HomeMy WebLinkAbout0659f } ORD *CE NO. 659 (1976 Series)40 1 AN ORDINANCE AMENDING 'tH.9 OFFICIAL ZONE MAP OF THE CITY OF SAN LUIS OBISPO (TO REZONE PROPERTY AT 1330 SOUTHWOOD DRIVE). BE IT ORDAINED by the City Council of the City of San Luis Obispo as follows: SECTION 1. That the following described portion of the City of San Luis Obispo as shown on the Official Zone Map of the City of San Luis Obispo be reclassified as follows: Said property is also shown on the map attached hereto marked Exhibit "A" and incorporated herein by reference. From District PD R -2 (Planned Development - Medium Density Residential) to PD R- 2.76 -1 (Planned Development - _Medium. Density Residential) real property described as: Parcel 3 of Parcel Map No. SLO -71 -242 in the City of San Luis Obispo, County of San Luis Obispo, State of California, recorded November 22, 1971, in Book 7, Page 34 of Parcel Maps. Together with that certain easement for ingress and egress over that certain land described as Parcel 9 in the Declaration of Easement recorded February 16, 1972, in Book 1658, Page 994 of Official Records. Also known as 1330 Southwood Drive. Approval is subject to the following conditions: 1. The applicant shall, within six months of this preliminary plan approval by the City Council, submit the final plans as approved by the Architectural Review Commission and Waterways Planning Board to the Planning Commission to insure compliance with this preliminary plan. Verification of conformity, by the Planning Commission, shall be required prior to issuance of any building permit. 2. The applicant shall submit documents for approval of the City Attorney, signed by all property owners of both phases, agreeing to common driveway easement, including a "tow away upon complaint" arrangement for the common driveways and parking areas. Such agreement shall be approved and recorded prior to occupancy of any portion of this project. 3. The project shall be reviewed by the Waterways Planning Board and modified per their recommendations. 0 659 a Ordinance No. 6590 2 106 Series) a_ f 4. The project shall be subject to approval �y the Architectural Review Comm. 5. There shall be no construction of structures within the 12 ft. wide sewer line easement along the west property line. This may require a minor plan modification. 6. Precise plans shall be submitted and approved within six months from date of approval of the planned development by the City Council; the commence= ment of construction shall occur within 6 months after approval of the precise plan; the applicant will have 12 months thereafter to complete. the project. 7. Property development may be phased provided common improvements (Lot 10) are completed prior to occupancy of any unit, with deferred installation of pedestrian walk acceptable adjoining Lots 5 -9 if assured by cash deposit. SECTION 2. This Ordinance, together with the ayes and noes, shall be published once in full, at least three days prior to its final passage, in the Telegram- Tribune, a news- paper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its said final passage.
