ORDINANCE NO. 338 (1966 Series)
AN ORDINANCE AUTHORIZING E)KCHANGE
OF REAL PROPERTY
W H E R E A S , the Council of the City of San Luis Obispo has determined that the
Property hereinafter described as Parcel A is necessary for public use as an off- street parldng
facility; and
W H E R E A S , the Council has determined that the City owned property hereinafter
described as Parcel B is not necessary for present or future public use purposes; and
W H E R E A S , the Council has determined that it is in the public interest to exchange
said parcels;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. That the City of San Luis Obispo hereby agrees to exchange the
property owned by said City, hereinafter described as Parcel B, for the property owned or
being acquired by Serafino Martinelli and Carmel Martinelli, hereinafter described as Parcel
A.
SECTION. 2. That bcth are to be free; and cicar of liens, but subject to leises,
covenants and conditions of record.
SECTION 3. That the Mayor is hereby authorized to execute necessary deeds and
documents to accomplish said exchange.
SECTION 4. That said parcels are described as follows:
PARCEL A:
All that certain real property situate in the County of San Luis Obispo, State
of California, described as follows:
That portion of Block 14 of the City of San Luis Obispo, county of San Luis
Obispo, State of California, according to map filed for record May 1, 1878 in Book A at Page
168 of Maps, in the office of the County Recorder of said County, described as follows:
Beginning at a point on the Northerly line of Monterey Street, in said City,
distant thereon, North 540 06' East, 109.31 feet from the Northeasterly corner of Chorro and
Mdrnerey Street, thence North 350 54' West, 80.00 feet to a point; thence North 540 06' East
12.67 feet 'to a point; thence North 350 54' East, 34.17 feet to a point; thence North 330 02'
West, 148.54 feet to a point; thence North 360 22' West, 86.50 feet to a point on the Southerly
line of Palm Street as shown on said map; thence along said ;southerly line North 530 38' East,
12.00 feet to a point; thence South 36° 22' East, 70.25 feet to a point; thence South 81° 22'
East, 8.13 feet to a point; thence North 5310 38' East 36.75 feet to a point; thence North 8° 38'
East, 8.13 feet to a point; thence North 360 22' West, 13.75 feet to a point; thence North 50°
13' East, 38.16 feet to'a point; thence South .35° 54 "East, 148.56 feet to a point; thence
South 540 06' West, 45.75 feet to a point; thence South 35° 54' East, 146.00 feet to a point on
the Northerly line of said Monterey Street, thence along said line South 54o 06' East, 72.44
feet to the point of beginning,

EXCEPTING THEREFROM that portion thereof included within the present lines of Monterey
Street.
PARCEL B:
All that certain real property situate in the County of San Luis Obispo, State
of California, described as follows:
That portion of the R. R . Harris resubdivision of Lots 58 and 61 -65 as per
J. T. Stratton's survey and map of the subdivisions of the Ranchos Canada De Los Osos Y La
Laguna as shown on page 161, Vol. A of Maps, in the office of the County Recorder, County of
San Luis Obispo, State of California, described as follows:
Beginning at point 'I'; thence S 48° 30' W along the northwesterly line of
Madonna Road a distance of 1020 feet to a point; thence N 430 30' W a distance of 20.01' to the
true point of beginning; thence N 430 30' W a distance of 400.24' to a point; thence S 480 30'
W a distance of 1138.00' to a point; thence S 430 30' E a distance of 400.244 to a point; thence
N 4810 30' E along a line parallel to and 20 feet northwesterly of the northwesterly line of
Madonna Road (formerly known as French Road) a distance of 1138.00 feet to the true point of
beginning.
EXCEPTING THEREFROM all that portion of this parcel of land deeded to the State of California.
as shown on sheet 4 of 5 of the right of way maps of the Madonna Road overcrossing, Dist. V,
San Luis Obispo 2, San Luis Obispo, containing 10.28 acres, more or less.
ALSO EXCEPTING THEREFROM land conveyed to the State of California by deed dated January
8, 1962 in Book 1170 at Page 738 of Official Records.
SECTION S. This Ordinance, together with the ayes and noes, shall be published
once in full, at least three days before its final passage, in the Telegram - Tribune, a news-
paper published and circulated in said City, and the same shall go into effect at the expiration
of thirty days after its said final passage.
