. Establish growth control measures in accordance with the proposed
water allocation regulations.
5. Revise the water rate schedule to include an increasing block rate
structure. This would provide an economic incentive for people to
reduce their water consumption and would tend to emphasize irrigation
deductions. This would require staff to bring back a rate ordinance.
6. Implement an alternate day water irrigation schedule. This would
1 result in less water being used for landscape irrigation. The option
would also require an ordinance amendment.
Councilwoman Rapp a suggested a life -line rate. She was anxious to see
this Come back as part of the rate structure.
Councilman Settle agreed.
Mayor Dunin urged that the groundwater study come hack as quickly as
possible.
Councilwoman Pinard stated that although she was supportive of developing
groundwater, she did not feel it should be utilized without a Man for
replenishing it.
Councilwoman Rappa suggested that staff look at turf management in
conjunction with the schools. She was not convinced than. retrofitting was
very efficient. Development of landscaping guidelines and turf management
were important.
Mayor Dunin declared the public hearing open.
Don Smith agreed Council should use a worst case scenario when setting
water allocation regulations.
1 laic Montgomery spoke in support of creating water resources. He suggested
that Council utilize the Chamber of Commerce and developers asking them to
come with suggestions for saving money and retrofitting. He felt the
Chamber would have suggestions pertaining to the economic aspects. He
also felt that groundwater for irrigation in City parks should be
. utilized.

He felt that the City's Community Development Director Mike Multari was an
excellent resource for these kinds of efforts.
Christina Hallbrook, student, asked Council to look at the waste in run
off within the community.
Arnold Voiny stated that many of the issues being raised today were
concerns he had expressed several years ago. He did not feel the City had
acted quickly enough to implement many of the water saving techniques.
Mayor Dunin declared the public hearing closed.
Moved by Settle /Rappa (5 -0), to direct staff to proceed with the 1988 -89
Annual Water Operational Plan recommendations regarding supply and demand
management.
B. Due to the lateness of the hour and upon general consensus,
discussion of the Draft EIR for the draft Water Allocation Regulations was
continued to Tuesday, May 10, 1988.
4. SILVER CITY APPEAL (File #428)
Council continued its consideration of an appeal by Richard Clark, a
tenant representing the Silver City Mobilehome Lodge, of a decision by the
Mobilehome Rent Review Board. The decision would allow rent increases
using the formula Maintenance of Net Operating Income (MNOI) at Silver
City Mobilehome Park located at 3860 S. Higuera (continued from 1/6/87 and
6/16/87).
Steve Henderson, Assistant to the CAO, reviewed the report with a
recommendation that Council deny the appeal and uphold the decision of the
Rent Review Board to allow an $8 per month space rental increase to become
effective immediately.
Mayor Dunin asked for public comment.
Dick Clark, applicant, spoke in support of his appeal.
Dennis Law, representing the Silver City Mobilehome Park owners, (see his
letter dated 1/6/87) spoke in support of the owners position.
Morris Levin, a mobilehome tenant living in Pismo Beach, spoke in support
of the appeal.
James Maxwell, President of Silver City Mobilehome Park, spoke in support
of the appeal.

After discussion, moved by Rappa /Settle (2 -3, Pinard. Reiss and Mayor
Dunin voting no) to uphold the appeal and deny the decision of the Rent
Review Board. Motion failed.
It was then moved by Reiss /Pinard (3 -2, Rappa and Settle voting no) to
deny the appeal and uphold the decision of the Mobilehome Rent Review
Board as recommended.
C O M M U N I C A T I O N S
COMM 1 Upon general consensus Council requested a status of Court Street
development.
There being no further business to come before the City Council. Moor
Dunin adjourned the meeting at 11:00 p.m., uesday, May 10. 1988, at
4:00 p.m.
