HomeMy WebLinkAbout0014NORDINANCE NO.14. ( NEW SERIES ) An Ordinance Prohibiting the Keeping of Bees Within the City of San Luis Obispo ". Be it ordained by tjj� Council of the City of SA-n Luis Obispo as follows:- Section 1.It shall be unlawful for any person, firm or corpor- ation to keep bees .within the corporate limits of the City of Sin Luis Obispo: provided that nothing 'herein contained smell be deemed to apply to the keeping of bees for the purpose of study or observation in a hive or box, which is situated and kept, ivithin a school house. Section 2.Any person, fins or corporation violating any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor, and upon conviction thereof shall be punishable by a fire not to exceed Fifty Dollars, or imprisonment in the City Jail not to exceed Ten Days, or by both such fine and imprisonment. Section 3.This Ordinance repeals all Ordinances or parts of Ordinances in conflict therewith. Section 4. This Ordinance together with the "Ayes" and "Noes" shall be published for wo days before its final passage in the a daily newspaper printed, published and circulatdd i said City of San Luis Obispo, and shall be in force, and take effect, thirty days from and after its final passage. All persons, firms or corporations now holding licenses under the provisions of said Ordinance i;o. 128 and the amendments thereto shall petition the Council for a license under this ordinance at 1.1 its regular neeting to be held on the ^kEJ4z day of December, 1911, and any holder of a license Who shall fail to petition the Council as above provided shall forfeit his license. Section 4J�' This ordance is hereby declared to be urgent and immediately necessary to pres�ve the public peace, health and safety, and shall take effect and be in force from. and after its final passage. Section,_Ei4,.This ordinance together with the ayes and noes shall 0 0 moral character, and sober and suitable persons to beep and conduct such -dace, and that the proposed place for carrying on sucli business is a suitable and proper place therefor, it shall by resolution order a license to be issued upon payment of the license fee therefor, specified herein, YJhich order shall remain in force not more than three months from the date of the same, and no license shall be renewed after three months except upon an application therefor being, received by the Council, and a license orderer issued as herein provided. I:i the Board finds that such aoplicants are not persons of good moral character, or are not sober and suitable persons to conduct such place, or that the proposed place for carrying on such business is not a suitable place therefor, it shall deny the petition. If t1le petition is denied no license shall be issued. Section I=: 0" Section 15 of an ordinance entitled " Ordinance No. 128 relating to regulating and licensing the business of selling and furnishing of spirituouq,vJInous and malt liquors in the -City of San -Luis Obispo" is hereby amended to read as 'Jollouts:— Section 15. The number of retail liquor,licenses in force at one time, under this ordinance, shall not exceed fifteen (15); provided, hoiiever, that all persons holding retail liquor licenses at the time this ordinance goes into effect shall be entitled to a preference in the issuance of licenses, and shall be entitled to have their licenses renewed. No license shall be issued for any bar —room, saloon, restaurant, hotel, or other place vihere vinous, spirituous or-malt liquors are sold by the glass, bottle, or otherwise to be drunk on the premises where sold, except upon the order of the Council of the City of San Luis Obispo. U enever any person or persons desire to open, keep or conduct amy suct: place they shall petition the Council to order a license issued therefor, ohich petition shall set 1_orth tli.e names of the applicants, the character of the business and t'-.e location of the premises where the business is to be con- ducted. I,o license shall belissued within six ( 6 ) days from the day that such petition is received by the Council. Any resident or tax payer of the City of San Luis Obispo may appoar before the Council and object to the granting affidavits to ^:prove that such applicants are not and are not sober and suitable per the proposed place for carrying on of such license „arid' May.' present persons of good moral character, 7,ons to conduct such a place, or that such business is not suitable or proper place thereform ' -� If the Ca.uncil finds such applicants to be persons of good UL of such place violated any of the provisions of this ordinance, or the laws of the State of California, or ordinances of this City now in force or which may hereafter be enacted, to sigh and present in person or by attorney a verified complaint against the holder of said license at a regular meeting of said Council, which complaint shall be in writing and shall set forth in a clear and noneise manner the facts constitut- ing the offense or grounds of complaint, and praying that the complaint be heard by the Council. Said zvmVI t-vt Council if said complaint be set ' t'he same in proper form and sufficiently charges an offense hhallj; for hearing at a day and hour not more than fifteen days aftew the same is present- ed to the Council, and shall direct the Chief of Police, or some other designated person, to deliver to the holder of the license, or person conducting said business, at least.five days before the time fixed for the hearing of the complaint, a written notice of the time and place set for the hearing of such complaint together with a copy of the com- plaint. The hearing of the charges preferred.in the complaint shall be carried on or conducted at an open meeting of said Bxardxafx Council, whether regular or special, and with the rules of evidence and procedure required by the Courts of this State in the trial of misdemeanors, and witnesses �shall be examined under oath. The holder of such license shall have the privilege of presenting evidence in his own behalf. If in the judgment of said Council after such hearing the existence of any of the causes specified in said complaint and in this ordinance has been proved to its satisfaction, l 0 S said Council . revoke and cancel said license, and in the event the same should be cancelled no further license shall issue to said person for the business specified in the license so revoked for a period of two years.
