Subject: Cost for Printing of Candidates' Statements
I have received the charges from the Registrar of Voters for the costs of candidates statements. Each of you will be
receiving a refund. There is an error in these charges and so I will not provide you with the exact amount until I receive
clarification from the Registrar of Voters.
The amount will vary a bit.
If you requested an English only printing, you will be receiving approximately $180 - $200.
If you requested a Spanish translation as well, you will be receiving approximately $340.
please_let.me know as soon as possible how you want your checks made payable i.e. tyou personally or to a
campaign bank account).
If I hear from you by the first of next week and can process your refund before Wednesday, the checks should be in the
mail on December 31 St.
12/22/2008
I will be sending you an e-mail letting you know the exact amount you will be receiving as soon as I receive the correction
from the Registrar of Voters.
I will also be advising you of your next/last filing requirement sometime next week if you haven't filed your termination
statement by that time.
For those of you who were unsuccessful candidates and still have campaign bank accounts open, please do not forget
that you must dispose of surplus funds by December 31St. I'll cover that further in my e-mail.

Subject: Amendments to Your Form 460
Jan,
It was brought to our attention that the Summary Page of your form appears to contain an error that requires an
amendment. As a result, I took several more minutes to review your entire form and found the following:
Line 16 - There seems to be a discrepancy in your ending cash balance in Column A. I believe this may have been
caused by carrying line 1 down to line 13, when line 3 should have been carried down.
Because you filed a Form 460 previously, Column B should also have been completed.
Line 19 will also need to be completed as it appears you have outstanding debts.
You may want to submit this amendment to coincide with the amendment providing street addresses in place of post
office boxes. You may also want to re- review your entire form before you complete the amendments in case we still
missed something.
I would recommend doing this sooner than later, however, as we will undoubtedly continue to receive requests to review
all of the forms. However, there are no deadlines and no penalties for filing amendments.
Jan, as you know, we do a cursory review of these forms and don't take time to look at all of the lines or double -check
figures. Had I pulled your file, I would have realized that Column B should have been completed, so I apologize for
overlooking that. I'm not sure I would have looked for the other items.
You should only submit the cover sheet and the pages requiring amendments when you turn this into us.
Both you and Dominic will need to sign the amendment cover sheet.
I regret the inconvenience making this amendment may cause you and Dominic. It's a learning process for all of us.
Let me know if you have questions.
Thanks,
Audrey

Thanks Audrey. I will scour my email lists to make sure the slocity.org addresses are not sent info from my

forward this email from you to me, so that he gets the picture.
Appreciate your guidance in all this,

CAO Ken Hampian has requested that I respond to your email in which you question whether there are regulations that
prohibit you from sending emails to friends and allies.
Please know that the City has no interest in or intention of interfering with your desire to send emails to any of your friends
and allies when those e-mails do not inadvertently violate state law or City policy. However, the following information
regarding State law and City policy may provide you with additional information regarding the City's concerns.
State law (particularly Government Code sections 3201 -3207) prohibits solicitations of City employees for campaign
contributions (except when that solicitation is made to a significant segment of the public via mass mailers that goes out to
all registered voters in the City).
The City's Code of Ethics, section 2.36.380(G) of the City's Municipal Code, supports the prohibitions established by State
law: "The political activities of city employees shall conform to pertinent provisions of state and federal law.
In addition, the City's Electronic Mail Policy stipulates that "The City's email system exists solely for the purpose of
conducting City business, and is not intended for personal use." The policy further prohibits the use of email to advertise
or promote political causes.
Staff is notified during each election period of these regulations. In addition, these regulations will also be called to the
attention of our candidates during the upcoming Candidates Orientation with CAO Hampian and Department Heads.
I'm not sure if you're aware that City e-mail has the same email extension (.slocity.org). This may provide you with a tool
for deleting employee e-mails from your address lists or responses.
I hope this information is of assistance to you. Please let me know if you have additional questions regarding this matter

Hi Audrey,
It occurred to me that city employees who have listed their city email addresses with Bob Banner would be
getting his emails at work. Many of them are of a political nature. Perhaps the city would want to request
employees take their city email addresses off any list serves and substitute their personal email addresses.
Thanks,
Jan

Hi, Jan,
received your earlier e-mail and am glad that you are planning to attend the Orientation next week.
I thought it might be a good idea to forward to you Ken's e-mail to Bob Banner. It may be that there are other folks
involved with your campaign who may inadvertently do what Bob did if they're not aware of our regulations. You may
want to pass this message along to them as well.
Let me know if you have questions and thanks for giving this your attention.

Bob, Jan inadvertently included City employees on a campaign email yesterday. This one has
found its way into City Hall, too. I am sure you want to avoid this, given the campaign regulations
against it, and so I am calling this to your attention so that you can remove me and other city

OCCUPATION: Former San Luis Obispo City Council Member, Businesswoman, Attorney and

I'm a 20 -year resident, married, with two children and four grandchildren. A graduate of Stanford
and Santa Clara Law School, I served on Council 1998 -2002 and earlier on the Planning
Commission. I've been a leader in environmental, neighborhood, anti- domestic violence and
humanitarian volunteer organizations. I have owned my business since 1993. I will gladly put
my experience, business savvy and land use expertise to work for San Luis Obispo.
Many residents are concerned that our precious natural, historical and financial resources have
been diminished by Council decisions and fear losing our unique small town atmosphere.
Outdated "pave and sprawl" policies increase climate disruption, and also turn San Luis Obispo
into "anyplace USA." Through listening to residents, implementing environmentally responsible
policies and requiring fiscal accountability, I will help turn San Luis Obispo around.
My priorities include encouraging economic vitality and a strong downtown, protecting our
hillsides, neighborhoods and city parks, building a new senior center, making San Luis Obispo
more bike and pedestrian friendly, improving public safety, transportation and streets, and
consulting with residents to plan a healthy community through the Land Use and Circulation
Element Update.
I will be your voice on Council. Let's work together towards a sustainable, prosperous future.

CODE OF FAIR CAMPAIGN PRACTICES
There are basic principles of decency, honesty, and fair play which every candidate for
public office in the State of California has a moral obligation to observe and uphold in order that,
after vigorously contested but fairly conducted campaigns, our citizens may exercise their
constitutional right to a free and untrammeled choice and the will of the people may be fully and
clearly expressed on the issues.
THEREFORE:
(1) 1 SHALL CONDUCT my campaign openly and publicly, discussing the issues as I
see them, presenting my record and policies with sincerity and frankness, and criticizing without
fear or favor the record and policies of my opponents or political parties that merit this criticism.
(2) 1 SHALL NOT USE OR PERMIT the use of character defamation, whispering
campaigns, libel, slander, or scurrilous attacks on any candidate or his or her personal or family life.
(3) 1 SHALL NOT USE OR PERMIT any appeal to negative prejudice based on a
candidate's actual or perceived race, religious creed, color, national origin, ancestry, physical
disability, mental disability, medical condition, marital status, age, sexual orientation, sex, including
gender identity, or any other characteristic set forth in Section 12940 of the Government Code, or
association with another person who has any of the actual or perceived characteristics set forth in
Section 12940 of the Government Code.
(4) 1 SHALL NOT USE OR PERMIT any dishonest or unethical practice that tends to
corrupt or undermine our American system of free elections, or that hampers or prevents the full
and free expression of the will of the voters including acts intended to hinder or prevent any eligible
person from registering to vote, enrolling to vote, or voting.
(5) 1 SHALL NOT coerce election help or campaign contributions for myself or for any
other candidate from my employees.
(6) 1 SHALL IMMEDIATELY AND PUBLICLY REPUDIATE support deriving from any
individual or group that resorts, on behalf of my candidacy or in opposition to that of my opponent,
to the methods and tactics that I condemn. I shall accept responsibility to take firm action against
any subordinate who violates any provision of this code or the laws governing elections.
(7) 1 SHALL DEFEND AND UPHOLD the right of every qualified American voter to full
and equal participation in the electoral process.
I, the undersigned, candidate for election to public office in the State of California or
treasurer or chairperson of a committee making any independent expenditures, hereby voluntarily
endorse, subscribe to, and solemnly pledge myself to conduct my campaign in accordance with the
above principles and practices.

CODE OF FAIR CAMPAIGN PRACTICES
(Division 20, Chapter 5, Elections Code.)
Chapter 5. Fair Campaign Practices
Article 1. General Intent
20400. The Legislature hereby declares that the purpose of this chapter is to encourage every
candidate for public office in this state to subscribe to the Code of Fair Campaign Practices.
It is the ultimate intent of the Legislature that every candidate for public office in this state
who subscribes to the Code of Fair Campaign Practices will follow the basic principles of decency,
honesty, and fair play in order that, after vigorously contested, but fairly conducted campaigns, the
citizens of this state may exercise their constitutional right to vote, free from dishonest and unethical
practices which tend to prevent the full and free expression of the will of the voters.
The purpose in creating the Code of Fair Campaign Practices is to give voters guidelines
in determining fair play and to encourage candidates to discuss issues instead of untruths or
distortions.
Article 2. Definitions
20420. As used in this Chapter, "Code" means the Code of Fair Campaign Practices.
Article 3. Code of Fair Campaign Practices
20440. At the time an individual is issued his or her declaration of candidacy, nomination papers, or
any other paper evidencing an intention to be a candidate for public office, the elections official shall
give the individual a blank form of the code and a copy of this chapter. The elections official shall
inform each candidate for public office that subscription to the code is voluntary.
In the case of a committee making an independent expenditure, as defined in Section
82031 of the Government Code, the Secretary of State shall provide a blank form and a copy of this
chapter to the individual filing, in accordance with Title 9 (commencing with § 81000) of the
Government Code, an initial campaign statement on behalf of the committee.
The text of the Code shall read, as follows: (See "CODE OF FAIR CAMPAIGN
PRACTICES" on reverse side).
20442. The elections official shall accept, at all times prior to the election, all completed forms
which are properly subscribed to by a candidate for public office and shall retain them for public
inspection until 30 days after the election.
20443. Every code subscribed to by a candidate for public office pursuant to this chapter is a
public record open for public inspection.
20444. In no event shall a candidate for public office be required to subscribe to or endorse the
code.

No, this is not correct. The form 460 is always filed with my office - an original and one copy. The form 410 is always filed
with the State - an original and one copy - and one copy is provided to me. Jan is current on the form 410.
Jan only needs to file the Form 460 at this time if she has received or spent $1,000 or more for this election.
I hope this helps. Let me know if you have additional questions.
Thanks,
Audrey

Jan,
know the forms are confusing, but the form 410 is the only form that goes directly to the State. We ask candidates to
provide us with a copy.
Because that was not clear to you, I'll keep one copy here and will send your original to the State from this office. When
you file your termination 410 or any future amendments, I'll just remind you.

Jan,
I am confirming that the number written on the top of your Form 410, which we faxed to you, is your Committee ID
number. It is 1307742. This is how these forms are returned to us from the Secretary of State's Office.

Hi Audrey,
I have not been able to ascertain whether the number written at the top of the 410 form you faxed me is indeed
my ID number for the campaign. When I get that straightened out, I will go to the First Bank on Higuera and
open a new account with the ID number, as per their requirements. I also will file an amended 410 with the new
bank acct number.
At that point, may I start collecting money, even though I have not yet taken out official papers?
Thanks for the clarification,
Jan
