HomeMy WebLinkAbout0468SPACE NO. 468 X1969 ie s) AN L _DiNAI10E AUTHORIZING AND APPROVING, AN EXCHANGE OF EASEMENTS rC_: PUBLIC PURPOSES. gHEP.EAS, the Council of the City of Can Luis Obispo has deterr.ined that the easement hereinafter described on Exhibit "A" is not presently used for public purposes and would be unnecessary for future use if an area of equal size could be P;:O- vided contiguous to the facilities now in place on the property by the owners thereof; and WHEREAS, the owners of the property burdened by easement described on Exhibit "A" have offered to give in exchange for said easement the easement described on Exhibit "B" covering an area equal to that which would be relinquished by the City as shown on Exhibit "C "; and WHEREAS, said easements are of equal value and the Council has determined that it is in the public interest to exchange said easements, NM,V, THEREFO]EE, BE IT ORDAIN i3 " by the Council of the City of Can Luis Obispo as follows: SECTION 1. The City of San Luis goispo hereby agrees to exchange that portion of the easement previously reserved by the City of San Luis Obispo described on Exhibit "A" for the easement described on Exhibit "B ", both of which exhibits are appended hereto and incorporated herein by reference as fully as if set forth below. SECTION 2. The -� a.yor is hereby authorized to execute an appropriate quitclaim deed describing the property on Exhibit "A" upon receipt of an easement in proper form describing the property on Exhibit "B" and thereupon to execute an appropriate certificate accepting; the easement set forth on Exhibit "B ". SECTION 3.
