ORDINANCE NO. 1043 (1985 Series)
AN URGENCY ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ADDING § 12.20.115 (Consumption of Alcohol Unlawful-in Mitchell Park)
of Chapter: 12.20 (Park Regulations) of the SAN LUIS OBISPO MUNICIPAL
CODE AND SETTING FORTH THE REASONS FOR ITS URGENCY
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Section 12.20.115 of the San Luis Obispo Municipal Code is
hereby added to read as follows:
12.20.115 Consumption of Alcohol Unlawful
It shall be unlawful for any person to consume any alcoholicbeverage in
Mitchell Park except for an activity conducted pursuant to a valid reservation.
SECTION 2. The Council declares that this ordinance is necessary as
an emergency measure to preserve the public peace, health or safety and finds the
following reasons to exist for its urgency:
1. There has been a significant increase in the number
of actual and perceived incidents of criminal or
undesireable activity involving the use of alcohol
in or near Mitchell Park; and
2. Neighborhood residents are unable to use the park
for its planned and regular purposes due to the
large number of persons using the park as a site
for the consumption of alcohol.
SECTION 3. This section shall be automatically repealed and of no
force and effect as of the effective date of Ordinance No. 1042 (1985 Series).

SECTION 4. The City Clerk shall cause this Ordinance to be published
within five (5) days in a newspaper of general circulation, but delay in publication,
or even failure to publish, shall not affect its validity.
