HomeMy WebLinkAbout0001ORDINANCE NO. 1 (1955 Series) AN ORDINANCE PROVIDING FOR THE ACQUISITION OF CERTAIN REAL PROPERTY BY THE CITY OF SAN LUIS OBISPO. BE IT ORDAINED BY the Council of the City of San Luis Obispo: SECTION I. That the public interest and necessity requires that those certain parcels of real property hereinafter described be acquired and pur- chased by the City of San Luis Obispo from the respective owners, as herein- after set forth. SECTION-2. That the Administrative Officer of the City of San Luis Obispo is hereby authorized to purchase all of that certain real property hereinafter described as Parcels 1 to 6 inclusive for, on and in behalf of said City of San Luis Obispo, from Camrose Gjurovich as guardian of the per- son and Estate of Maggie A. Carby Brown, an incompetent person, as to parcels 1 and 2 for the sum of Thirty -five thousand dollars ($35,000.00)., from Fred H. Johnson and Florence G. Johnson, his wife, as to parcel 3 for the sum of Four thousand forty -three dollars (4,043.00), from E. Taylor Smith as to parcel 4 for the sum of One thousand six hundred dollars ($1,600.00), from Benj. F. Loveall and Marguerite F. Loveall, husband and wife, as to parcel 5 for the sum of Twelve thousand dollars ($12,000.00) and from Wanda Kamm Wright as to an undivided one -half interest, and Leslie W. Kamm as to an undivided one -half interest in and to parcel 6 for the sum of Six thousand dollars ($6,000.00). SECTION 3. Said parcels of real property situated in the City of San Luis Obispo, County of San Luis Obispo, State of California, are described as follows: PARCEL 1: All of Lot 4 and those portions of Lots 3 and 5 in Block 86 of the Lands of A. Murray in the City of San Luis Obispo, ac- cording to the map thereof filed for record May 1, 1876 in book A page 115 of Maps in the office of the county recorder of said county; and those portions of Lots 8, 91 10 and 11 in Block 86 of the Mission Vineyard Tract in the City of San Luis Obispo, ac- cording to the map thereof filed for record March 8, 1873 in book A page 143 of Maps in the office of the county recorder of said county, described as a whole as follows: Beginning at a point on the easterly line of Broad Street which is distant South 360 53' East 14.05 feet from the corner common to Lots 2 and-,3 in Block 86 of the Lands of A. Murray; thence North 530 ,r 2 k 4 07' East parallel with the south line of Higuera Street 109.35 feet; thence at right angles North 360 53' West 14.75 feet to the southwest corner of the land described in the deed to Wallace Everson recorded January 28, 1884 in book R page 519 of Deeds; thence at right angles North 530 07' East along the south line of the land described in the deed to Wallace Everson and along the south line of the land described in the deed to Remick and Orr recorded April 5, 1884 in book S page 69 of Deeds, 72.29 feet to the southeast corner of the land described in the deed to Remick and Orr; thence at right angles South 360 53' East 60.7 feet to the most southerly corner of the land described in the deed to P. B. Prefumo recorded August 27, 1885 in book T page'578 of Deeds; thence at right angles North 530 071 East along the southerly line of the land described in the deed to P. B. Prefumo, 4.91 feet to the most westerly corner of the land described in the deed to H. M. Osgood et al recorded April 30, 1875 in book G page 285 of Deeds; thence at right angles South 360 53' East along the westerly line of the land described in the deed to H. M. Osgood et al and its southeasterly extension, 41.7 feet to a point on the north line of the second parcel of land described in the deed to Emma Krebs recorded February 17, 1888 in book Z page 393 of Deeds; thence at right angles South 530 07' West along the northerly line of the land described in the deed to Emma Krebs, 40.03 feet to the most westerly corner thereof; thence at right angles South 360 53' East along the westerly line of the land described in the said deed to Emma Krebs, 14.68 feet to the most southerly corner thereof; thence at right angles South 530 07' West 146.50 feet to a. ^point on the easterly line of Broad Street; thence at right angles North 360 53' West along the easterly line of Broad Street, 102.30 feet to the point of beginning. PARCEL 2: That portion of Lot 5 in Block 86 of the Lands of A. Murray in the City of San Luis Obispo, according to the map thereof filed for record May�..l, 1876 in book A page 145 of Maps in the office of the county recorder of said county; and that portion of Lot 11 in Block 86 of the Mission Vineyard Tract in the City of San Luis Obispo, according to the map thereof filed for record March 8, 1873 in book A page 143 of Maps in the office of the county recorder of said county, described as follows: Beginning at the most westerly corner of the land described in the deed to John Muller recorded March 28, 1887 in book W page 396 of Deeds, said point being distant North 360 12' West 83.72 feet from a point on the northerly line of Marsh Street that is distant North 540 East 146.77 feet from the most northerly corner of Broad and Marsh Streets; thence North 360 12' West 14 feet 7 inches to a point on the south line of the land described in the deed to Ernest Krebs recorded April 23, 1884, in book S page 100 of Deeds; thence North 540 East along the southerly line of the land described in the deed to Ernest Krebs and its northeasterly extension, 49.30 feet to a point on the Westerly line of the land described in the deed to M. A. Elizalde recorded September 23, 1884 in book S page 497 of Deeds; thence South 360 33' East along the westerly line of the land described in the deed to M. A. Elizalde 13.78 feet to the most northerly corner of the land described in the deed to John Muller hereinabove referred to; thence South 540 West along the northerly line of the land described in said deed to John Muller, 49.40 feet to the point of beginning. PARCEL 3: That portion of Lot 8 in Block 86 of the Mission Vine- yard Tract in the City of San Luis Obispo, according to the map thereof filed for record March 8, 1873 in book A page 143 of Maps in the office of the county recorder of said county described as fol- lows: Beginning at a point on the southerly line of Fiiguera Street, as the 3 same now exists, which is distant South 530 071 West 121 feet from the southwesterly corner of Garden and Higuera Streets, said point also being the northeasterly corner of the land described in the deed to Frank C. Aston recorded February 11, 1922 in book 150 page 293 of Deeds; thence at right angles South 360 531 East along the northeasterly line of the land described in the deed to Frank C. Aston, 89.30 feet to the northerly line of an alley; thence at right angles North 530 071 East along the northerly line of said alley, 6.50 feet; thence at right angles North 360 531 West 89.30 feet;, more or less, to a point on the southerly line of Higuera Street; thence at right angles South 530 071 West along the southerly line of Higuera Street 6.50 feet to the point of beginning. PARCEL 4: That portion of Lot 10 in Block 86 of the Mission Vine- yard Tract in the City of San Luis Obispo, according to the map thereof filed for record March 8, 1873 in book A page 143 of Maps in the office of the county recorder of said county described as follows: Beginning at a point on the westerly line of Garden Street at the point of intersection of the line between Lots 10 and 11 in said Block 86 with the westerly line of Garden Street; thence at right angles South 530 071 West along the line between Dots 10 and 11 in said Block 86, 110 feet; thence at right angles North 360 531 West 40 feet; thence at right angles South 530 071 West 5 feet, more or ]e ss, to the line of the land described in the deed to C. A. Younglove recorded November 24, 1908 in book ?9 page 347 of Deeds; thence at right angles North 360 53' West along said line 7 feet to the southwesterly corner of the land described in the deed to C. L. Johnson and F. H. Johnson recorded February 29, 1912 in book 92 page 192 of Deeds; thence at right angles North 530 071 East along the southerly line of the land described in the Deed to C. L. Johnson and F. H. Johnson, 115 feet to the westerly line of Garden Street; thence at right angles South 360 531 East along the westerly line of Garden Street 47 feet, more or less, to the point of begin- ning, excepting therefrom the northeasterly 88 feet thereof. PARCEL 5: Those portions of Lots 5 and 6 in Block 86 of the Lands of A. Murray in the City of San Luis Obispo, according to the map thereof filed for record May 1, 1876 in book A page 145 of Maps in the office of the county recorder of said county; and those portions of Lots 11 and 12 in Block 86 of the Mission Vineyard Tract in the City of San Luis Obispo, according to the map thereof filed for record March 8, 1873 in book A page 143 of Maps in the office of the county recorder of said county, described as follows: Beginning at a point on the northerly line of Marsh Street, which is distant North 540 East 146.77 feet from the northerly corner of Marsh and Broad Streets; thence North 36o 121 West 83.72 feet; thence North 540 East 49.40 feet; thence South 360 331 East 83.72 feet to a point on the northerly line of Marsh Street;.thence South 540 West along the northerly line of Marsh Street, 49,93 feet to the point of beginning. Except therefrom that portion of said land described in the deed to the City of San Luis Obispo, a municipal corporation, by deed re- corded January 11, 1890 in book 7 page 2 of Deeds. PARCEL 6: Those portions of Lots 5 and 6 in Block 86 of the Lands cc A. Murray in the city of San Luis Obispo, according thereof filed for record May 1, 1876 in book A 1Ja5tof Maps in the office of the county recorder of said county, described as follows: A 4 Beginning at a point on the northerly line of Marsh Street, as widened, in the city of San Luis Obispo, distant thereon 146.50 feet northeasterly from the northeasterly corner of Marsh and Broad Streets and being the southwesterly corner of the land described in the deed to John Muller by deed dated March 21, 1887 and recorded in book W page 396 of Deeds; thence southwesterly along the northerly line of Marsh Street, 25 feet; thence at right angles northwesterly parallel with the easterly line of Broad Street, 74 feet to the southerly line of the land described in the deed to C. A. Younglove recorded November 24, 1908 in book 79 page 347 of Deeds; thence at right angles northeasterly along the southerly line of the land described in the deed to C. A. Younglove, 25 feet to the westerly line of the land described in the deed to John Muller as afore- said; thence at right angles southeasterly along the westerly line of the land described in the deed to John Muller, 74 feet to the northerly line of Marsh Street and the point of beginning. SECTION 4. This ordinance, together with the Ayes and Noes, shall be published for three days before its final passage in the Telegram- Tribune, a daily newspaper printed, published and circulated in said City, and the same shall take effect and be in force thirty days after its final passage.
