City Attorney Lowell announced the following Closed Session topic:

City Attorney Lowell reported that the Closed Session was held and Council provided
direction to its property negotiators. No reportable action was taken.
PRESENTATIONS
Cathy Creswell, Deputy Director of State Housing & Community Development (HCD),
presented the City with a Local Government Achievement Award in recognition for
achieving its Housing Element certification, pledged HCD's support in making the
implementation of the Housing Element a reality, and responded to questions raised by
Council Member Settle.
Fire Chief Knabe presented Community Emergency Response Team (CERT) Program

Awards to Rik Grencik, Cindy Sutliff, Lynn Wilwand and Viv Dilts.
PUBLIC COMMENT ...
Gary Fowler, San Luis Obispo, explained why he thinks the ad in today's paper related to
Mardi Gras activities is misleading and should be amended before it is printed again.
Sifu Kelvin Harrison, San Luis Obispo, discussed his continuing concerns related to
harrassment.
CONSENT AGENDA
Mayor Romero announced that a continuation has been requested from the Attorney for R.W.
Hertel & Sons, Inc. related to Item C4 (Final Acceptance of Public Improvements for Tract
2401).
Council Member Mulholland, Vice Mayor Ewan and Mayor Romero concurred to grant the
continuation to enable the developer to continue to work with the Rancho Obispo
Homeowners Associaton to resolve issues at the development.
Council Member Settle abstained from discussion on this matter because he owns property
within the vicinity of the subdivision.
ACTION: Moved by Ewan/Settle to approve the Consent Agenda, with the exception of
item C4, as recommended by the City Administrative Officer; motion carried 4:0:1
(Council Member Brown absent).
C1. APPROVE MINUTES OF TUESDAY, JANUARY 4, 2005, REGULAR MEETING.
ACTION: Moved by Ewan/Settle to waive oral reading and approve as presented;
motion carried 4:0:1 (Council Member Brown absent).
C2. APPROVAL OF MILLS ACT CONTRACT FOR THE HISTORIC MICHAEL RIGHETTI

ACTION: Moved by Ewan /Settle to adopt Resolution No. 9644 (2005 Series)
approving a Mills Act contract for the historic Michael Righetti House, located at
1314 Palm Street; motion carried 4:0:1 (Council Member Brown absent).
ACTION: Moved by Ewan/Settle to adopt Resolution No. 9645 (2005 Series) adding
1429 Osos Street to the Master List of Historical Resources; motion carried 4:0:1
(Council Member Brown absent).
ACTION: Consensus to grant continuation of this item to enable the developer to
continue to work with the Rancho Obispo Homeowners Associaton to resolve issues
at the development; 3:1:1 (Council Member Settle abstained; Council Member Brown
absent).

C5. MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND
THE SAN LUIS OBISPO CITY EMPLOYEES' ASSOCIATION FOR THE PERIOD OF
01/01/05-12/31/05.
ACTION: Moved by Ewan /Settle to adopt Resolution No. 9646 (2005 Series)
approving the Memorandum of Agreement for a one -year contract; motion carried
4:0:1 (Council Member Brown absent).
C6. PURCHASE OF 1049 ORCUTT ROAD.
ACTION: Moved by Ewan /Settle to 1. Authorize the purchase of property located at
1049 Orcutt Road for $550,000. 2. Transfer $224,000 from the construction phase of
this project and appropriate an additional $91,000 in transportation impact fees for
acquisition of this property. 3. Authorize the Mayor to sign final purchase
documents and the deed; motion carried 4:0:1 (Council Member Brown absent).
PRESENTATION
Police Captain Blanke and Lieutenant Tolley reviewed lessons learned from Mardi Gras
2004 and provided Council with an overview of the 2005 operation.
Mayor Romero called for comments from the public at this time.
Gary Fowler. San Luis Obispo, suggested that the language on "The Party Is Over" poster
should be used in the newspaper publication and raised several questions and concerns
' related to the failure to reference involvement of the student community, the possibility of
alcohol being available before people arrive in the City, and how the Police will respond to
events held on private property.
Andrew Carter, San Luis Obispo, commended the Police Department as well as other
communities and agencies assisting the City with the 2005 operation.
Following a brief Council discussion, staff agreed to take back to the Mardi Gras outreach
committee the possibility of distributing poster materials to businesses selling alcohol
outside of the City.
COUNCIL LIAISON REPORTS
Council Member Mulholland reported on the January meeting of the County's Water
Resources Advisory Committee.
Mayor Romero reported on the January 13"' Performing Arts Center Commission (PAC)
meeting. He also reported on his attendance at a Downtown Association meeting which he
attended on behalf of Vice Mayor Ewan.
Council Member Settle asked staff to investigate the relocated palm trees in the vicinity of
Fire Station 4.
CAO Hampian indicated that staff is researching this matter and will provide Council with a
status report.

There being no further business to come before the City Council, Mayor Romero adjourned
the meeting at 8:20 p.m. to Saturday, January 29, 2005 at 8:30 a.m. at the Library Community
Room, 995 Palm Street, San Luis Obispo.
