ORDINANCE NO. 199 (New Series)
AN ORDINANCE ORDERING THE CLOSING UP AND
ABANDONMENT OF THOSE CERTAIN PORTIONS OF
FREDERICK STREET AND VICTORIA STREET, HERE-
INAFTER DESCRIBED, IN THE CITY OF SAN LUIS
OBISPO, COUNTY OF SAN LUIS OBISPO, STATE OF
CALIFORNIA.
WHEREAS, the City Council of the City of San Luis Obispo did
on the 12th day of June, 1939, pass its Resolution of Intention No.
426 (New Series), to order the closing up and abandonment of the follow-
ing described portions of Frederick Street and Victoria Street located
within the City of San Luis Obispo, County of San Luis Obispo, State of
California, to -wit:
and
(a) Frederick Street: Beginning at the point of intersec-
tion of the northwesterly line of Kuang Su Avenue and the
southwesterly line of Frederick Street; thence northeasterly
along the northeasterly prolongation of said northwesterly
line of Kuang Su Avenue, to the northeasterly line of Fred-
erick Street; thence northwesterly along said northeasterly
line of Frederick Street, to an intersection with the north-
easterly prolongation of the northwesterly line of Humbert
Avenue; thence southerly along a straight line to the point
of intersection of the southeasterly line of Humbert Avenue
with the southwesterly line of Frederick Street; thence
southeasterly along said southwesterly line of Frederick
Street to the point of beginning.
(b) Victoria Street: Beginning at the point of intersection
of the northwesterly line of Kuang Su Avenue with the south-
westerly line of Victoria Street; thence northeasterly along
the northeasterly prolongation of said northwesterly line of
Kuang Su Avenue to the northeasterly line of Victoria Street;
thence northwesterly along said northeasterly line of Victoria
Street to the southeasterly line of Humbert Avenue; thence
southwesterly along said southeasterly line of Humbert Avenue
produced across Victoria Street, to the southwesterly line of
said Victoria Street; thence southeasterly along said south-
westerly line of Victoria Street to the point of beginning.
WHEREAS, said Resolution described the work or improvement and
the land deemed necessary to be taken therefor, specified the exterior
boundaries of the district of the land to be affected or benefited by
said work or improvement and to be assessed to pay the damages, costs
and expenses thereof, and designated the Telegram- Tribune, a daily
newspaper published and circulated in said City of San Luis Obispo as

the daily newspaper in which the notice hereinafter referred to was to
be published by the Superintendent of Streets of said City of San Luis
Obispo; and
WHEREAS, said Superintendent of Streets did then, to -wit, on
the 16th day of June, 1939, cause to be conspicuously posted along the
line of said contemplated work or improvement, at no more than three
hundred feet in distance apart, but not less than three in all, notices
of the passage of said Resolution of Intention, No. 426 (New Series),
which said notices were in the form and set forth all the matters and
things required by law to be therein set forth; and
WHEREAS, said Superintendent of Streets caused a notice similar
in substance to be published for a period of ten (10) days in said
Telegram - Tribune; and
WHEREAS, more than ten (10) days have elapsed since the
expiration of the time of publication of said notice as aforesaid and
no objection whatever to said proposed work or improvement or to the
extent of the district of land to be affected or benefited by the work
or improvement has been filed with or delivered to the Clerk of said
City Council, or made to or received by said City Council; and
WHEREAS, the said City Council has given full and complete
consideration to the facts and evidence upon the question as to whether
or not the public interest and convenience require that all of the
hereinabove described portions of Frederick Street and Victoria Street
be closed up and abandoned;
and
WHEREAS, the public interest and convenience require that all
of the hereinabove described portions of said Frederick Street and
Victoria Street.be closed up and abandoned; and
WHEREAS, said proposed work is for the closing up and abandon-
ing, and it appears that no assessment is necessary; and

WHEREAS, no parcel of the hereinabove described portions of
said Frederick Street and Victoria Street, hereby ordered to be closed
up and abandoned, was acquired by the City of San Luis Obispo or by
the public by deed from any person or persons whatever.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF SAN LUIS OBISPO AS FOLLOWS:
Section 1. That the public interest and convenience require
that all of the hereinabove described portions of said Frederick
Street and Victoria Street be closed up and abandoned.
Section 2. That all of the hereinabove described portions
of said Frederick Street and said Victoria Street be and they are
hereby ordered closed and abandoned.
Section 3. This ordinance, together with the Ayes and Noes
shall be published for two days before its final passage in the
Telegram- Tribune, a daily newspaper printed, published and circulated
in said City, and the same shall take effect and be in force thirty
(30) days after its final passage.
