AN ORDINANCE CREATING UNDERGROUND UTILITY DISTRICTS
NUMBERS 2, 3, 4 & 5
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. That pursuant to public hearing duly held in accordance
with Chapter 4 of Article VIII of the San Luis Obispo Municipal Code, the
following described areas are hereby declared as Underground Utility Districts
as follows:

2 Between the center lines of Osos, Higuera,
Morro and Mill Streets.
3 Between the center lines of Osos, Marsh,
Chorro and Higuera Streets.
4 Between the center lines of Morro, Higuera,
Chorro and Mill Streets plus the westerly
side of Chorro Street between Mill and
Palm Streets and including the properties
facing thereon.
5 Between the center lines of Chorro, Marsh,
Broad and Higuera Streets,
SECTION 2. That the City Council does hereby find that the public
necessity, health or safety requires the removal of all poles and overhead wires
and associated overhead structures from the public streets, alleys or ways within
the above described areas, and the underground installation of wires and facilities
for supplying electric, communication, or similar or associated service therein.
SECTION 3. That the City Council does hereby order the removal of all
poles and overhead wires and associated overhead structures from the public
streets, alleys or ways and further fixes dates on which affected property owners
must be ready to receive underground service as follows:

SECTION 4. That the City Clerk of the City of San Luis Obispo is hereby
instructed to notify all affected utilities and all persons owning real property
within Underground Utility Districts of the adoption of this Ordinance-within ten
(10) days after the date of such adoption. Said City Clerk shall further notify
said property owners of the necessity that, if they or any person occupying such
property desires to continue to receive electric, communication or other similar
or associated service, they or such occupant shall provide all necessary facility
changes on their premises so as to receive such service from the lines of the
supplying utility or utilities at a new location in the front sidewalk area
adjacent to or at the property line unless the utility specifies some other
location as provided-in Section 8400.7 of the Municipal Code, subject to applicable
rules, regulations and tariffs of the respective utility or utilities on file with
the Public Utilities Commission of the State of California and to the requirements
of State laws and the Municipal Code. Such notification shall be made by mailing
a copy of this Ordinance, together with a copy of Sections 8400 to 8400.10,
inclusive, of the Municipal Code to the affected utilities and to affected property
owners as such are shown on the last equalized tax roll of the City of San Luis
Obispo.
SECTION 5. This Ordinance, together with the ayes and noes, shall be
published once in full, at least three days before its final passage, in the
Telegram- Tribune, a newspaper published and circulated in said City, and the same
shall go into effect at the expiration of thirty days after its said final passage.
