It shall be unlawful for any person, whether ` 18 as principal or agent, clerk or employe, either for himself or any 19 other person, or any body= corporate, or otherwise, or as officer 20 of any corporation, to commence or carry on any trade, calling, 21 business, or occupation in this ordinance specified, without first. .22 having procured a. license from said City so to do, and each and 23 every.day or fractional part of a day thtt said trade, calling, 24 business or occupation in this ordinance specified is conducted or 25 carried on without such license shall constitute a violation of 26 this ordinance, and any person who shall Violate any of the pro - 27 visions of this ordinance or who shall for himself or for any other 28 person or persons, or for any body corporate, or otherwise, commence 29 or carry on any trade, calling, business or occupation aforesaid 30 without first having procured such license, shall, for each violat- 31 ion of this ordinance, be deemed guilty of a misdemeanor, and, up- 32 on conviction oy any court having; jurisdiction tL,eveof, shall be fined therefor in a sure of not less than ten ( ";) )10900) Dollars, and 1 not more than three hundred ($300.00) dollars, or be imprisoned 2 for a term not exceeding thirty (30) days, or shall suffer both 3 such fine and im risonmert and the amountof ch 1'cense shall 4 beIliable to an action in the name of the City of San uis Obispo,, 5 in any court of competent jurisdiction, for the amount of the p 6 license of such trade, calling, business or occupation, as he 7 shall or they may be eng�:.,ged in, with costs of suit. 8 Provided, ho.o;ever, that arrest and conviction hereun L" 9 der shall not be con.:trued as.a waiver of the right of said city, 10 to bring such civil action, nor, shall the bringing of such civil; 11 action release the defendant therein, or any other person, from 12 such criminal prosecution. 13 Section_ III. It shall be the duty of the City Clerk 14 to prepare and issue a License udder #-,4,-e ordinance for every per-; o o 15 son , firm, or corporation liable to pay a license hereunder. 16 Each license shall state the amount thereof, the period of time zto 17 covered thereby, the name of the person, firm or corporation for: 18 whom issued, the trade, calling, business or occupation licensed, 19 and the location of the place of business where such trade, call - 20 ing, business or occupation is to be carried on. Said City Clerk i 21 shall sign and deliver the sa.rre to the City Collector for collect - 22 ion and take his receipt for :he amount thereof. 23 In no case shall any mistake by the C_ty Clerk or City 24 Collector in stating the amount of a license prevent or prejudice 25 the collection for the city of chat shall be actually due from 26 any one carrying on a, trade, calling, business or occupation 27 subject et to license under this ordinance. 28 Section Iii. All.lice_Ises shall be paid in advance 29 in the legal currency of the United States, at the office of the 30 City Collector. A separate license must be obtained for each 31 branch establishment or separate place of business in which the 32 trade, calling, profession or occupation is carried on, and each -2- L" t 4b 1 license shall authorize the party obtaining it to carryon, pur- 2 sue, or conduct only that trade, calling, profession or occupation 3 described in such license, and only at the location or place of 4 business which is indicated thereby. 5 The monthly licenses' in this ordinance provided shall 6 be due and payable to the city on the first of each month, in ad -t 7 vance, from all persons who have for the previous month been lic 8 ensed to carry on the same trade, calling, profession_ or occupation, 9 and from all persons who have not been licensed for the previous 10 month for the same trade, calling, profession or occupation the 11 license shall be due and -aid pay, and mint be procured by such 12 persons before commencing o g carry on such trade, calling, profess= 13 ion or occupation. 14 The quarterly licenses in this ordinance provided shall z - e 15 be due and payable to the city on the first days of January, April, �aU lg gym& July and October, and all such licenses shall expire with the lust, 17 Z ° c3��+ra� ch e -r r , awl 1 s„ cr. - � 18 r tom, days of March June, 8eptemebr, and December of each 19 year, but the .first quarterly license issued to any person, as herein 20 provided, shall be issued for the unexpired one -third or two - thirds 21 of the current quarter, except as may be herein provided. 22 The weekly licenses in this ordinance provided shall be 23 due and payable to the city on the Monday of each week ir? advance. 24 The daily licenses in this ordinance provided shall be 25 due and pa g a hi le zxx to the city eac day in advance. 26 The annual licenses in this ordinance provided shall 27 be due and payable to the city at the times specified herein res- 28 ectivel_ p y, or when not so specified, on the first day of July of 29 each ydar. 30 No greater or less amounts of money shall be charged 31 or received for any licenses than are provided in this ordinance an 3ce 2 and no license shall be sold or issued for any period other, than -3- 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 z ° a 15 w 16 z o° 17 aka a 18 a M IV 20 21 22 23 24 25 26 27 28 29 30 31 32 is provided in this ordinance. Section V. The City Clergy: must prepare and have printed licenses of all classes mentioned in this ordinance, for the term of three months aria for such shorter terms as are hrein authorized to be issued, with a blank receipt attached for 1 the signature of the City Collector when issued.in substantially 4 f the following form: "No.......... RECEIVED.. ....... ....... 19 ....... the sum above specified for said License. ..... ... ..... • City Collector." � The licenses so prepared by the City Clerk shall be bound in books of suitable size and shall have a stub correspond ing thereto which shall remain in the book after issuance. On this stub shall be noted the number of the license, the date there of, to whom issued, for what, the time when it expires, and the amount paid. City 8 Section VI. The City Clerk must keep an account with 9 the City Collector of all licenses delivered to him, issued, or 10 returned unissued by him; a correct statement of the Collector's 11 license account must be certified to the City Council each month 12 by the City Clerk, But the City Clerk shall not give the City 13 Collector credit for, nor shall the City Collector be entitled 14 to have credit for any unissued license, without first procuring 0 0 15 the cancellation thereof by and through the City Council. Every solicitor or order agent soliciting or 22 taking orders frog house to house for the sale o:F- purchase of 23 - books, maps, charts, photographs, pictures, paintings or other 24 goods, wares or merchandise, with or without samples either for 25 present or future delivery, when not in conjunction with any store' 26 or rather fixed place of business paying a license fee to. the City 27 of �,a.n Luis Obispo, whether such books, maps charts photographs, ; 28 pictures, paintings, or other goods., wares or merchandise shall be 29 in his actual possession or not, shall pay a license fee of (k5.00) 30 Five Dollars per day or (,25.00) pax Twenty -five Dollars per week. 31 Sub92.
