(2) The word "incumbent" if the candidate is a candidate for the same office which he or she holds at the time of filing the nomination papers, and was elected to that office by a vote of the people, or, in the case of a superior court judge, was appointed to that office. (3) No more than three words designating either the current principal professions, vocations, or occupations of the candidate, or the principal professions, vocations, or occupations of the candidate during the calendar year immediately preceding the filing of nomination documents. For purposes of this section, all California geographical names shall be considered to be one word. Hyphenated words that appear in any generally available standard reference dictionary, published in the ignited States at any time within the 10 calendar years immediately preceding the election for which the words are counted, shall be considered as one word. Each part of all other hyphenated words shall be counted as a separate word. (4) The phrase "appointed incumbent " if the candidate holds an office other than a judicial office by virtue of appointment, and the candidate is a candidate for election to the same office, or, if the candidate is a candidate for election to the saute office or to some other office, the word "appointed" and the title of the office. In either instance, the candidate may not use the unmodified word "incumbent" or any words designating the office unmodified by the word "appointed," However, the phrase " "a pointed incumbent" shall not be required of a candidate who seeks reelection to an office which he or she holds and to which he or s le was appointed, as a nominated candidate, in lieu of an election, pursuant to Sections 5326 and 5328 of the Education Code or Section 7228, 7423, 7673, 10229, or 10515 of this code. (b) Neither the Secretary of State nor any other election official shall accept a designation of which any of the following would be true: (1) It would mislead the voter. (2) It would suggest an evaluation of a candidate, such as outstanding, leading, expert, virtuous, or eminent. (3) It abbreviates the word "retired" or places it following any word or words which it modifies. (4) It uses a word or prefix, such as "former " or 'ex -," which means a prior status. The only exception is the use of the word "retired." (5) It uses the name of any political party, whether or not it has qualified for the ballot. (6) It uses a word or words referring to a racial, religious, or ethnic group. (7) It refers to any activity prohibited by law. (c) If, upon checking the nomination documents and the hallot designation worksheet described in Section 1310 7.3, the election official finds the designation to be in violation of any of the restrictions set forth in this section, the elections official shall notify the candidate by registered or certified mail return receipt requested, addressed to the mailing address provided on the candidate's ballot designation worksheet. (1) The candidate shall, within three days, excluding Saturday, Sunday, and state holidays, from the date he or she receives notice by registered or certified mail, or from the date the candidate receives actual notice of the violation, whichever occurs first, appear before the elections official or, in the case of the Secretary of State, notify the Secretary of State by telephone, and provide a designation that complies with subdivision (a). (e) The designation shall remain the same for all purposes of both primary and general elections, unless the candidate, at least 98 days prior to the general election, requests in writing a different designation which the candidate is entitled to use at the time of the request. (f) In all cases, words so used shall be printed in 8 -point roman uppercase and lowercase type except that, if the designation selected is so long that it would conflict with the spare requirements of Sections 13207 and 13211, the elections official shall use a type size for the designation for each candidate for that office sufficiently smaller to meet these requirements. (g) Whenever a foreign language translation of a candidate's designation is required under the Voting Fights Act of 1965 (42 U.S.C. We believe that your position as a Planning Commissioner would be more correctly defined as a "vocation" than as an occupation. If you believe that you can indicate on your ballot designation worksheet that you spend a substantial amount of time and effort performing your duties as Commissioner, this designation would be acceptable to me. While it is unlikely that it would happen, you should be aware that ballot designations are subject to challenge. Regarding your Nomination Paper, if it does not contain the adequate number of signatures, in accordance with the Elections Code, I would provide you with a copy showing which ones are not valid and would issue you a second Nomination Paper. You could then circulate that, complete and return it in the same manner you did your first one. You could collect up to 30 signatures_ You would not want to have the same folks sign the second form. I would only check the number I needed from the first paper. Does this help? His two issues regarding salary related to his retirement allowance from PERS as a result of his retiring from Cal Poly. He first wanted to know if being a Council Member would be considered a temporary position and /or less than 960 hours per year (the maximum he can work as a retiree). I told him that elected officials had the option of whether or not to be enrolled in the retirement system, so the 960 -hour rule didn't apply. For example, the Mayor continues to receive his PERS retirement allowance. His second question about waiving partial salary is that he has an earnings limit because he's on a disability retirement. I told him that as long as the City Attorney was OK with it and Payroll could accommodate it, that there were no HR issues that would prevent him from taking a partial salary. We didn't specifically talk about the cafeteria contribution. I would need additional information from him as to the earnings limit to see if the cafeteria contribution would count toward that limit, since he would only be getting enough to cover his insurance premiums. Since he retired from Cal Poly, he would most likely stay with their medical insurance (since they pay 100% for retirees) and we would only be talking about dental, vision and life insurance premiums. He said he would call me if he had any additional benefit questions. Audrey From: Irons, Monica Sent: Friday, March 28, 2008 9:09 AM To: Hooper, Audrey Cc: Jenny, Karen Subject: RE: Council Salaries Hi Audrey — I'm copying Karen on this. She is out of the office until Monday but I'll ask her to follow up with you and Dan when she returns. My sense is that it would be possible for a council member to waive the salary, but I assume we report the insurance as compensation although as a council member he is not eligible for a cash back option so I don't know how that affects things. Karen will you let us know your thoughts on this? 4/2/2008 Page 2 of, p From: Hooper, Audrey Sent: Thursday, March 27, 2008 3:36 PM To: Irons, Monica Subject: Council Salaries Monica, Dan Carpenter is on our Planning Commission. He is a potential Council candidate who raised an earlier question regarding his salary (see Debbie's response, below). Dan s now asking whether or not the City is able to pay him a portion of his salary (as opposed to the full Council salary). (Jonathan said he didn't think it would be a problem for Dan to waive his entire salary - I didn't ask him about a partial salary, but I'm copying him on this e- mail.) Dan also has questions related to whether the benefits he would receive are equivalent to and /or reported as salary. (I may not have worded this exactly correctly.) Debbie thinks Dan's current questions should be answered by Human Resources. Would you or your designee be willing to call Dan and answer his questions to the degree possible? His office number is his home number is I have also strongly suggested he talk to PERS (from which he retired) and his tax person. Thanks, Audrey (PS - I'll be curious to know if what he is requesting is possible. I'm not sure how that will impact his desire to run for office.) From: Malicoat, Debbie Sent: Wednesday, March 19, 2008 7:05 AM To: Hooper, Audrey Subject: RE: Council Salaries Audrey, In my time here (which is only 8 years) we haven't had anyone do this. That doesn't mean it couldn't be done. The payroll system is capable of not paying a salary and only paying the cafeteria contribution. But you should definitely talk to Jonathan about it. Debbie From: Hooper, Audrey Sent: Tuesday, March 18, 2008 5:17 PM To: Malicoat, Debbie Subject: Council Salaries Debbie, A potential candidate asked me whether it would be possible for him to be elected to office and decline the salary that goes with the position of Council Member. If elected, he would like to receive the other benefits (health, life, etc.). Before I talk to Jonathan about this matter, can you tell me if there is a process whereby the City could orchestrate this ? ?? Thanks, 4/2/2008
