HomeMy WebLinkAbout0255NI Sf' .7 I� ORDINANCE N0. 25,_ 5_( New Series) AN ORDINANCE LICENSING AND REGULATING THE BUSINESS OF CONDUCTING OR OPERATING CARD GAMES OR CARD TABLES AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Every person, firm, corporation or associa- tion engaged in the business of conducting or operating card games or card tables for hire or for a consideration, or who: conducts or operates card games or card tables for hire or for a consideration in conjunction with another business shall pay a license fee as follows: (a) Where only one such card game or card table is con- ducted or operated, an annual license.fee in the sum of $100.00. (b) Where more than one such card game or card tables are operated an annual license fee of $100.00 for every such card game or card table so conducted or operated. SECTION 2. It shall be unlawful to operate or conduct any card table or card game between the hours of 12 o'clock midnight and 6 o'clock A.M. of the day following. SECTION 3. Any license issued under the provisions of this ordinance to any person, firm, corporation or association shall not be deemed a license to deal, play, carry on, open or cause to be opened, or to conduct, either as owner or em- ployee, whether for hire or not, any game made illegal by the provisions of the Penal Code of the State of California or by the provisions of any statute of the State of California. SECTION 4. Any building, room or premises to which a license shall be granted under the provisions of this ordin- ance shall be deemed to be a public place, and all Police Officers and Peace Officers shall have free access thereto. o�SS� s • — 1�- n.. No such building, room or premises shall be kept locked during business hours, nor shall any card table or card game be conducted or operated behind locked doors. No minor under the age of twenty -one years shall be employed in or shall be allowed to frequent, remain in or visit the room or premises wherein is conducted or operated any card game or card table licensed under the provisions of this ordinance. SECTION 5. No license shall be issued under the pro- visions of this ordinance except upon order of the City Council.- The provisions,of Ordinance No. 76 (New Series) of the City of San Luis Obispo defining the respective duties of the City Clerk and the City Collector in the issuance, collection and accounting on all licenses are hereby made a part of this ordinance. SECTION 6. The violation'of any of the provisions of this ordinance shall be sufficient cause, and the City Council is-hereby given the.power and authority, to revoke any license issued under the terms of this ordinance. SECTION 7. Any person, firm, corporation or association violating any of the provisions of deemed guilty of a misdemeanor and shall be punished by a fine of not imprisonment in the County Jail of Obispo for a period of not exceedi such fine and imprisonment. this ordinance shall be upon conviction thereof to exceed $500.00, or by the County of San Luis a.g six months, or by both SECTION 8. This Ordinance, together with the Ayes and Noes shall be published for two days before its final passage in the Telegram- Tribune, a daily newspaper printed, published and circulated in said City, and the same shall take effect and be in force thirty days after its final passage. - 2 - f` l ' , INTRODUCED AND PASSED to print this 7th day of August, 1944, by the following vote: AYES:R.P.Howell,RalphC.
