AN ORDINANCE PROVIDING FOR.THE LEASE OF
CERTAIN REAL PROPERTY OWNED BY THE CITY
OF SAN LUIS OBISPO.
BE IT ORDAINED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. It is hereby determined and declared by the City
Council of the City of San Luis Obispo that the public interest
demands and that it is to the advantage of the City of San Luis
Obispo that the real property hereinafter described be leased for a
period of one year, with the option to the lessee to renew such lease
for successive periods of one year, for the duration of the war now
in progress.
SECTION 2. Said. City Council does hereby determine and
declare that it is the intention of said City Council to enter into
a lease of said real property.
SECTION 3. When this ordinance shall take effect, the City
Clerk is hereby authorized and directed to advertise for bids and
for holding a public auction of said lease. A form of said lease
shall be prepared, and after approval of the form by the City Council,
shall be filed in the office of the City Clerk, and any lease awarded
shall be upon such form. During the period of advertising such form
of lease shall be open to public inspection, which fact shall be
stated in such advertising.
SECTION 4. Such lease shall be made at public auction to the
highest bid.der,at the highest monthly rent; provided, said City
Council may at its discretion reject any and all bids. Upon said lease
being.awarded the Mayor of said City is hereby authorized to execute
said lease for and on behalf of,said City, which execution shall be

attested by the City Clerk. ,�•
SECTION 5. The real property intended to be leased is
situated in the County of San Luis Obispo, State of California, and
is described as follows:
Lot or subdivision "D" as per map and survey of
Lots.S$, 61, 62263, 64 and 65 of James T. Stratton's
.survey and map of the subdivision of-the Ranchos Canada
de Los Osos and La Laguna, reference being made to a
map of said resubdivision of said lots made by
R. R. Harris and on file in the Office of the County
Recorder of the County of San Luis Obispo, except that
portion of said Lot "D" which lies.south and west of
San Luis Obispo Creek.
SECTION. 6. This ordinance is hereby declared to be an
emergency measure necessary for the immediate preservation of the
public peace, health and safety and shall take effect and be in force
from and after its final passage and adoption. The following is a
specific statement showing the urgency of this ordinance:
The United States is at war and the development and
marketing of minerals is vital to the prosecution of the war. The
real property intended to be leased is useful as a location for a
mineral stock pile, enabling minerals produced near the City to
be more readily handled and marketed.
SECTION 7. This ordinance, together with the Ayes and Noes
shall be published for two days before its final passage in the
Telegram- Tribune, a daily newspaper printed, published and circulated
in said City.
