FRISBY W HE RE AS, The City of San Luis Obispo, hereinafter .called City, desires to acquire certain property on Johnson Avenue for street widening purposes from James C. and Mildred C. Frisby, hereinafter called Frisby; and I 11 H E E. E A S , Frisby desires to acquire certain property from the City of San Luis Obispo to widen their lot located on Johnson Avenue; and V1 H E R E A S , the parties have agreed upon the respective values of the parcels and the improvements to be made by the parties hereto; N O V1, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the Council shall convey to Frisby the parcel shown on Exhibit "B ", attached hereto and incorporated by reference, in exchange for conveyance by Frisby to the City of San Luis Obispo of the parcel shown on Exhibit "A ", attached hereto and in- c orporated by reference. SECTION 2. That, pursuant to the agreement between the parties hereto, Frisby shall pay to the City the sum of $428.00 as the net land value, plus $234.00 for paving of the street, and Frisby agrees to install standard curb, gutter and sidewalk across the entire frontage of the two parcels at the new setback line within thirty (30) days after notice from the City to construct. SECTION 3. This ordinance, together with the ayes and noes, shall be published once in full, at least three days before its final passage, in the Telegram- Tribune, a news- paper published and circulated in said City and the same shall go into effect at the expiration of thirty days after its said final passage.
