It was their studied opinion that the abandonment-of the parcel shown on the sketch filed with the application for abandonment, would include some land that might be required by the State of California. Some time ago a request was made to the State Highway Department for the' improvement of the North -bound Lane where Monterey Street enteres 101 'Highway. In order to assure the State of sufficient land to make the necessary improve - ments, we have requested Mr. Peterson to check the application for abandonment and report as to whether it would interfere with the State's future require- ments. As soon as Mr. Peterson.files his report, we will pass the report, with our Committee's recommendations on to you. Mission San Luis Obispo de Tolosa — Founded 1772 A I October 14, 1955• To the Member of the City Council: Mr. Powell of the California State Division of Highways, Dept. of Public Works, called regarding the abandonment of that portion of Monterey Street lying in front of the Motel Inn; he states (1) that he believes the State had fee title in the property involved and therefore, by relinquishing their rights transfer a fee title to the City of Sawn Luis Obispo. He further stated that an abandonment, in his opinion, would not transfer any interest in a fee title. (2) that the State Division of Highways is concerned about the reser- vations inthe event the land is transferred to another owner and would like to prepare a tentative quit claim deed for our consideration; thereforel it is my suggestion that the City Council, at. the meeting of October 17th, merely hear any protests to the advertised abandon- ment and postpone the Final Passage of Ordinance until we receive a full report from the State Division of Highways. Any future improvement of High- way 101 or the interchange at Monterey Street would probably involve a need for additional property near the Motel Inn. This is due to the fact that Parcel 9 of the description_ in the Relinquishment mentioned in the above report, stated that this is a portion of Block 36, 37 and 38 and portion of Murray and Monterey streets as shown on map of Phillips Addition, surveyed by Goodall in 1887. Note: property in question is sectional property which is not shown on the map which said Parcel 9 referred to. Said Parcel 9 then goes on to describe by metes and bounds our property and other property. It appears that the intent of said Relinquishment was to include the property in question, but did not do so, because of the map reference contained therein. With reference to item 1 of report above mentioned, the right of ways with which reference is made, are unlocatable. Moore and Eleanor Moore, husband and wife, to Title Insurance and Trust Company, a California corporation, as Trustee, to secure an indebtedness of $13,500.00 and other amounts as therein provided, in favor of John W. Fisher and Lurene W. Fisher, husband and wife, as tenants in common, recorded June 23, 1959, in Book 1007, atpage 599 of Official Records. Said Deed -of Trust contains the following provisions, among others: "This deed of trust is second snd subject to that certain deed of trust executed by Courtney L. Proceedings in the matter of the Estate of John W. Fisher, deceased, show that John W. Fisher, died on August 16, 1962 and that Lurene W. Included in the assets of this estate is a parcel of real property known as the Motel Inn located at 2223 Monterey Street, San Luis Obispo, California. Subject property is located near the north boundaries of the City north- east of the intersection of Monterey Street and U. S. Highway #101 and is a portion of the west half of the northwest quarter of Section 25, Township 30 South, Range 12 East, Mt. Diablo Base & Meridian, more particularly described as Assessor's Parcel 1- 081 -12 Code Area 3 -00 consisting of 2.757 acres more or less. It has come to our attention that a portion of the property on the north end of the property line (which was formerly a portion of ,Monterey Street) was never actually deeded by the City of San Luis Obispo to the adjacent land owner (Moores) but, rather, was vacated by Ordinance No. 12 (1955 -56 Series), which was finally passed on November 7, 1955• At the present time, the subject property is under lease and negotiations are pending with the lessees to rewrite and extend the lease to the satisfaction of all concerned. How -. ever, before the new lease may become effective, legal counsel representing the lessees insists that the City of San Luis Obispo officially deed the disputed property to the estate. However, it is the parcel shown as #2 on this map which apparently was a part of Monterey Street at one time but was never officially deeded to the estate.
