COUNCIL HEARING ROOM, CITY HALL, 990 PALM STREET ROLL CALL Councilmembers Present: Vice -Mayor Pinard, Councilmembers Jerry Reiss, Allen K. Settle, and Mayor Ron Dunin Absent: Councilwoman Penny Rappa City Staff Present: John Dunn, Administrative Officer; Pam Voges, City Clerk Dave Romero, Public Works Director; Toby Ross, Assistant to City Administrative Officer; Mike Dolder, Fire Chief; Jim Gardiner, Police Chief; Vicki Finucane, Acting City Attorney CONSENT AGENDA C -1 STATE SENATE RECYCLING BILL (File No. 482) Council considered a resolution endorsing State Senate Bill 1221, to raise redemption values for recyclable beverage containers. Moved by Settle / Pinard (4 -0 -1, Councilwoman Rappa absent), Resolution No. 6616 adopted endorsing passage of Senate Bill 1221 as recommended. BUSINESS ITEMS 1. THURSDAY NIGHT ACTIVITIES (File No. 470) Council considered the Business Improvement Association's Thursday night Rules and Regulations; specifically, the placement of non - profit and informational groups. Dodie Williams, Administrator for the Business Improvement Area, reviewed the agenda report and stated that the BIA had reviewed and raised concerns as to when and where non - profit informational groups could set up their booths. It was the BIA's recommendation that; 1) Council reinstate the five dollar ($5.00) processing fee which would allow greater control over applicants, 2) give the BIA staff direction and authority in the treatment of groups displaying materials deemed objectionable for the norms of the event in the community, 3) allow a specific number of spaces for informational groups on Higuera Street, with the balance on Garden Street - all on a rotating basis, and 4) that additional City Police support for strong enforcement for already established rules and regulations be implemented to augment the BIA staff efforts as necessary for proper control of the activity. Mayor Dunin asked for public comment. 429 City Council Minutes Tuesday, May 23, 1989 - 7:00 p.m. Page 2 Tom Brown suggested an alternative that the groups be allowed to set up at the Mission Plaza with the Recreation Department as being the lead agency. Pete Evans spoke in support of allowing any number of non - profit and informational groups to set up throughout the Higuera and Marsh Street activity. Robert Frost, President of the Democratic Central Committee, was concerned that non - profit groups be allowed to participate. Mark Williams, of Christian Perspective, spoke in support of the non - profit groups being able to locate on the busier streets. Hank Alperts felt it was a 'freedom of speech' that non - profit groups be allowed to set up on Higuera. Peter Jaenkin, Manager of Farmer's Market, supported providing some control over the groups. Sue Shriner spoke in support of the non - profit agencies. Ken Frummelt, member of the BIA, urged support of some control. John Chestnut, 314 Higuera, supported control. Joan Heitz, 1119 Garden Street, urged some type of control. Richard Gransdorf, 160 Grand Avenue, suggested they be allowed to set up on Higuera Street. Lillian Judd, who works with the Democratic Central Club, supported non - profit organizations on the busier streets. Kurt Kupper, 798 Evans Road, supported the non - profit groups. Marge Sorenson, 1710 Alta, spoke in support. Cal Poly student, spoke in support of freedom of speech. 570 Peach Street, volunteer at BIA booth, urged that some controls be afforded the BIA. Robert Hawley, spoke in support of some controls. Maggie Cox, Chamber of Commerce, spoke in support of the BIA's recommendations. John Bushnell, supported the BIA recommendations. ' Mayor Dunin closed the public portion of the meeting. Dodie Williams then again reviewed the recommended actions of the BIA. 430 City Council Minutes Page 3 Tuesday, May 23, 1989 - 4:00 p.m. After discussion by Council, it was moved by Settle / Pinard to adopt recommendations of the BIA, Nos. 1 and 3, to reinstate the $5.00 processing fee, and to allow a specific number of spaces for informational groups on Higuera Street, with the balance on Garden Street, all on a rotating basis. Mayor Dunin urged Kurt Kupper to work with the BIA and the non - profit organizations to work out a solution to their concerns. Mayor Dunin then offered to pay for three non - profit organizations per month, if they were unable to afford the reinstated processing fee. Councilman Settle stated he would match Mayor Dunin's offer. COMMUNICATIONS Comm 1. Councilman Settle, a member of the League of California Cities Nominating Committee, asked if anyone was interested in being nominated to the League of California Cities Board. 5:45 p.m., there being no further business to come before the City Council, Mayor Dunin adjourned the meeting to Wednesday, May 24, 1989, at 11:30 a.m., in the Community Conference Room at the )ell-by-County Library.
