HomeMy WebLinkAbout0330ORDINANCE NO. 330 (1965 Series) AN ORDINANCE PROVIDING REGULATIONS FOR MOVING BUILDINGS IN THE CITY OF SAN LUIS OBISPO BE IT OR DA I NE D by the Council of the City of San Luis Obispo as follows: SECTION I. That Sections 8800 through 8800.17 of the San Luis Obispo Municipal Code shall be and are hereby repealed. SECTION 2. That the following Sections are hereby added to Article VIII of the. San Luis Obispo Municipal Code, to read as follows: CHAPTER 6 - MOVING OF BUILDINGS Section 8800. Purpose. This Chapter is intended to establish procedures for the relocation of buildings, subject to safeguards to ensure that such buildings are structurally sound or will be repaired and that they will harmonize with existing development in the area to which they are to be moved. Section 8800.1 Approval Required. No person shall move any building into, from, or through the City of San Luis Obispo except as provided herein, without first obtaining the approvals required by this Ordinance. Exceptions. The following, when of a size which can be carried on a trailer or truck without projecting at the sides or rear, or exceed normal height restrictions, pro- vided they comply with Sub - Sections 8800.3 (F) and (G) of this Ordinance, and all other City codes and regulations: 1. Temporary construction offices. 2. New prefabricated buildings or'components. 3: Garage, woodshop or tool shed. 4. Building moved within a lot or to an adjoining lot in the same ownership. Section 8800.2 Application, Fees and Bond. A . Application. Application shall be made in triplicate on a form supplied by the Building Department, accompanied by the fees and plans stated thereon. B. Fees. Dollars ($15'00) 1. For moving a building from one part of the City to another, Fifteen .. 2: For moving a building out of the City, no fee. Cents ($0.15) for each mile by road from the City limits Fifteen o the existing l(ocation,' plus Fifteen g C. Bond. The applicant shall post with the City a bond satisfactory to the City Clerk in the value of One Thousand Dollars ($1,000.00). Said bond shall guarantee: L Cleaning of the former site as required by Section 8800.3 F. 2. Completion on the new site as required by Section 8800.3 G. Work needed to correct any of the foregoing matters may be carried but or contracted by the City after the time limits stated and shall be paid for from the bond. The bond shall not be released until such work is completed. . Section 8800.3 Procedure. The following procedure shall be followed for any application to move a building ex- cept that buildings to be moved out of the City need only comply with Sub - Sections (E) and (F) . A. Referrals. ! Copies of the application shall be sent to the City Engineer and the Police Department. B. Posting. The structure and proposed location shall be posted by the Building Department on each street frontage at each site at least seven (7) days before a hearing by the Board of Adjustments. Such posting shall indicate the existing and proposed locations, and the time of the hearing. C . Inspection. Prior to the hearing, an official of the Building Department shall inspect the building. D. Hearing. The Board of Adjustments shall hold a hearing on the proposed moving and shall approve, conditionally approve, or deny the application, based on the following con- siderations: 1: The Building Inspector's report on the condition of the structure. 2. The appearance of the structure related to existing development in the vicinity of the proposed site. 3: Protests from residents in the vicinity of the proposed site. 4. Conformance with City ordinances. E . Issuance of Permits. 1. Upon approval of an application to move a building, the applicant shall obtain a Transportation Permit from the City Engineer. 2. A Building Permit must also be obtained, if required. F. Cleanup of Former Site. Within thirty (30) days after removal of the building, the site shall be cleared of remaining portions of buildings and debris; utilities shall be sealed off, and any excavation or basement shall be filled level with the adjoining ground. G. Completion on New Site. Within ninety (90) days of the move, all incidental work shall be completed to a stage where the building is habitable and a final inspection may be made by the Building Department, plus any external repairs, repainting, and grading needed to make the building and site compatible with the neighborhood. H. Appeal. 1. Any person aggrieved by any decision made pursuant to this Chapter may appeal to the Planning Commission. 2. A subsequent appeal may be made to the City Council. 3. Appeals must be submitted in writing, within five (5) days of the decision, and will be placed on the next open agenda. -2- SECTION 3. This Ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days before its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage. Copies of the proposed or are on file in the Office of the City Clerk at the City Hall for public inspection. SAID PUBLIC HEARING will be held on Monday, November 15, 1965 at 8:15 P. SUBJECT: Building Moving Ordinance The Commission has been concerned for some time at the shortcomings of the House Moving Ordinance adopted in x1955. This Ordinance limits house moving to the night `time period and has no requirements regarding clean up of old sites and completion of buildings on new sites. The administrative procedure also does not correlate applications with the City Engineer and Police Departments. A new Ordinance has been drafted which will simplify pro- cedures, require clean up of former site and completion on the new site and enable approval to be given by the Board of Adjustments rather than the Planning Commission. Resolution No. 127 -65 of the Planning Commission recommends that the Council hold the necessary public hearings on this Ordinance with the view to its adoption. PC:vlo
