HomeMy WebLinkAbout1052• ORDINANCE NO. 1052 (1985 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE FINDINGS REQUIRED TO GRANT EXCEPTIONS TO CONDOMINIUM DEVELOPMENT STANDARDS BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Findings. A. The amendment is not a project as defined in the California Environmental Quality Act and the city's environmental guidelines. B. The amendment is consistent with the general plan. SECTION 2. Municipal Code Section 17.82.150 is amended to read as follows: 17.82.150 EXCEPTIONS TO PROPERTY IMPROVEMENT STANDARDS Upon request by a subdivider, the Council may approve exceptions to property improvement standards for new or conversion projects. The nature of the exception shall be described in public notices for council hearing on the condominium map. The Council may act on the request only after a public hearing. In order to approve an exception, the Council must find that: A. There are circumstances of the site, such as size, shape, or topography, distinct from land in the same zoning, or compliance would not be practical because of the location or site design; B. The variance will not constitute a grant of special privilege - -an entitlement inconsistent with the limitations upon other properties in the vicinity with the same zoning; and C. No feasible alternative to authorizing the exception would satisfy the intent of city policies and regulations. SECTION 3. This ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in this city.
