HomeMy WebLinkAbout0699ORDINANCE NO. 699 (1977 Series) r AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AUTHORIZING SALE OF SURPLUS REAL PROPERTY LOCATED ADJACENT TO THE SEWAGE TREATMENT PLANT. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Pursuant to the provisions of Government Code, Sections 37350 and 37351 and City Charter Section 725, this Council hereby authorizes sale of the following described real property ;to San Luis Obispo Aerie 3389, Fraternal Order of Eagles: That portion of Lot 14 of the San Luis Obispo Suburban Tract, in the City of San Luis Obispo, County of San Luis Obispo, State of-California, as per map filed in Book 1 Page 92 of Record of Surveys, in the Office of the County Recorder of said County, described as follows: Beginning at the point of intersection of the Westerly line of Higuera Street and the Northerly line of said Lot 14, thence North 64 005' West along the Northerly line of Lot 14 a distance of 182.78 feet to the true point of beginning, thence South 25 155' West along the Westerly line of land described in Volume 1799, Page 464, a distance of 178.90 feet to a point, thence North 64 005' West, a distance of 100 feet to a point, thence North 25 055' East, a distance of 178.90 feet to the Northerly line of Lot 14, thence South 64 °05' East along said Northerly line of Lot 14, a distance of 100 feet to the true point of beginning. The purchase price of said property shall be $6,000.50. Upon the.effectivei.date of this Ordinance, the Mayor is authorized to execute a quitclaim Deed for this property. SECTION 2. This Ordinance, together with the ayes and noes, shall be published once in -full, at least three (3) days before its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its said final passage. Peterson, City Engine RE: Surplus Property at Sewer Farm Last Fall the Eagles requested the City to sell to them approxi- mately .4 of an acre of land immediately behind their facilities. At Council direction, staff has had an appraisal conducted and is now prepared to offer the property for sale. Our Attorney indicates that we must advertise an invitation to bid 10 days prior to the date set for opening of bids. After the bids are opened, additional bids may be received until such time as the Council determines whether or not it wishes to accept a bid. Attached is a proposed invitation to bid which indicates the pro- cedure and a condition, the condition being "Bidders are advised that the property will be conveyed with the provisions that no access is to be provided and that no building permits will be is- sued without provision of frontage on a public street and com- pliance with other city regulations ". RECOMMENDATION Staff recommends that the minimum bid acceptable for the propertyy. be $5,850. This is based on the appraisal and City costs etke-f Vt, •• wJa Attorney 4eeo and appraisal fees. Staff also recommends that the invitation to bid be advertised and bids received on April 4, 1977 up to 5:00 p.m. Bids shall be reported to the Council at its meeting of April 5, at which time additional bids may be received. The Council then will make the determination whether or not it wishes to sell to the highest bidder. Consideration of Level I sewer deficiency in conjunction with Minor Sub. 77 -148, Eagles Lodge.Hall, 3650 S. Higuera Street. Associate Planner, Dan Smith, presented the staff analysis explaining that the subject property is not served by City sewer. He stated staff is recommending that the subdivider be required to extend a 12 inch sewer main in S. Higuera St. right -of -way from approximately 1300 ft. south of the subject site to and across the entire street frontage of the subject property. Commr. Johansen said he thought the cost of extending this sewer was exorbitant and therefore he said he could not support the staff's recommendation. On motion of Commr. Johansen, seconded by Commr. Schneider, Resolution No. 1088 -77 was adopted, recommending to the City Council note the deficiency but that the subdivider not be required to install a 12 inch sewer main in S. Higuera St. right - of -way from approximately 1300 ft. south of the subject site to and across the entire street frontage of the subject property. VOTING: Aye - Commrs. Miller, AdministrAtive OtAicer FROM: Dan Smith, Associate Planner SUBJECT: Planning Commission recommendation regarding Level I 604 -A Sewer Deficiency - Minor Subdivision /Use Permit Request, 3650 South Higuera Street, Eagles Lodge, applicant Statement of Deficiency The subject property is not served by City sewer. The nearest existing public sewer is located approximately 1200 feet away in Higuera Street. The subject property is currently served by on -site septic tank. The applicant is requesting a use permit to construct a new and larger lodge facility. Staff Evaluation: Staff recommended to the Planning Commission that the applicant be required to extend a 12 inch sewer line in Higuera Street for a distance of approximately 1200 feet. The cost of the sewer extension would be approximately $30,000 based on estimates of the City Utility Engineer. The City would, per current policy, compensate for the cost of oversizing of the sewer line (difference in cost between standard 8 inch line and required 12 inch line) if the applicant followed City procedure for construction. The difference in cost would amount to approxi- mately $6,000. The applicant would also be eligible for reimbursement per City schedule by developers who later connected to the portion of extended sewer line. It may be worth noting that the west side of Higuera Street is fully developed and therefore provides no opportunity for applicant reimbursement. The east side is undeveloped however, and may provide some.reimbursement depending upon develop- ment design. Planning Commission Recommendation r The Planning Commission recommended that the deficiency be noted but that the applicant not be required to extend the sewer line. It appeared that the Planning Commission`Telt that the size of the project did not warrant the relatively expensive off site improvement ..J The lack of sewer would obviously hurt the development potential of the site depending on soil capability which staff understands is relatively poor. County Health Department approval would also be required. for any expanded use of the septic tank facilities. Council Agenda /July 5, 1977 Minor Sub /Use Permit - 3650 S. Higuera Page 2 Staff Recommendation: rStaff recommends that the applicant be required to extend the 12 inch sewer main approximately 1200 feet to and across the frontage of the subject property as an off site improvement as a requirement of Ordinance No. 604 -A. Further, the Council should authorize City contribution for sewer line oversizing if City procedure for construction is followed.
