THEREFORE: (1) 1 SHALL CONDUCT my campaign openly and publicly, discussing the issues as I see them, presenting my record and policies with sincerity and frankness, and criticizing without fear or favor the record and policies of my opponents or political parties that merit this criticism. (2) 1 SHALL NOT USE OR PERMIT the use of character defamation, whispering campaigns, libel, slander, or scurrilous attacks on any candidate or his or her personal or family life. (3) 1 SHALL NOT USE OR PERMIT any appeal to negative prejudice based on a candidate's actual or perceived race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, age, sexual orientation, sex, including gender identity, or any other characteristic set forth in Section 12940 of the Government Code, or association with another person who has any of the actual or perceived characteristics set forth in Section 12940 of the Government Code. (4) 1 SHALL NOT USE OR PERMIT any dishonest or unethical practice that tends to corrupt or undermine our American system of free elections, or that hampers or prevents the full and free expression of the will of the voters including acts intended to hinder or prevent any eligible person from registering to vote, enrolling to vote, or voting. (5) 1 SHALL NOT coerce election help or campaign contributions for myself or for any other candidate from my employees. (6) 1 SHALL IMMEDIATELY AND PUBLICLY REPUDIATE support deriving from any individual or group that resorts, on behalf of my candidacy or in opposition to that of my opponent, to the methods and tactics that I condemn. I shall accept responsibility to take firm action against any subordinate who violates any provision of this code or the laws governing elections. (7) 1 SHALL DEFEND AND UPHOLD the right of every qualified American voter to full and equal participation in the electoral process. Ken Hampian CAO, City of San Luis Obispo 990 Palm Street San Luis Obispo, CA 93401 Ken, __/70 -Q EZ September 16, 2008 Terry Mohan San Luis Obispo, CA 93401 As a candidate for city council two years ago I became familiar with the difficulty of getting yourself and your view out to the general public. Now that I am running for mayor I am attempting to not only get exposure for myself but also for the other candidates who do not have platforms in city government to express their opinions. When inquiring about using the city council chambers for public televised forums involving all of the candidate for our city government I was told that I, as a candidate, could not organize such an event that I would have to find a non - profit organization to set it up. I have contacted over a half dozen non - profit organizations and then went on to the major media outlets in the city. I have not been able to find one organization that feels it is worth their time to introduce the candidates who are opting to run this city for the next four years. So it has fallen back onto my lap. Pursuant to Chapter 1.1.5 of the Council Policies and Procedures the CAO has the exclusive authority to grant the use city council chamber and set up calendar dates. In 1.1.5, Part f. it states that providing all candidate are invited the chamber may be used for a Candidate Forum, without any stipulation of who needs to organize it. Pe This is an official request to allow me to set up a meeting with all of the candidates for city office who would like to participate in such a forum to chose the date(s) for the forum and choose moderators to compile and ask questions. I would request that you give us a list of dates at night prior to the election so that the public and all of the candidates would be available. I would like to request we be allowed to hold at least one and possibly two forums in the chambers before election day. I would also request of the council to forgo any charges to the candidates as this would be considered a public service and since the chambers already belong to the citizens the only other charge would be the operation of the video equipment. I would ask the council to agendise an item to allot the $400 to $600 per forum for this service as it is pittance compared to the benefits it gives to the voters to determine the best candidates. Page 1 of 1 Terry, As I mentioned to you when we last talked, I wanted to research your request and you agreed I could get back to you no later than this Friday or Monday. At any rate, when I saw your e-mail, I expedited my research. I hope the following information is helpful to you. The City may allow the use of the Council Chamber for a candidates' forum, but it may not be organized by a candidate. You may not, therefore, take the lead in requesting the use of the City's facility for this purpose. Such a forum must be organized, as well as moderated, by a neutral organization with a non - profit status (such as the League of Women Voters). The request should be submitted in writing to me from a responsible party of the neutral, non - profit organization. Please feel free to give provide my contact information to any such organization that may want to organize a candidate's forum. I will be happy to answer their questions directly and work with them on this matter. Audrey From: Terry Mohan [mailto:catsdad @sbcglobal.net] Sent: Tuesday, August 19, 2008 2:54 PM To: Hooper, Audrey Cc: Cano, Elaina Subject: Candidate Forums Audrey, I sent this email to Sandra Duerr at the Tribune and Evan Pappas at KSBY along with all the other candidates save Arnold Ruiz, I didn't have his email address. I didn't intend to make more work for you nor have them contacting you for information. Feel free to refer anyone to me in that event. But with only two months until the election I hope to get these forums organized ASAP. Thank you for your assistance in this matter. Have a great day, Terry Mohan Sandra & Evan, I am attempting to set sip a couple candidate forums that could be televised either on public access or through the set up at city hall on channel 21. In the latter case I would hope to use the council chambers. The city clerk hoped to have some information about that passibility when I return from vacation on Monday, August 25. She wasn't sure if candidates could organize these forums or if they had to be sponsored by outside groups. I am curious if the Tribune or KSBY would be willing to sponsor such events? The League of Women Voters said while they do not have the staff to set up all the forums they get requests for, however they would be happy to moderate one if that would help. While I appreciate specialty groups having forums for their members I would like to see events that would attract more of the general public and give them the opportunity for greater participation. It would also increase the public exposure of newer candidates and their positions on the issues. For one I am unable to attend most forums held during normal business hours and would like to schedule these televised forums at night or on the weekend. If you have any further suggestions or ideas please add them to the discussion. 1/5/2009 Page 1 of 1 Hooper, Audrey From: Terry Mohan [catsdad @sbcglobal.net] Sent: Friday, August 15, 2008 6:43 AM To: Hooper, Audrey Subject: Candidate Statement in Spanish Audrey, I'm sorry I forgot to check the box requesting my candidates statement to be printed also in Spanish.
