AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
APPROVING A PRELIMINARY DEVELOPMENT PLAN FOR
KSBY BROADCAST STUDIOS AT 1407 AUTO PARK MY (R1187)
WHEREAS, the Planning Commission and City Council have held hearings to
consider appropriate zoning for subject property in accordance with Section
65800 et seq. of the Government Code; and
WHEREAS, the rezoning has been evaluated in accordance with the California
Environmental Quality Act and the City's Environmental Impact Procedures and
Guidelines, and a negative declaration based upon an initial study has been
recommended; and
WHEREAS, the proposed zoning promotes the public health, safety, and
general welfare;
BE IT ORDAINED by the council of the City of San Luis Obispo as follows:
SECTION 1. The Council makes the following findings:
1. That the use and development plan are consistent with the general plan.
2. That the proposed development is suitable at this location.
3. That the planned development satisfies criteria 1 and 2 of Zoning
Regulations Section 17.62.040.
SECTION 2. The negative declaration subject to mitigation is approved.
SECTION 3. The preliminary development plan is approved subject to the
following conditions:
1. Pads for the dish antennae shall be relocated or so designed that they do
not encroach on the drainage channel easement, to the approval of the
Public Works Department.
2. Applicant shall provide gates through the security fence to allow access
to the drainage channel for maintenance, to the approval of the Public
Works Department.
3. Applicant shall red -curb at least 20 feet adjacent to the driveway ramp,
to the approval of the Public Works Department.
4. On the easterly side of the drainage channel, opposite the
microwave - antenna tower, applicant shall: (1) plant evergreen trees which
at maturity would reduce the visual impact of the tower from view by
potential residential development; (2) plant a variety of landscaping
materials throughout the site to minimize the visual impact of the tower
buildings and receiving..dishes to the approval of the Community
Development Department .

SECTION 4. This ordinance, together with the ayes and noes, shall be
published once in full, at least three (3) days prior to its final passage, in
the Telegram- Tribune, a newspaper published and circulated in said city, and
the same shall go into effect at the expiration of thirty (30) days after its
said final passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis
Obispo at a meeting thereof held on the -16th- day of October, 1 -984
on motion,of Councilman Griffin , seconded by Councilman Settle , and on the
following roll call vote:
AYES: Councilmembers Griffin, Settle, Dovey, Dunin and Mayor Billig
