After discussion, moved by Reiss /Dunin (5 -0) to continue this item and
directed staff to work with the property owner and the representatives
from the "Citizens to Protect the Biddle House" to work out a mutually
acceptable and economically feasible resolution to the issue. Motion
carried unanimously.
8. CREEK SETBACK (File No. 597)
Council considered a determination regarding a San Luis Creek setback and
easement for a new office building at 444 Higuera Street, Smith - Lorance,
applicant (continued from April 18, 1989).
Dave Romero, Public Works Director, reviewed the agenda report with the
recommendation that Council uphold the staff's determination of the
required development (creek) setback and easement at 444 Higuera Street.
Mayor Dunin asked for public comment.
Barry Williams urged against the requirement.
Pat Smith, applicant, urged against the requirement.
After discussion, moved by Rappa /Settle (4 -1, Mayor Dunin voting no) staff
determination was upheld to require the development setback and easement
as required.
9. COLD CANYON LANDFILL SITE EXPANSION (File No. 142)
After brief discussion and upon general consensus, the Council (5 -0)
received and filed the initial study of the Cold Canyon Sanitary Landfill
site expansion and Solid Waste Commission's recommendations to the County
Board of Supervisors.
There being no further business to come before the City Council, Mayor
Dunin adjourned the meeting at 12:00 P.m. midnight, to Wednesday, June 7,
1989, at 3:00 p.m., in the City /County Library Community Room for a joint
meeting with the Board of Supervisors. ( /
